Commentary: International And Comparative Law Perspectives On Internet Patents, Toshiko Takenaka Jan 2001

Commentary: International And Comparative Law Perspectives On Internet Patents, Toshiko Takenaka

Articles

The Internet and e-commerce have created a borderless market. Goods and services sold on the Internet are subject to the patent statutes and regulations of all countries in which customers have access. Because the presence or absence of patent protection—or variations in that protection—hinders the movement of goods and services throughout the Internet, it is necessary to harmonize the protection afforded by Internet patents in their early stages of development. Among the three papers, however, only Professor Chiappetta touched upon the problem of compliance with the provisions in TRIPS. None of the papers paid attention to the feasibility of harmonizing …

This commentary will focus on the participants' proposals relative to the laws of other countries. Particularly, assuming that the same proposals were to be made in an international negotiation, my commentary reflects potential reactions and responses from Japanese and European delegates.

The Emperor's New Clothes: The Shocking Truth About Digital Signatures And Internet Commerce, Jane K. Winn Jan 2001

The Emperor's New Clothes: The Shocking Truth About Digital Signatures And Internet Commerce, Jane K. Winn

Articles

This Article critiques a specific set of assumptions about specific application of digital signature technology: that contracts will be formed over the Internet among parties with no prior relationships through reliance on digital signature certificates issued by trusted third parties to establish the identity of the parties. This application for digital signature technology was once seen as both its most ambitious and most promising application because, for parties with no prior knowledge of each other, there is not yet a reliable system of online identities in Internet commerce.

Parties with an ongoing commercial relationship can absorb the cost of offline …

Eddy Structures Induced Within A Wedge By A Honing Circular Arc, C. P. Hills Jan 2001

Eddy Structures Induced Within A Wedge By A Honing Circular Arc, C. P. Hills

Articles

In this paper we outline an expeditious numerical procedure to calculate the Stokes flow in a corner due to the rotation of a scraping circular boundary. The method is also applicable to other wedge geometries. We employ a collocation technique utilising a basis of eddy (similarity) functions introduced by Moffatt (1964) that allows us to satisfy automatically the governing equations for the streamfunction and all the boundary conditions on the surface of the wedge. The circular honing problem thereby becomes one-dimensional requiring only the satisfaction of conditions on the circular boundary. The advantage of using the Moffatt eddy functions as …

Eddies Induced In Cylindrical Containers By A Rotating End Wall, Christopher Hills Jan 2001

Eddies Induced In Cylindrical Containers By A Rotating End Wall, Christopher Hills

Articles

The flow generated in a viscous liquid contained in a cylindrical geometry by a rotating end wall is considered. Recent numerical and experimental work has established several distinct phases of the motion when fluid inertia plays a significant role. The current paper, however, establishes the nature of the flow in the thus far neglected low Reynolds number regime. Explicitly, by employing biorthogonality relations appropriate to the current geometry, it is shown that a sequence of exponentially decaying eddies extends outward from the rotating end wall. The cellular structure is a manifestation of the dominance of complex eigensolutions to the homogeneous …

Sharing Health-Care Records Over The Internet, Jane Grimson, Gaye Stephens, Benjamin Jung, William Grimson, Damon Berry, Sebastien Pardon

Articles

Presents a novel approach to sharing electronic health-care records that leverages the Internet and the World Wide Web, developed as part of two European Commission-funded projects, Synapses and SynEx. The approach provides an integrated view of patient data from heterogeneous, distributed information systems and presents it to users electronically. Synapses and SynEx illustrate a generic approach in applying Internet technologies for viewing shared records, integrated with existing health computing environments. Prototypes have been validated in a variety of clinical domains and health-care settings

Controlling The Optical Properties Of A Conjugated Co-Polymer Through Variation Of Backbone Isomerism And The Introduction Of Carbon Nanotubes, A. Dalton, J. Coleman, M. In Het Panhuis, B. Mccarthy, A. Drury, W. Blau, J. Nunzi, Hugh Byrne

Articles

The need to control the formation of weakly emitting species in polymers such as aggregates and excimers, which are normally detrimental to device performance, is illustrated for the example of the polymer poly(m-phenylenevinylene-co-2,5-dioctyloxy-p-phenylenevinylene), using the model compound, 2,5-dioctyloxy-p-distyrylbenzene as a comparison. Two different methods, namely a Homer-Emmons polycondensation in dimethylformamide (DMF) and a Wittig polycondensation in dry toluene, have been used during synthesis resulting in a polymer with a predominantly trans-vinylene backbone and a polymer with a predominantly cis-vinylene backbone, respectively. Photoluminescence and absorption spectroscopy indicate that the polymer forms aggregate species in solution with spectra that are distinctly red-shifted …

