Lux In Arcana: Decoding The Right To Be Forgotten In Digital Archives, Patricia S. Abril, Eugenio Pizarro Moreno Sep 2016

Lux In Arcana: Decoding The Right To Be Forgotten In Digital Archives, Patricia S. Abril, Eugenio Pizarro Moreno

Articles

On 13 May 2014, the European Court of Justice ruled that search engines such as Google had a duty to respect EU citizens' right to be forgotten. That is, the search engines-deemed "controllers" of information under the Directive-were obligated in some circumstances to remove or de-list links from search results that pertain to information that infringes on an individual's rights under the Directive. In the fall of 2015, the Spanish Supreme Court found itself obligated to determine the application of the digital right to be forgotten in a different context: This time in a digital newspaper archive. However, since …

Bicp Global Bim Study, Barry Mcauley, Alan Hore, Roger West Sep 2016

Bicp Global Bim Study, Barry Mcauley, Alan Hore, Roger West

Articles

The BICP is a direct response to the 2014 Construction 2020 report calling on Enterprise Ireland to work with industry organisations to promote the use of BIM and develop the appropriate technical skills amongst Irish construction firms so that they can successfully compete in markets where BIM is widely adopted or a requirement. There are four distinct work packages to achieve the strategic objectives of the BICP which include amongst other things a systematic review of BIM adoption in international regions, with particular focus on the enablers to support national implementation programmes. This study focused on exploring the value proposition …

From Integrationism To Equal Protection: Tenbroek And The Next 25 Years Of Disability Rights, Samuel R. Bagenstos Sep 2016

From Integrationism To Equal Protection: Tenbroek And The Next 25 Years Of Disability Rights, Samuel R. Bagenstos

Articles

If there is one person who we can say is most responsible for the legal theory of the disability rights movement, that person is Jacobus tenBroek. Professor tenBroek was an influential scholar of disability law, whose writings in the 1960s laid the groundwork for the disability rights laws we have today. He was also an influential disability rights activist. He was one of the founders and the president for more than two decades of the National Federation of the Blind, one of the first-and for many years undisputedly the most effective-of the organizations made up of people with disabilities that …

Gold Nanostars For Efficient In Vitro And In Vivo Real-Time Sers Detection And Drug Delivery Via Plasmonic-Tunable Raman/Ftir Imaging, Furong Tian, Joao Conde, Chenchen Bao, Yunsheng Chen, James Curtin, Daxiang Cui Aug 2016

Gold Nanostars For Efficient In Vitro And In Vivo Real-Time Sers Detection And Drug Delivery Via Plasmonic-Tunable Raman/Ftir Imaging, Furong Tian, Joao Conde, Chenchen Bao, Yunsheng Chen, James Curtin, Daxiang Cui

Articles

The application of plasmonic-enhanced Raman imaging of cancer cells and drug delivery is gaining momentum. Here, we propose a new theranostic strategy based on an efficient plasmonic-tunable Raman/Fourier transform infrared (FTIR) spectroscopy imaging, to simultaneously evaluate the anticancer drug scattering cellular imaging and the Raman scattering molecular vibration signals in living cells. This technique allows to monitoring the drug release throughout the cell cycle and in vivo biodistribution and biocompatibility with low dose drug therapy (200 µg/mL) and low toxicity effect. This system can directly track in real-time the delivery and release of an anticancer drug (mitoxantrone, MTX) from gold …

ROS densities and colony formation were …

Quizmastery: Students As Bloggers And Testers In Pursuit Of Grammatical Competence, Sue Norton, Odette Gabaudan Jul 2016

Quizmastery: Students As Bloggers And Testers In Pursuit Of Grammatical Competence, Sue Norton, Odette Gabaudan

Articles

This article considers the challenges confronted by instructors of composition and writing skills in higher education. Identifying key aspects of grammar, syntax, and punctuation, it argues that a grammatically informed terminology is helpful to learner-writers endeavouring to improve the clarity of their written assignments. To aid assimilation of this terminology, and the concepts it signifies, e-learning tools can be integrated into the curriculum so that students can consolidate knowledge through their own construction of it. As they create blogs and peer to peer quizzes, they become more theoretically and practically informed about the basis of effective writing practices.

