"The Verdict" Is In: The Civic Implications Of Civil Trials, Richard H. Weisberg Jan 2001

"The Verdict" Is In: The Civic Implications Of Civil Trials, Richard H. Weisberg

Articles

The article argues that civil trials have become central to American civic imagination, reflecting broader societal values and conflicts. Despite current negative portrayals of plaintiffs' lawyers, the cultural narrative of the heroic lawyer fighting against powerful institutions persists, influenced by popular media and historical legal traditions.

Why Federalism Must Be Enforced: A Response To Professor Kramer, Marci A. Hamilton Jan 2001

Why Federalism Must Be Enforced: A Response To Professor Kramer, Marci A. Hamilton

Articles

The United States Supreme Court has issued a series of opinions that turn on the Constitution's inherent principles of federalism, decisions that have alarmed many a legal scholar. Some scholars have attacked the Court for overstepping its bounds, and others have criticized the Court on the ground that the federal/state balance should be maintained through the political process rather than judicial review. The most recent advocate of this position, Professor Larry Kramer, recently argued in the Columbia Law Review that the political party structure ensures that state interests are taken into account at the federal level, and therefore the Supreme …

The World Trade Constitution, John O. Mcginnis, Mark L. Movsesian Dec 2000

The World Trade Constitution, John O. Mcginnis, Mark L. Movsesian

Articles

Conventional wisdom holds that the World Trade Organization (WTO) necessarily poses a threat to sovereignty and representative government within its member nations. Professors McGinnis and Movsesian refute this view. They argue that the WTO can be understood as a constitutive structure that, by reducing the power of protectionist interest groups, can simultaneously promote international trade and domestic democracy. Indeed, in promoting both free trade and accountable government, the WTO reflects many of the insights that inform our own Madisonian Constitution. Professors McGinnis and Movsesian reject recent proposals to grant the WTO regulatory authority, endorsing instead the WTO's limited adjudicative power …

Ccd Speckle Observations Of Binary Stars From The Southern Hemisphere. Ii. Measures From The Lowell-Tololo Telescope During 1999, Elliott P. Horch, Otto Franz, Zoran Ninkov Nov 2000

Ccd Speckle Observations Of Binary Stars From The Southern Hemisphere. Ii. Measures From The Lowell-Tololo Telescope During 1999, Elliott P. Horch, Otto Franz, Zoran Ninkov

Articles

Speckle observations of 145 double stars and suspected double stars are presented and discussed. On the basis of multiple observations, a total of 280 position angle and separation measures are determined, as well as 23 high-quality nondetections. All observations were taken with the (unintensified) Rochester Institute of Technology fast-readout CCD camera mounted on the Lowell-Tololo 61 cm telescope at the Cerro Tololo Inter-American Observatory during 1999 October. We find that the measures, when judged as a whole against ephemeris positions of binaries with very well-known orbits, have root mean square deviations of (1.8+/- 0.3) degrees in position angle and (13+/-2) …

Quality Of Shredded Carrots As Affected By Packaging Film And Storage Temperature, Catherine Barry-Ryan, David O'Beirne Jul 2000

Quality Of Shredded Carrots As Affected By Packaging Film And Storage Temperature, Catherine Barry-Ryan, David O'Beirne

Articles

Different packaging films and storage temperatures were used to establish a range of equilibrium modified atmospheres for storage of shredded carrots. Quality and storage-life of the packaged shredded carrots were determined using sensory evaluation, microbial counts, and a range of physical tests. Minimal processing steps such as peeling and shredding caused physical damage, physiological stress, and enhanced microbial growth, leading to a reduced shelf life when compared to the whole vegetable. A P-plus microporous film (CO2 permeability of 29103mL.m 2.d 1.atm 1) was the most suitable for the storage of shredded carrots. Findings indicated that deterioration in these products was …

Lightness Dependencies And The Effect Of Texture On Suprathreshold Lightness Tolerances, Ethan D. Montag, Roy S. Berns Jun 2000

Lightness Dependencies And The Effect Of Texture On Suprathreshold Lightness Tolerances, Ethan D. Montag, Roy S. Berns

Articles

A psychophysical experiment was performed to determine the effects of lightness dependency on suprathreshold lightness tolerances. Using a pass/fail method of constant stimuli, lightness tolerance thresholds were measured using achromatic stimuli centered at CIELAB L* = 10, 20, 40, 60, 80, and 90 using 44 observers. In addition to measuring tolerance thresholds for uniform samples, lightness tolerances were measured using stimuli with a simulated texture of thread wound on a card. A texture intermediate between the wound thread and the uniform stimuli was also used. A computer-controlled CRT was used to perform the experiments. Lightness tolerances were found to increase …

