Confusion Isn't Everything, William Mcgeveran, Mark P. Mckenna Jan 2013

Confusion Isn't Everything, William Mcgeveran, Mark P. Mckenna

Articles

The typical shorthand justification for trademark rights centers on avoiding consumer confusion. But in truth, this encapsulation mistakes a method for a purpose: confusion merely serves as an indicator of the underlying problems that trademark law seeks to prevent. Other areas of law accept confusion or mistake of all kinds, intervening only when those errors lead to more serious harms. Likewise, every theory of trademark rights considers confusion troubling solely because it threatens more fundamental values such as fair competition or informative communication. In other words, when it comes to the deep purposes of trademark law, confusion isn’t everything. Yet …

Taxing The Platypygous, James J. White Jan 2013

Taxing The Platypygous, James J. White

Articles

This Article maintains that obesity in the United States is an enormous public health issue that causes the health care costs of the obese Americans greatly to exceed those of citizens of normal weight. Recognizing that that much of that cost will be born by publicly financed programs and that the taxes supporting those programs will constitute an externality that the fat impose on the thin, the Article proposes a tax on high calorie food-but only when that food is purchased by the obese. The Article addresses many of the administrative, moral and other objections to a tax aimed at …

The majority of mothers in Ireland provide formula milk to their infants during the initial weeks postpartum; however, data are lacking on their formula feeding practices and support needs. This prospective Dublin-based observational study, which included 450 eligible mother-term infant pairs recruited and followed up to 6 months postpartum, aimed to advance our understanding of maternal formula feeding practices, their reasons for deciding to formula feed, sources of feeding information and perceived support needs; insights into infant formula milk consumption patterns in relation to current feeding guidelines are also provided. In summary, the vast majority of infants at 6 weeks …

Epigenetic Regulation Of Oxysterol Formation, Steve Meaney Jan 2013

Epigenetic Regulation Of Oxysterol Formation, Steve Meaney

Articles

Oxysterols are oxygenated derivatives of cholesterol that may be formed by either enzymatic or non-enzymatic mechanisms. Expression of the genes responsible oxysterol synthesis (GROS) is known to be restricted across different tissues and cell types. Regulation of the transcription of GROS and the activity of their enzyme transcripts has been the subject of intense activity for many years. Recent studies have sought to decipher the mechanism(s) that underpin the restricted expression of the GROS. Available data indicates that epigenetic mechanisms have an important role to play in the control of the expression of GROS. In the current review we summarize …

Obesity Is An Independent Predictor Of Breastfeeding Initiation When Socioeconomic Status Is Controlled For, Annemarie Bennett, Daniel Mccartney, John Kearney

Articles

Breastfeeding initiation rates vary across Europe, with rates as low as 56%(1) in Ireland and rates in excess of 90%(2) in the Nordic countries. A host of factors, including demographic, social, psychological and physical factors, influence the initiation, intensity and duration of breastfeeding. The extent to which modifiable factors influence breastfeeding initiation should be ascertained in order to prioritise support services for breastfeeding. Obesity is a known modifiable factor which inhibits breastfeeding initiation. This study aimed to determine the extent to which obesity inhibits breastfeeding initiation while controlling for socioeconomic status and other confounding factors. The Infant Cohort dataset from …

Against Notice Skepticism In Privacy (And Elsewhere), M. Ryan Calo Jan 2013

Against Notice Skepticism In Privacy (And Elsewhere), M. Ryan Calo

Articles

What follows is an exploration of innovative new ways to deliver privacy notice. Unlike traditional notice that relies upon text or symbols to convey information, emerging strategies of “visceral” notice leverage a consumer’s very experience of a product or service to warn or inform. A regulation might require that a cell phone camera make a shutter sound so people know their photo is being taken. Or a law could incentivize websites to be more formal (as opposed to casual) wherever they collect personal information, as formality tends to place people on greater guard about what they disclose. The thesis of …

Antioxidant Capacity, Arabinoxylans Content And In Vitro Glycaemic Index Of Cereal-Based Snacks Incorporated With Brewer’S Spent Grain, Sofia Reis, Nissreen Abu-Ghannam

Articles

Extruded snacks and breadsticks were formulated with increasing levels of brewer’s spent grain (BSG). The phenolic content increased by 4 and 7 fold with BSG addition in extrudates (40g/100g) and in breadsticks (35g/100g), respectively. Consequently, antioxidant capacity (DPPH, FRAP) also increased despite a recorded loss of phenolic compounds in extruded snacks. Arabinoxylans content increased up to 20 and 25g of BSG addition /100g of formulated extruded snacks and breadsticks, respectively. Further addition of BSG did not improve the content of arabinoxylans due to the possible formation of polysaccharide-protein complexes. Medium GI breadsticks were obtained with 35g of BSG incorporation /100g …

Release As Remedy For Excessive Punishment, Alexander A. Reinert Apr 2012

Release As Remedy For Excessive Punishment, Alexander A. Reinert

Articles

Although the Eighth Amendment’s prohibition on “cruel and unusual” punishment means different things in different contexts, it plainly forecloses state and federal actors from choosing ex ante to impose a punishment that is either disproportionate or inconsistent with minimum standards of decency. In other words, the Eighth Amendment mandates that no punishment be imposed if the only other choice on the table is an unconstitutional punishment. Although this principle can be gleaned from the disparate strands of Eighth Amendment jurisprudence, its remedial consequence has not been fully implemented. In this Article, I propose that providing a remedy of release from …

What Is The Pensee Sauvage And Is It Still Alive In Modern Society?, Mark William Farrell Mar 2012

What Is The Pensee Sauvage And Is It Still Alive In Modern Society?, Mark William Farrell

Articles

The culinary process has changed somewhat down through the ages but not to any great extent. The raw materials are still similar but innovation and creativity has been applied to them to give the finished product varying degrees of taste, texture, sensory and aesthetic pleasure. Fundamentally the tools which we use to interpret or rate our food are the very same apparatus which animals use to define theirs. The anthropology of sensory perception is essentially the same for animals and man in an evolutionary perspective (Pasquet, Simmen & Pagezy, 2000). It reflects the capacity of the animal or primitive human …

Considering A Complemental Model Of Health And Fitness, Ross Neville Jan 2012

Considering A Complemental Model Of Health And Fitness, Ross Neville

Articles

This article examines the concept of fitness, which, in spite of its much avowed cultural significance, has become the subject of much critical attention. In particular, it considers the now contested relation of fitness to health; the fact that, although there appears to be a clear consensus on a simple causal relation between the two, this has been deemed illusory outside the medico-scientific context of its production. In response to the problems with both of these positions, this article examines the potential for reconfiguring the relation between fitness and health on new terms. A complemental model of health and fitness …