Effects Of Australia's Maal And Dpt On Internet-Based Businesses, Antony Ting, Tommaso Faccio, Jeffrey M. Kadet Jul 2016

Effects Of Australia's Maal And Dpt On Internet-Based Businesses, Antony Ting, Tommaso Faccio, Jeffrey M. Kadet

Articles

Australia has received considerable attention as a result of its unilateral actions to discourage multinational profit shifting. Those actions include the 2015 enactment of the Multinational Anti-Avoidance Law and the Australian Treasury’s May 2016 proposal for a diverted profits tax. This article considers how those actions might affect non-Australian multinational entities that conduct internet platform services for, and earn revenues from, Australian customers if those MNEs take no action. It also reviews structural alternatives.

As will be seen from the example set out in the article, the Australian royalty withholding tax is a major portion of the possible tax increases …

Profit-Shifting Structures: Making Ethical Judgments Objectively, Part 2, Jeffrey M. Kadet, David Koontz Jul 2016

Profit-Shifting Structures: Making Ethical Judgments Objectively, Part 2, Jeffrey M. Kadet, David Koontz

Articles

MNCs and their advisors have seemingly taken ethics out of the mix when considering the profit-shifting tax structures they have so prolifically and enthusiastically implemented over the past several decades. There may be a variety of reasons for this. First, U.S. tax law is a self-assessment system, meaning that in most cases taxpayers compute and pay tax without advance approval of their tax positions from the IRS. No third party technical test or propriety standard has to be passed on the front end for any tax strategy or structure. Second, direct personal benefits accrue to management and advisors from implementing …

The Positive Psychology Of Maritime Health, Joanne Mcveigh, Malcolm Mclachlan, Bill Kavanagh Jul 2016

The Positive Psychology Of Maritime Health, Joanne Mcveigh, Malcolm Mclachlan, Bill Kavanagh

Articles

The remote, isolated, confined, and safety-critical environment of seafaring exposes seafarers to a very specific assortment of stressors. Research suggests that seafarers as a professional group are amongst those at high risk for stress and associated mental health conditions. This article explores positive psychology as an approach to supporting wellbeing at sea. Positive psychology may support health, positive attitudes and productive work behaviour; however it cannot and should not be employed as a means of inoculating seafarers against the negative consequences of fundamentally unreasonable work practices. Rather, positive psychology can help seafarers thrive in an overall context that recognises and …

Informant Witnesses And The Risk Of Wrongful Convictions, Jessica A. Roth Jul 2016

Informant Witnesses And The Risk Of Wrongful Convictions, Jessica A. Roth

Articles

Several studies in the last two decades have revealed that false criminal informant testimony is a leading factor in wrongful convictions, along with false confessions, eyewitness misidentification, and faulty forensic science. Although a great deal more remains to be done, many jurisdictions have implemented evidence-based reforms to these last three categories of evidence. Policy about criminal informants, however, seems to be stubbornly stagnant, and relevant social science is virtually nonexistent. This Article questions the relative lack of attention to informant testimony and suggests that the dangers posed by informant testimony are both greater and different than previously thought. Unlike much …

A Comparison Of Catabolic Pathways Induced In Primary Macrophages By Pristine Single Walled Carbon Nanotubes And Pristine Graphene, Caroline More, Jennifer Mcintyre, Luke O'Neill, Hugh Byrne Jun 2016

A Comparison Of Catabolic Pathways Induced In Primary Macrophages By Pristine Single Walled Carbon Nanotubes And Pristine Graphene, Caroline More, Jennifer Mcintyre, Luke O'Neill, Hugh Byrne