A Review Of The Different Methods For Assessing Standing Balance, Jacinta Browne, N. J. O'Hare Jan 2001

A Review Of The Different Methods For Assessing Standing Balance, Jacinta Browne, N. J. O'Hare

Articles

This paper is a review of the balance assessment methods currently used to evaluate standing balance. Most of the presently available instrumentation appears to be more suited to research laboratories than to routine clinical situations. Functional assessments of balance appear to be the quickest test to administer and do not require expensive equipment however only gross changes in balance can be detected making them suitable as a screening tool for identifying subject’s needing more thorough evaluation. Force platforms appear to be most suited balance assessment instrumentation to the clinical situation since it produces a real time display and can detect …

E-Spatial Technology For Spatial Analysis And Decision Making In Web-Based Land Information Management Systems, James Carswell

Articles

In this paper we describe e-SpatialTM technology, comprising an innovative software solution for deploying integrated web-based spatial applications within Oracle 9i Database environments. The two main components of the solution are the iSMARTTM database development technology and the i-SpatialTM Information Server (iSIS). This technology allows Oracle users to build and deploy both spatially enabled and standard Internet applications without requiring any application-specific GIS source code. It can be deployed on any Oracle supported hardware platform and on any device running a Java Virtual Machine, thus providing full support for wireless, PDAs and other mobile devices. In particular, we describe a …

Lightness Dependencies And The Effect Of Texture On Suprathreshold Lightness Tolerances, Ethan D. Montag, Roy S. Berns Jun 2000

Lightness Dependencies And The Effect Of Texture On Suprathreshold Lightness Tolerances, Ethan D. Montag, Roy S. Berns

Articles

A psychophysical experiment was performed to determine the effects of lightness dependency on suprathreshold lightness tolerances. Using a pass/fail method of constant stimuli, lightness tolerance thresholds were measured using achromatic stimuli centered at CIELAB L* = 10, 20, 40, 60, 80, and 90 using 44 observers. In addition to measuring tolerance thresholds for uniform samples, lightness tolerances were measured using stimuli with a simulated texture of thread wound on a card. A texture intermediate between the wound thread and the uniform stimuli was also used. A computer-controlled CRT was used to perform the experiments. Lightness tolerances were found to increase …

Two Rank Order Tests For M-Ary Detection, Viswanath Annampedu, Vladimir V. Roganov, Ramanarayanan Viswanathan Mar 2000

Two Rank Order Tests For M-Ary Detection, Viswanath Annampedu, Vladimir V. Roganov, Ramanarayanan Viswanathan

Articles

We consider a general M-ary detection problem where, given M groups of L samples each, the problem is to identify which unique group of L samples have come from the signal hypothesis. The optimal likelihood ratio test is unrealizable, when the joint distribution of ML samples is not completely known. In this paper we consider two rank order types of tests termed as the modified rank test (MRT) and the modified rank test with row sort (MRTRS). We examine through simulation, the small sample probability of error performances of MRT and MRTRS for detecting a signal among contaminants. Numerically …

Kenneth Starr: Diabolically Evil?, Jeanne L. Schroeder, David G. Carlson Mar 2000

Kenneth Starr: Diabolically Evil?, Jeanne L. Schroeder, David G. Carlson

Articles

The article explores the intersection of law, morality, and subjectivity through the lens of Slavoj Žižek's philosophical works, particularly in the context of the impeachment of President Clinton. It argues that the public's negative reaction to the impeachment was rooted in a fear of encountering "diabolical evil," a concept drawn from Kantian philosophy, where law and morality coincide perfectly. This form of evil is more terrifying than ordinary evil because it is committed without pathological motives, purely for the sake of duty.

Improved Direct Solver For Building Energy Simulation, Michael Crowley, Saleem Hashmi Jan 2000

Improved Direct Solver For Building Energy Simulation, Michael Crowley, Saleem Hashmi

Articles

Finite difference methods, when applied to the differential equations modelling energy flows in buildings, give rise to a system of non-linear difference equations. A frequently used direct solution method involving linearization is analysed and a related method proposed. These and one other connected method are compared using a building related test problem prepared for this purpose. The proposed numerical method is found to produce least error, about 30% less than the commonly used method, and it is recommended for inclusion in building energy simulation software. A fundamental method for estimating the pre conditioning period of a building, arising from the …

Past-Dependency, Pragmatism, And Critique Of History In Adjudication And Legal Scholarship, Richard A. Posner Jan 2000

Past-Dependency, Pragmatism, And Critique Of History In Adjudication And Legal Scholarship, Richard A. Posner

Articles

Using Nietzsche's great essay on the uses and disadvantages of history for life as his jumping-off point, Judge Posner examines the utility of the study of history for adjudication and legal scholarship. He argues, following Nietzsche; that the wrong kind of historical study can be very bad for "life " including law, while the right kind-the kind deployed by a pragmatic judge or a policy-oriented legal scholar-may deviate from literal accuracy in the direction of a rhetorical and imaginative narrative of historical events that can be constructively employed in a forward-looking approach to legal problems.

