Later Attempts To Relocate The Capital Of Washington, Arthur S. Beardsley Jan 1941

Later Attempts To Relocate The Capital Of Washington, Arthur S. Beardsley

Articles

The controversy over the location of the seat of government, which had flared up frequently in Washington Territory during the period 1855-1875, was comparatively dormant in the following decade. With the coming of the railroads, the discovery of gold in the Fraser River country and Idaho, the use of irrigation in central Washington, the growth of the sheep and cattle business, the increase in commerce on the Columbia and Snake rivers, the development of the lumber and fishing industries west of the Cascade Range, the population of all sections of the territory rapidly increased, and Washington Territory was soon to …

The Codes And Code Makers Of Washington, 1889-1937, Arthur S. Beardsley

Articles

Under the provisions of the Organic Act of Washington Territory, Congress had agreed to provide for the publication of the territorial statutes; hence, so long as Congress was willing to assume the cost of the publication of these territorial laws under the guise of a codification of the statutes, but little attention toward the preparation of a compilation, in the form in which this term is generally understood, was likely. The agitation for statutory reform, which consumed no small part of the time of the various territorial legislative sessions, was not motivated by a hope for a code of the …

Methods Of Wage Policy I, Max Rheinstein Jan 1938

Methods Of Wage Policy I, Max Rheinstein

Articles

Social science has a threefold task: first, that of describing the phenomena of social life; second, that of classifying and arranging these phenomena in a systematic order; and, finally, that of investigating regularities of relations between social phenomena in the order of cause and effect. Wages and governmental efforts to influence their level are social phenomena. In the following article an attempt will be made to classify various methods of governmental wage policy under certain type situations and to arrange these type situations in a systematic order. It is hoped that such an arrangement may be helpful in the way …

The New Law Of Nations, Edwin D. Dickinson Dec 1925

The New Law Of Nations, Edwin D. Dickinson

Articles

"In these disillusioned years which are the aftermath of the World War the law of nations has come to be regarded in many quarters with a kind of sophisticated skepticism. It is freely asserted that the law has proved a futile reliance, that it has broken down, and it is asked--with an air of unbelief too obvious to be misunderstood--What is there that is ever likely to be done about it?"

The Reform Of Civil Procedure, Edson R. Sunderland Jul 1923

The Reform Of Civil Procedure, Edson R. Sunderland

Articles

Professor Sunderland addresses the pernicious involvement of legislators in legal reform, contrary to the English model. This duty should be left to those who know the Law better than any: "The courts constitute the judicial department of the state, and the judges who preside and the lawyers who practice in them are the selected group of trained men charged with the responsibility for administering the law."

Legislation In Vague Or General Terms, Ralph W. Aigler Jan 1923

Legislation In Vague Or General Terms, Ralph W. Aigler

Articles

FOR some reason, probably in part the increasing complexity of our life and relationships, but more largely, perhaps, the growing tendency to regulate everybody and everything by positive law, the courts have been called upon with increasing frequency to pass upon the effectiveness of statutes and ordinances phrased in indefinite terms. In a very interesting and valuable paper, Professor Freund has pointed out the weakness and strength, on the one hand, of legislation in general terms, and on the other hand, legislation in which the rule of conduct is attempted to be laid down with precision. His interest apparently lay …

Is A Municipal Fuel Yard A 'Public Service Plant'?, Evans Holbrook Jan 1923

Is A Municipal Fuel Yard A 'Public Service Plant'?, Evans Holbrook

Articles

In Consumers' Coal Co. et al. v. City of Lincoln, et al. (Neb. 1922) 189 N. W. 643, the supreme court of Nebraska held that a municipal fuel-yard, selling fuel at retail to the inhabitants of the city, was not a "public service plant" authorized by a section of the city charter which empowered the city to acquire, own and operate gas and electric plants, street railways, telephone plants, "and any and all other public service plants and properties, for the purpose of supplying the city and the inhabitants thereof with such service and public utilities." The suit was brought …

Emotional Disturbance As Legal Damage, Herbert F. Goodrich Jan 1922

Emotional Disturbance As Legal Damage, Herbert F. Goodrich

Articles

MENTAL pain or anxiety the law cannot value, and does not pretend to redress, when the unlawful act complained of causes that alone. Lord Wensleydale's famous dictum in Lynch v. Knight will serve as a starting point for this discussion. His lordship's notion of mental pain is evidently that of a "state of mind" or feeling, hidden in the inner consciousness of the individual; an intangible, evanescent something too elusive for the hardheaded workaday common law to handle. Likewise, in that very interesting problem regarding recovery for damages sustained through fright, it is always assumed, tacitly or expressly, that mere …

The Lawyers' Club And Dormitories, Henry M. Bates

Articles

The generous gift of an internationally known lawyer who is a graduate of this Law School has made it possible for the Law School to plan a splendid group of buildings. When the whole plan is finally realized we shall have an equipment for the professional work and the living arrangements of our law students hitherto unequaled anywhere in the history of legal education.

Legal Education And Admission To The Bar, Henry M. Bates

From Conclusions: "We cannot close this report with some general remarks concerning standards of admission to the bar. An examination of the Proceedings of the American and the various state bar associations during the last few years will show a constant expression of dissatisfaction with the comparatively low standards for admission which prevail ..."

Recovery Of Life Insurance When Insured Died In Military Service, Ralph W. Aigler Jan 1920

Recovery Of Life Insurance When Insured Died In Military Service, Ralph W. Aigler

Articles

A group of very recent cases, representative no doubt of many others pending, involve an interesting and important question as to the construction of military and naval service clauses in life insurance policies. These clauses which have been common in policies, at least in those issued in the last few years, while varying in wording-and these variations may be vitally important,-provide in general that if the insured meets death while engaged in military or naval service the liability of the insurer shall be limited to the premiums paid, unless permission to engage in such service shall have been obtained from …

Nebulous Injunctions, Edgar N. Durfee Jan 1920

Nebulous Injunctions, Edgar N. Durfee

Articles

Injunctive relief is sought against alleged wrongdoing which is merely incidental to the conduct of a legitimate business. The wrong is established and the court is satisfied that an injunction should issue. Yet some nice questions remain as to the scope and terms of the decree.