Articles

Understanding the correlation between the physico-chemical properties of carbonaceous nanomaterials and how these properties impact on cells and subcelluar mechanisms is critical to their risk assessment and safe translation into newly engineered devices. Here the toxicity, uptake and catabolic response of primary human macrophages to pristine graphene (PG) and pristine single walled carbon nanotubes (pSWCNT) are explored, compared and contrasted. The nanomaterial toxicity was assessed using three complementary techniques (live-dead assay, real time impedance technique and confocal microscopic analysis), all of which indicated no signs of acute cytotoxicity in response to PG or pSWCNT. Transmission electron microscopy (TEM) demonstrated that …

Modification Of The In Vitro Uptake Mechanism And Anti-Oxidant Levels In Hacat Cells And Resultant Changes To Toxicity And Oxidative Stress Of G4 And G6 Poly (Amido Amine) Dendrimer Nanoparticles., Marcus Maher, Hugh Byrne Jun 2016

Modification Of The In Vitro Uptake Mechanism And Anti-Oxidant Levels In Hacat Cells And Resultant Changes To Toxicity And Oxidative Stress Of G4 And G6 Poly (Amido Amine) Dendrimer Nanoparticles., Marcus Maher, Hugh Byrne

Articles

The mechanism of cellular uptake by endocytosis and subsequent oxidative stress has been identified as the paradigm for the toxic response of cationically surface charged nanoparticles. In an attempt to circumvent the process, the effect of increased cellular membrane permeability on the uptake mechanisms of poly (amidoamine) dendrimers generation 4 (G4) and 6 (G6) in vitro was investigated. Immortalised, non-cancerous human keratinocyte (HaCaT) cells were treated with DL-Buthionine-(S,R)-sulfoximine (BSO). Active uptake of the particles was monitored using fluorescence microscopy to identify and quantify endosomal activity and resultant oxidative stress, manifest as increased levels of reactive oxygen species, monitored using the …

The Statistical Relevance And Effect Of Assuming Pessimistic Default Overall Thermal Transmittance Coefficients On Dwelling Energy Performance Certification Quality In Ireland, Ciara Ahern, Brian Norton, Bernard Enright May 2016

The Statistical Relevance And Effect Of Assuming Pessimistic Default Overall Thermal Transmittance Coefficients On Dwelling Energy Performance Certification Quality In Ireland, Ciara Ahern, Brian Norton, Bernard Enright

Articles

In the EU, Energy Performance Certificates (EPCs) are issued for dwellings whenever they are constructed, sold or leased. Where requiring data would be prohibitively costly, nationally applicable default-values for the thermal transmittance coefficients of the building envelope are employed. Use of such worst case default U-values ensure that a poor dwelling does not attain a better energy rating than is merited. In the absence of empirical data in Ireland thermal-default U-values, as in many other EU member states, are determined by the type and date of construction and then prevailing building codes. Using 463,582 dwellings representing 32% of the total …

Source Separation Approach To Video Quality Prediction In Computer Networks, Ruairí De Fréin May 2016

Source Separation Approach To Video Quality Prediction In Computer Networks, Ruairí De Fréin

Articles

Time-varying loads introduce errors in the estimated model parameters of service-level predictors in Computer Networks. A load-adjusted modification of a traditional unadjusted service-level predictor is contributed, based on Source Separation (SS). It mitigates these errors and improves service-quality predictions for Video-on-Demand (VoD) by :6 to 2dB.

Sources Of Information On The Trans-Pacific Partnership, Barbara H. Garavaglia May 2016

Sources Of Information On The Trans-Pacific Partnership, Barbara H. Garavaglia

Articles

The Trans-Pacific Partnership Agreement (TPP) is a free trade agreement between 12 countries in the Asia Pacific region: Australia, Brunei Darussalam, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, the United States, and Vietnam. The agreement, signed by the U.S. and other participating countries in Auckland, New Zealand on February 4, 2016, “promotes economic integration to liberalise trade and investment” and “bring economic growth” to the region and participating countries. One reason for the sense of uncertainty, unease, and concern surrounding free trade agreements in general and the TPP in particular is that the negotiations are not public and …