Hydrodynamic Drag In Steller Sea Lions (Eumetopias Jubatus), Lei Lani Stelle, Robert Blake, Andrew Trites Jun 2000

Hydrodynamic Drag In Steller Sea Lions (Eumetopias Jubatus), Lei Lani Stelle, Robert Blake, Andrew Trites

Articles

Drag forces acting on Steller sea lions (Eumetopias jubatus) were investigated from 'deceleration during glide' measurements. A total of 66 glides from six juvenile sea lions yielded a mean drag coefficient (referenced to total wetted surface area) of 0.0056 at a mean Reynolds number of 5.5x10(6). The drag values indicate that the boundary layer is largely turbulent for Steller sea lions swimming at these Reynolds numbers, which are past the point of expected transition from laminar to turbulent flow. The position of maximum thickness (at 34 % of the body length measured from the tip of the nose) was more …

Observational Limits On Terrestrial-Sized Inner Planets Around The Cm Draconis System Using The Photometric Transit Method With A Matched-Filter Algorithm, Laurance R. Doyle, Hans Deeg, Valerij Kozhevnikov, Zoran Ninkov, Et Al. May 2000

Observational Limits On Terrestrial-Sized Inner Planets Around The Cm Draconis System Using The Photometric Transit Method With A Matched-Filter Algorithm, Laurance R. Doyle, Hans Deeg, Valerij Kozhevnikov, Zoran Ninkov, Et Al.

Articles

A lightcurve of the eclipsing binary CM Draconis has been analyzed for the presence of transits of planets of size >= 2.5 Earth-radii (Re), with periods of 60 days or less, and in co-planar orbits around the binary system. About 400 million model lightcurves, representing transits from planets with periods ranging from 7 to 60 days, have been matched/correlated against these data. This process we call the "transit detection algorithm" or TDA. The resulting `transit-statistics' for each planet candidate allow the quantification of detection probabilities, and of false alarm rates. Our current lightcurve of CM Dra has a coverage of …

Effects Of Peeling Methods On The Quality Of Ready-To-Use Carrot Slices, Catherine Barry-Ryan, David O'Beirne Apr 2000

Effects Of Peeling Methods On The Quality Of Ready-To-Use Carrot Slices, Catherine Barry-Ryan, David O'Beirne

Articles

The effects of methods used for peeling and physiological age (over-wintering) on the quality and storage life of carrot disks packaged in modified atmosphere were examined. Commercial mechanical abrasion peeling using fine or coarse carborundum plates, was compared with carrots peeled by hand, before slicing into disks. Slices which had been peeled by abrasion had higher respiration rates, greater microbial contamination and growth rates, higher pH values, higher rates of weight loss and shorter microbiological shelf-lives than those which had been hand peeled. These results reflected the higher quality of the manually peeled carrots. Micrographs of the peeled surfaces confirmed …

A Response To Professor Benkler, Marci A. Hamilton Apr 2000

A Response To Professor Benkler, Marci A. Hamilton

Articles

Professor Hamilton explores the constitutional complexity uncovered by Professor Benkler in his piece, Constitutional Bounds of Database Protection: The Role of Judicial Review in the Creation and Definition of Private Rights in Information. Specifically, Professor Hamilton highlights that our democratic structure is characterized by representation rather than self-rule. In doing so, she refocuses the role of information in the political process and highlights that different types of information require different levels of access. Professor Hamilton's analysis further illustrates how an imprecise use of terminology may lead to incorrect conclusions regarding information jurisprudence. Through her more refined lens, Professor Hamilton reconsiders …

Suing The Devil: A Guide For Practitioners, Charles M. Yablon Feb 2000

Suing The Devil: A Guide For Practitioners, Charles M. Yablon

Articles

The essay humorously argues that suing the Devil is a viable legal strategy, challenging the perception of his invincibility. It provides a guide on navigating the procedural and substantive legal challenges involved, suggesting that the Devil's legal vulnerabilities make him a feasible target for litigation.

