The Perilous Necessity: Nonlegal Materials In A Family Law Course, Robert Levy Jan 1963

The Perilous Necessity: Nonlegal Materials In A Family Law Course, Robert Levy

Articles

Even the most casual observer should be aware that we are living through a period of intense interest by law professors in the behavioral sciences. No volume of the Journalof Legal Education is published without at least one essay on a law school program, a design for cooperative research or a criticism of the lawyers for paying no heed to their more scientific brethren. A review of A.A.I.S. convention agendas would indicate, I am sure, very few meetings without some discussion of "Law and the Behavioral Sciences."' The interest manifests itself in a variety of ways, 'but nowhere more actively, …

Some Thoughts On "Antitrust Policy" And The Antitrust Community, Robert Levy Jan 1961

Some Thoughts On "Antitrust Policy" And The Antitrust Community, Robert Levy

Articles

In this article, ProfessorLevy uses a recent book recom- mending extensive changes in the antitrust laws as a springboardfor discussion of one of the most complex and difficult problems of antitrustadministration:the lack of competition in the "concentrated,"or oligopolistic,in- dustries. The author suggests that reform through legis- lation is probably impossible because of the current cli- mate of opinion and the effectiveness of numerous anti- trust "hucksters"-laivyers and businessmen who fre- quently sacrifice accuracy and objectivity in pursuing re- sults they favor. ProfessorLevy suggests a new interpre- tation of the present Sherman Act to avoid the difficul- ties of legislative modification. His …

Riparian And Public Rights To Lakes And Streams, Ralph W. Johnson

Articles

The purpose of this article is to assist in the re-examination of Washington water law by looking at the parts of that law encompassed within the labels "riparian" and "appropriation." The first few pages will sketch some of the current trends in water use, showing some of the remarkable differences in use between the first part of the century and today, and between the eastern and western parts of the state. The balance of the article will examine the two systems to see where they are meeting current needs of the state and where they are not. Several questions will …

The Columbia River System, Ralph W. Johnson

Articles

In March, 1959; the International Columbia River Engineering Board submitted its report on the co-operative development of the river to the International Joint Commission. In December, 1959, that Commission submitted to the governments of Canada and the United States its recommendations for apportionment of benefits if co-operative development is undertaken. And thirdly, in the last two years there has been much attention directed at the Peace River development, which is considered by some as competitive with the Columbia. Let us examine the effects of these events on the Columbia River problem. A presentation for Panel II, Current Legal Problems Connected …

The Supreme Court And State Power To Deal With Subversion And Loyalty, Roger C. Cramton Jan 1958

The Supreme Court And State Power To Deal With Subversion And Loyalty, Roger C. Cramton

Articles

In this Article, Professor Cramton discusses the effect of recent United States Supreme Court decisions on state control of Subversive activities. He finds that while the decisions to some extent restrict state activity in this area, and though the Court in its decisions gives the impression of vacillation and confusion, some definite an dworkable principles are emerging which contribute to a resolution of the inherent conflict of federal-state relations which these issues pose. He concludes that as the states grow more sophisticated in their treatment of these issues, so the policy of judicial self-restraint will become more influential in restricting …

Washington Timber Deeds And Contracts, Ralph W. Johnson Apr 1957

Washington Timber Deeds And Contracts, Ralph W. Johnson

Articles

The law of Washington concerning the interests conveyed by timber deeds and contracts is foggy. Many vital questions are still totally unanswered, or have been left in confusion, by the cases in point. The principal area of doubt revolves around the question of whether standing timber, which has been sold separately from the land on which it stands, is realty or personalty. The answer is vital for many reasons. It determines whether a husband has power as manager of the community to convey community-owned timber without his wife's signature, which statute of frauds applies to a timber transaction, which recording …

Symbolic Logic: A Razor-Edged Tool For Drafting And Interpreting Legal Documents, Layman E. Allen Jan 1957

Symbolic Logic: A Razor-Edged Tool For Drafting And Interpreting Legal Documents, Layman E. Allen

Articles

A large amount of the litigation based on written instruments-whether statute, contract, will, conveyance or regulation-can be traced to the draftsman's failure to convey his meaning clearly. Frequently, of course, certain items may purposely be left ambiguous, but often the question in issue is due to an inadvertent ambiguity that could have been avoided had the draftsman clearly expressed what he intended to say. In this Article it is suggested that a new approach to drafting, using certain elementary notions of symbolic logic, can go a long way towards eliminating such inadvertent ambiguity. This new approach makes available to draftsmen …