Quantification Of Hemodynamic Pulse Wave Velocity Based On A Thick Wall Multi-Layer Model For Blood Vessels, Jeffrey S. Lillie, Alexander S. Liberson, David A. Borkholder Apr 2016

Quantification Of Hemodynamic Pulse Wave Velocity Based On A Thick Wall Multi-Layer Model For Blood Vessels, Jeffrey S. Lillie, Alexander S. Liberson, David A. Borkholder

Articles

Pulse wave velocity (PWV) is an important index of arterial hemodynamics, which lays the foundation for continuous, noninvasive blood pressure automated monitoring. The goal of this paper is to examine the accuracy of PWV prediction based on a traditional homogeneous structural model for thin-walled arterial segments. In reality arteries are described as composite heterogeneous hyperelastic structures, where the thickness dimension cannot be considered small compared to the cross section size. In this paper we present a hemodynamic fluid - structure interaction model accounting for the variation of geometry and material properties in a radial direction. The model is suitable to …

Theoretical Modeling Of The Effect Of Polymer Chain Immobilization Rates On Holographic Recording In Photopolymers, Dana Mackey, Paul O'Reilly, Izabela Naydenova Apr 2016

Theoretical Modeling Of The Effect Of Polymer Chain Immobilization Rates On Holographic Recording In Photopolymers, Dana Mackey, Paul O'Reilly, Izabela Naydenova

Articles

This paper introduces an improved mathematical model for holographic grating formation in an acrylamide-based photopolymer, which consists of partial differential equations derived from physical laws. The model is based on the two-way diffusion theory of \cite{izabela}, which assumes short polymer chains are free to diffuse, and generalizes a similar model presented in \cite{josab} by introducing an immobilization rate governed by chain growth and cross-linking. Numerical simulations were carried out in order to investigate the behaviour of the photopolymer system for short and long exposures, with particular emphasis on the effect of recording parameters (such as illumination frequency and intensity), as …

The Use Of Specialized Cybercrime Policing Units: An Organizational Analysis, Dale Willits, Jeffrey Nowacki Apr 2016

The Use Of Specialized Cybercrime Policing Units: An Organizational Analysis, Dale Willits, Jeffrey Nowacki

Articles

Given the increased focus and importance of cybercrime, some police agencies have turned to the use of specialized cybercrime policing units. Research has yet to examine the how frequently these units are used in policing, nor has research examined the types of agencies most likely to use these units. The current research, drawing on contingency theory, institutional theory, and Maguire’s theory of police organizational structure, uses four waves of Law Enforcement Management and Administrative Survey data to provide a descriptive analysis of specialized cybercrime units with a focus on identifying organizational correlates, environmental pressures, and the role of time. Trend …

Evaluation Of Cytotoxicity Profile And Intracellular Localisation Of Doxorubicin-Loaded Chitosan Nanoparticles, Gabriele Dadalt Souto, Zeineb Farhane, Esen Efeoglu, Alan Casey, Jennifer Mcintyre, Hugh Byrne

Articles

In the emerging field of nanomedicine, targeted delivery of nanoparticle encapsulated active pharmaceutical ingredients (API) is seen as a potential significant development, promising improved pharmacokinetics and reduced side effects. In this context, understanding the cellular uptake of the nanoparticles and subsequent subcellular distribution of the API is of critical importance. Doxorubicin (DOX) was encapsulated within chitosan nanoparticles to investigate its intracellular delivery in A549 cells in vitro. Unloaded (CS-TPP) and doxorubicin-loaded (DOX-CS-TPP) chitosan nanoparticles were characterised for size (473±41 nm), polydispersity index (0.3±0.2), zeta potential (34±4 mV), drug content (76±7 µM) and encapsulation efficiency (95±1%). The cytotoxic response to …

A Comprehensive Theory Of Civil Settlement, J. J. Prescott, Kathryn E. Spier Apr 2016