U.S. Federal Government Cios: Information Technology's New Managers--Preliminary Findings, Marianne Buehler Jan 2000

U.S. Federal Government Cios: Information Technology's New Managers--Preliminary Findings, Marianne Buehler

Articles

The Clinger-Cohen Information Technology Management Reform Act of 1996 (Clinger-Cohen Act) has changed the dynamics of how federal agencies view and manage their information technology. The mandated provision for Chief Information Officers (CIOs) is to act as information change agents and technology “watchdogs” for their agency. To observe how government is reacting to employing CIOs, field studies were conducted by e-mail with eight agencies to discover the successes and the challenges of this new information initiative. Four of the agencies contacted were mandated by the Clinger-Cohen Act and four were non-mandated. The results of this study depict varying levels of …

College Teachers' Perceptions Of English Language Characteristics That Identify English Language Learning Disabled Deaf Students, Gerald Berent, Vincent Samar, Ila Parasnis Jan 2000

College Teachers' Perceptions Of English Language Characteristics That Identify English Language Learning Disabled Deaf Students, Gerald Berent, Vincent Samar, Ila Parasnis

Articles

Deaf individuals typically experience English language difficulties at all levels of linguistic knowledge. Hearing individuals with English language learning disabilities (LD) can exhibit the same kinds of English language difficulties as deaf individuals. Although the existence of deaf individuals who also have LD has long been recognized, no definite criteria for identifying them exist, partly because of the confounding effects of deafness and LD on English language development. Despite the confound, previous surveys suggest that teachers believe atypical English-language behavior is a potential diagnostic marker for LD in deaf individuals. In the present study, a survey solicited the intuitions of …

Exponentially Weighted Moving Average Acceptance Charts, Donald Holmes Jan 2000

Exponentially Weighted Moving Average Acceptance Charts, Donald Holmes

Articles

A description of acceptance charts, which use subgroup averages, was published by Freund in 1957 (Industrial Quality Control 1957; (October); 13-23). The purpose of these charts is to evaluate a process in terms of whether or not it could be expected to satisfy product tolerances. This paper combines the acceptance chart concept with the exponentially weighted moving average (EWMA). An example is included to illustrate the proposed concept.

A Problem-Based Learning Approach To Business Software Skills, Victor Perotti, Patricia Sorce, Ben Isselhardt Jan 2000

A Problem-Based Learning Approach To Business Software Skills, Victor Perotti, Patricia Sorce, Ben Isselhardt

Articles

Today, computer software skills are a fundamental requirement for every businessperson. It is difficult to imagine how an individual could even survive in the current business atmosphere without the ability to use basic computer applications. Thus, the instruction of theses skills has become an important facet of all Business education. Unfortunately, the traditional lecture and repetition approach to these skills seldom work well. It becomes very obvious that learning computer software requires practice with the software, rather than lengthy discourse on the subject. This paper presents an overview of our transition to an alternative teaching methodology, problem-based learning, for the …

Current-Voltage Characteristics Of High Current Density Silicon Esaki Diodes Grown By Molecular Beam Epitaxy And The Influence Of Thermal Annealing, Michael Dashiell, Ralph Troeger, Sean Rommel Jan 2000

Current-Voltage Characteristics Of High Current Density Silicon Esaki Diodes Grown By Molecular Beam Epitaxy And The Influence Of Thermal Annealing, Michael Dashiell, Ralph Troeger, Sean Rommel

Articles

We present the characteristics of uniformly doped silicon Esaki tunnel diodes grown by low temperature molecular beam epitaxy (Tgrowth=275°C) using in situ boron and phosphorus doping. The effects of ex situ thermal annealing are presented for temperatures between 640 and 800°C. A maximum peak to valley current ratio (PVCR) of 1.47 was obtained at the optimum annealing temperature of 680°C for 1 min. Peak and valley (excess) currents decreased more than two orders of magnitude as annealing temperatures and times were increased with rates empirically determined to have thermal activation energies of 2.2 and 2.4 eV respectively. The decrease in …

Comparing Lifetime Emissions Of Natural Gas And Conventional Fuel Vehicles: An Application Of The Generalized Ancova Model, Michael Deaton, James Winebrake Jan 2000

Comparing Lifetime Emissions Of Natural Gas And Conventional Fuel Vehicles: An Application Of The Generalized Ancova Model, Michael Deaton, James Winebrake

Articles

New regulations and incentives are encouraging the use of clean, alternative fuel vehicles (AFVs) in urban areas. These vehicles are seen as one option for reducing air pollution from mobile sources. However, because of the limited number of AFVs on the road, little is known about actual lifetime emissions characteristics of in-use AFVs. This study describes the use of a generalized analysis of covariance model to evaluate and compare the emissions from natural gas vehicles with emissions from reformulated gasoline vehicles. The model describes fleet-wide emissions deterioration, while also accounting for individual vehicle variability within the fleet. This ability to …

A Treatise On Signed And Spoken Language In Early 19th Century Deaf Education In America, Harry Lang, W. Stokoe

Articles

This article introduces a reprint of an 1835 article by Frederick Augustus Porter Barnard entitled, "Existing State of the Art of Instructing the Deaf and Dumb". It reviews Barnard's background and achievements (including 25 years as the president of Columbia College), his familial progressive deafness, and his advanced views on communication methods (he urged use of both sign language and English).