Rotary Honing: A Variant Of The Taylor Paint-Scraper Problem, Christopher Hills, H. Moffatt Jan 2000

Rotary Honing: A Variant Of The Taylor Paint-Scraper Problem, Christopher Hills, H. Moffatt

Articles

The three-dimensional Row in a corner of fixed angle α induced by the rotation in its plane of one of the boundaries is considered. A local similarity solution valid in a neighbourhood of the centre of rotation is obtained and the streamlines are shown to be closed curves. The effects of inertia are considered and are shown to be significant in a small neighbourhood of the plane of symmetry of the flow. A simple experiment confirms that the streamlines are indeed nearly closed; their projections on planes normal to the line of intersection of the boundaries are precisely the 'Taylor' …

Michigan's Minority Graduates In Practice: The River Runs Through Law School, Richard O. Lempert, David L. Chambers, Terry K. Adams

Articles

This paper reports the results of a 1997-98 survey designed to explore the careers of the University of Michigan Law School's minority graduates from the classes of 1970 through 1996, and of a random sample of Michigan Law School's white alumni who graduated during the same years. It is to date the most detailed quantitative exploration of how minority students fare after they graduate from law school and enter law practice or related careers. The results reveal that almost all of Michigan Law School's minority graduates pass a bar exam and go on to have careers that appear successful by …

Re-Examining The Role Of Patents In Appropriating The Value Of Dna Sequences, Rebecca S. Eisenberg Jan 2000

Re-Examining The Role Of Patents In Appropriating The Value Of Dna Sequences, Rebecca S. Eisenberg

Articles

As public and private sector initiatives race to complete the sequence of the human genome, patent issues have played a prominent role in speculations about the significance of this achievement. How much of the genome will be subject to the control of patent holders, and what will this mean for future research and the development of products for the improvement of human health? Is a patent system developed to establish rights in mechanical inventions of an earlier era up to the task of resolving competing claims to the genome on behalf of the many sequential innovators who elucidate its sequence …

Rational Generalised Moonshine From Orbifolds, Rossen Ivanov, Michael Tuite Jan 2000

Rational Generalised Moonshine From Orbifolds, Rossen Ivanov, Michael Tuite

Articles

Frenkel, Lepowsky and Meurman constructed the Moonshine Module (MM) as a Z2 orbifold of the Leech Lattice Meromorphic Conformal field theory. The group of automorphisms of this theory is the 'Monster Group' M - the largest finite sporadic simple group (with order ~ 8. 1053 ). 'Monstrous Moonshine' is the famous observation that the Thompson series, corresponding to each class of M, is a hauptmodule for some genus zero fixing group. Norton considered Generalised Moonshine Functions (GMF), depending on two commuting Monster elements, and suggested that they are also hauptmodules. Using meromorphid Abelian orbifoldings of MM we identify …

Enantioselective Complexation Of Amino Acids By 6a-Deoxy-6a-Hydroxyethylamino- Β -Cyclodextrin And Its Metallo-Derivatives In Aqueous Solution, Nicole Van Hoof, Noel Russell, Mary Mcnamara, Raphael Darcy Jan 2000

Enantioselective Complexation Of Amino Acids By 6a-Deoxy-6a-Hydroxyethylamino- Β -Cyclodextrin And Its Metallo-Derivatives In Aqueous Solution, Nicole Van Hoof, Noel Russell, Mary Mcnamara, Raphael Darcy

Articles

Enantioselectivity towards several amino acids by metallo-6A-deoxy-6A-hydroxyethylamino-β-cyclodextrins (metallo- β CDea’s) was investigated by potentiometric titration of the various amino acid/metallo- β CDea systems with NaOH solution. It was shown that the cyclodextrin derivative is capable of distinguishing between enantiomers of amino acid species in the presence of certain metal ions (Co, Ni, Cu and Zn). Ni- β CDea complexes show the most enantioselectivity, whereas for Cu and Co2C-_CDea complexes less selectivity is observed. As expected, Zn- β CDea complexes exhibit no enantioselectivity. Stability and selectivity, however, do not go hand in hand, since the most stable complexes are formed …