A Comprehensive Theory Of Civil Settlement, J. J. Prescott, Kathryn E. Spier

Articles

A settlement is an agreement between parties to a dispute. In everyday parlance and in academic scholarship, settlement is juxtaposed with trial or some other method of dispute resolution in which a third-party factfinder ultimately picks a winner and announces a score. The “trial versus settlement” trope, however, represents a false choice; viewing settlement solely as a dispute-ending alternative to a costly trial leads to a narrow understanding of how dispute resolution should and often does work. In this Article, we describe and defend a much richer concept of settlement, amounting in effect to a continuum of possible agreements between …

Justice Kennedy And The Fisher Revisit: Will The Irrelevant Prove Decisive?, Richard O. Lempert Apr 2016

Justice Kennedy And The Fisher Revisit: Will The Irrelevant Prove Decisive?, Richard O. Lempert

Articles

Most Court watchers expect Justice Kennedy to cast the deciding vote when the Supreme Court hands down its decision in this term’s installment of Fisher v. University of Texas at Austin or, as it is colloquially titled, Fisher II. What divides observers is not whose vote will be crucial, but the law that vote will make. At one extreme, Justice Kennedy could vote to uphold the Fifth Circuit’s reaffirmation of its earlier decision. When the case was heard, this would almost certainly have meant affirming the circuit court’s decision by an equally divided Court. (Justice Kagan, an almost certain supporter …

Antitrust And Wealth Inequality, Daniel Crane Apr 2016

Antitrust And Wealth Inequality, Daniel Crane

Articles

In recent years, progressive public intellectuals and prominent scholars have asserted that monopoly power lies at the root of wealth inequality and that increases in antitrust enforcement are necessary to stem its rising tide. This claim is misguided. Exercises of market power have complex, crosscutting effects that undermine the generality of the monopoly regressivity claim. Contrary to what the regressivity critics assume, wealthy shareholders and senior corporate executives do not capture the preponderance of monopoly rents. Such profits are broadly shared within and dissipated outside the firm. Further, many of the subjects of antitrust law are middle-class professionals, sole proprietors, …

Understanding Noncompetition Agreements: The 2014 Noncompete Survey Project, J. J. Prescott, Norman D. Bishara, Evan Starr Apr 2016

Understanding Noncompetition Agreements: The 2014 Noncompete Survey Project, J. J. Prescott, Norman D. Bishara, Evan Starr

Articles

In recent years, scholars and policymakers have devoted considerable attention to the potential consequences of employment noncompetition agreements and to whether legislatures ought to reform the laws that govern the enforcement of these controversial contractual provisions. Unfortunately, much of this interest—and the content of proposed reforms—derives from anecdotal tales of burdensome noncompetes among low-wage workers and from scholarship that is either limited to slivers of the population (across all studies, less than 1%) or relies on strong assumptions about the incidence of noncompetition agreements. Better understanding of the use of noncompetes and effective noncompetition law reform requires a more complete …

Challenges And Opportunities In Dfo-At: A Study Of E-Nable, Jeremiah L. Parry-Hill, Daniel L. Ashbrook

Articles

In this paper, we present the results of a study of the e‑NABLE community–a distributed, collaborative volunteer effort to design and fabricate upper-limb assistive technology devices for distant strangers. We position e‑NABLE as the prototypical example of “Do-it-yourself For Others Assistive Technology” (DFO‑AT) and describe three key findings: how the project does and does not meet the recipient's nuanced needs for functional and social support; how e‑NABLE volunteers' motivations compare to those of volunteers for other efforts, including open source software projects; and we explore the challenges inherent in the distance between volunteers and recipients. We also describe opportunities for …

Articles

Metformin is the main drug of choice for treating type 2 diabetes, yet the therapeutic regimens and side effects of the compound are all undesirable and can lead to reduced compliance. The aim of this study was to elucidate the mechanism of action of two novel compounds which improved glucose handling and weight gain in mice on a high-fat diet. Wildtype C57Bl/6 male mice were fed on a high-fat diet and treated with novel, anti-diabetic compounds. Both compounds restored the glucose handling ability of these mice. At a cellular level, these compounds achieve this by inhibiting complex I activity in …