Heterodyne Detection For Fiber Bragg Grating Sensors, Hedi Bellil, Mustafa Abushagur Jan 2000

Heterodyne Detection For Fiber Bragg Grating Sensors, Hedi Bellil, Mustafa Abushagur

Articles

In this paper, we present a Fiber-Bragg-Grating-based temperature sensor. The technique employs heterodyne detection using two Fiber Bragg Gratings. One of the gratings is used as a reference (local oscillator) and the second as a sensing arm. This sensor uses a Folded Mach-Zehnder interferometer. As the temperature changes, the Bragg wavelength of the FBG shifts. The heterodyne detection is used to detect the frequency difference between the reference and sensing signals that is caused by the temperature change. The dynamic range and sensitivity of the sensor were analyzed and presented.

Habitat Conversion, Information Acquisition, And The Conservation Of Biodiversity, Amitrajeet Batabyal Jan 2000

Habitat Conversion, Information Acquisition, And The Conservation Of Biodiversity, Amitrajeet Batabyal

Articles

We analyze two questions concerning the conservation of biodiversity in a dynamic and stochastic framework. First, given the link between natural habitats and biodiversity, when should a social planner stop the habitat conversion process? Second, what is the nexus between a social planner's optimal conservation policy And the length of this individual's planning horizon? We obtain the following two results. First the optimal conservation policy calls for the social planner to wait a while, i.e. not act upon receipt of the first (1/e) fraction of all utility packets. The social planner should then stop the habitat conversion process upon receipt …

An Empirical Study Of Student Attitudes Toward Group Learning Experience, Khondkar Karim, Robert Rutledge, Pierre Titard Jan 2000

An Empirical Study Of Student Attitudes Toward Group Learning Experience, Khondkar Karim, Robert Rutledge, Pierre Titard

Articles

This study examines business students' attitudes and beliefs about the non-performance benefits of cooperative learning used to address changes in business education (Accounting Education Change Commission, 1990). In doing so, this paper seeks to fill the gap between learning outcomes and the students' perceived value of this learning experience (cottell & Millis, 1992; 1993; Peek, Peek, & Horras, 1994; Peek Winking, & Peek, 1995; Fellers, 1996; Hite. 1996). The remainder of this paper presents a discussion of the background and application of cooperative learning, and describes the research methodology used. The analysis of data and empirical results are presented, followed …

Quality Management Applied To Higher Education, A. Erhan Mergen, Delvin Grant, Stanley Widrick Jan 2000

Quality Management Applied To Higher Education, A. Erhan Mergen, Delvin Grant, Stanley Widrick

Articles

In the last decade, many universities and American Assembly of Collegiate Schools of Business (AACSB) have increased their interest in applying principles of quality management, however, there is limited discussion and no universally agree upon model of quality management. We propose a model of quality management that has three components: quality of design, quality of conformance, and quality of performance. The model is applied to Rochester Institute of Technology's College of Business. It provides a framework to identify research, teaching and operational improvement opportunities.

The Effect Of International Institutional Factors On Properties Of Accounting Earnings, Ray Ball, S.P. Kothari, Ashok Robin Jan 2000

The Effect Of International Institutional Factors On Properties Of Accounting Earnings, Ray Ball, S.P. Kothari, Ashok Robin

Articles

International differences in the demand for accounting income predictably affect the way it incorporates economic income (change in market value) over time. We characterize the "shareholder" and "stakeholder" corporate governance models of common and cod law countries respectively as resoling information asymmetry by public disclosure and private communication. Also, code law directly links accounting income to current.

Using Technology To Educate The Public, Stephen M. Johnson Jan 2000

Using Technology To Educate The Public, Stephen M. Johnson

Articles

While the primary focus of any law faculty will always be its law students, the Internet and other new technologies enable law teachers to assume a central role in providing free legal education to the public. Although many schools are experimenting with distance learning and computer-assisted legal educa- tion to train law students, the real power of those tools may be their potential to facilitate public access to legal information. Traditionally, educating the general public has not been a primary responsibility of law professors, but today we have not only an opportunity, but an obligation, to develop computer-based legal education …
