Inheriting Citizenship, Scott Titshaw Jan 2022

Inheriting Citizenship, Scott Titshaw

Articles

Most of us become citizens at birth based either on our birthplace or our parents' citizenship status. Over thirty countries recognize birthplace citizenship, but inherited citizenship is nearly universal. Such universal legal rules are rare, and they are particularly remarkable in the context of citizenship, where state sovereignty is near its apex. This Article explores why inherited citizenship is necessary, even in nations recognizing birthplace citizenship. It surveys the history, definitions, purposes, current rules, politics, and global trends in this area and identifies three modern categories of birthright citizenship laws: primary inherited citizenship systems, dual inherited and birthplace systems, and …

Encapsulation Of Essential Oils In Nanocarriers For Active Food Packaging, Shubham Sharma, Lilly Mulrey, Megan Byrne, Amit Jaiswal, Swarma Jaiswal Jan 2022

Encapsulation Of Essential Oils In Nanocarriers For Active Food Packaging, Shubham Sharma, Lilly Mulrey, Megan Byrne, Amit Jaiswal, Swarma Jaiswal

Articles

Active packaging improves a packaging system’s effectiveness by actively integrating additional components into the packaging material or the headspace around the packaging. Consumer demand and awareness have grown enough to replace chemical agents with natural active agents. Essential oils (EOs) are extensively distributed throughout nature but at low levels and sometimes with poor recovery yields, which poses an issue with their application in food. Due to the instability of EOs when added directly into a food product, they require encapsulation before being added to a packaging matrix such as liposomes, solid-lipid nanoparticles, nano-emulsions, cyclodextrins, and nanostructured lipid nano-carriers. This article …

Narratives Of Black Women Stem Faculty: Breaking Barriers To Promote Institutional Transformation At Historically Black Colleges And Universities, Anna Lee, Maya Corneille, Karen T. Jackson, Bahby Banks, Sherrice Allen, Robin N. Coger, Margaret I. Kanipes, Stephanie Luster-Teasley

Articles

Women faculty at Historically Black Colleges and Universities (HBCUs), experience many barriers. HBCUs’ rich histories of advancing racial equity have often outweighed a focus on gender equity, with issues at the intersection of race and gender receiving minimal attention. This study highlights the need for institutional transformation at HBCUs by identifying the structural factors that promote and inhibit Black women STEM faculty advancement. Interviews (n=15) were conducted with HBCU Black women STEM faculty using the Life Interview approach. The three major themes related to barriers included: (a) greater likelihood of having their expertise questioned, (b) increased pressure to work harder, …

Opportunities And Barriers Faced By Early-Career Civil Engineers Enacting Global Responsibility, Shannon Chance, Inês Direito, John Mitchell Jan 2022

Opportunities And Barriers Faced By Early-Career Civil Engineers Enacting Global Responsibility, Shannon Chance, Inês Direito, John Mitchell

Articles

The term ‘global responsibility’ projects a holistic sense of ethics, sustainability, and obligation. To achieve the long-term viability of human life on Earth, civil engineering must be conducted in increasingly responsible ways, and civil engineers must value and enact global responsibility in their work. Interviews conducted with nine civil engineers in London provide insight regarding engineers’ familiarity with the term, how they learned about it, what opportunities and barriers they face, and what might be done by professional and educational institutions to help them practice more responsibly. Results indicate: the term itself is novel but underlying concepts are not; continuing …

Khan, Prabal Subedi, Soile Tapio, Anna Saran, Mariateresa Mancuso

Articles

Cell communication via exosomes is capable of influencing cell fate in stress situations such as exposure to ionizing radiation. In vitro and in vivo studies have shown that exosomes might play a role in out-of-target radiation effects by carrying molecular signaling mediators of radiation damage, as well as opposite protective functions resulting in resistance to radiotherapy. However, a global understanding of exosomes and their radiation-induced regulation, especially within the context of an intact mammalian organism, has been lacking. In this in vivo study, we demonstrate that, compared to sham-irradiated (SI) mice, a distinct pattern of proteins and miRNAs is found …

A Knowledge-Based Model For Context-Aware Smart Service Systems, Thang Le Dinh, Thanh Thoa Pham Thi, Cuong Pham-Nguyen, Le Nguyen Hoai Nam

Articles

The advancement of the Internet of Things, big data, and mobile computing leads to the need for smart services that enable the context awareness and the adaptability to their changing contexts. Today, designing a smart service system is a complex task due to the lack of an adequate model support in awareness and pervasive environment. In this paper, we present the concept of a context-aware smart service system and propose a knowledge model for context-aware smart service systems. The proposed model organizes the domain and context-aware knowledge into knowledge components based on the three levels of services: Services, Service system, …

Transferring Studies Across Embodiments: A Case Study In Confusion Detection, Na Li, Robert J. Ross Jan 2022

Transferring Studies Across Embodiments: A Case Study In Confusion Detection, Na Li, Robert J. Ross

Articles

Human-robot studies are expensive to conduct and difficult to control, and as such researchers sometimes turn to human-avatar interaction in the hope of faster and cheaper data collection that can be transferred to the robot domain. In terms of our work, we are particularly interested in the challenge of detecting and modelling user confusion in interaction, and as part of this research programme, we conducted situated dialogue studies to investigate users' reactions in confusing scenarios that we give in both physical and virtual environments. In this paper, we present a combined review of these studies and the results that we …

Articles

The mortality associated with cervical cancer can be reduced if detected at the precancer stage, but current methods are limited in terms of subjectivity, cost and time. Optical spectroscopic methods such as Raman spectroscopy can provide a rapid, label-free and nondestructive measurement of the biochemical fingerprint of a cell, tissue or biofluid. Previous studies have shown the potential of Raman spectroscopy for cervical cancer diagnosis, but most were pilot studies with small sample sizes. The aim of this study is to show the clinical utility of Raman spectroscopy for identifying cervical precancer in a large sample set with validation in …

A causal association between radiation exposure and various types of non-malignant diseases, especially cardiovascular diseases, has been extensively reported [1,2]. The risks of radiation-induced heart disease (RIHD) were described in therapeutically exposed cohorts of patients with thoracic tumors in which a high incidence of long-term complications (i.e., pericarditis, cardiomyopathy, coronary artery disease, valvular heart disease, conduction abnormalities and myocardial fibrosis) increased the risk of heart-disease-related mortality [3]. Patients who received post-mastectomy radiotherapy for left-sided breast cancer were at a 2–3-time higher risk of developing cardiovascular disease, due to the apex and anterior wall of the heart being exposed to doses …

Carbon Nanotube Coated Fibrous Tubes For Highly Stretchable Strain Sensors Having High Linearity, Chenchen Li, Bangze Zhou, Yanfen Zhou, Jianwei Ma, Fenglei Zhou, Shaojuan Chen, Stephen Jerrams, Liang Jiang Jan 2022

Carbon Nanotube Coated Fibrous Tubes For Highly Stretchable Strain Sensors Having High Linearity, Chenchen Li, Bangze Zhou, Yanfen Zhou, Jianwei Ma, Fenglei Zhou, Shaojuan Chen, Stephen Jerrams, Liang Jiang

Articles

Strain sensors are currently limited by an inability to operate over large deformations or to exhibit linear responses to strain. Producing strain sensors meeting these criteria remains a particularly difficult challenge. In this work, the fabrication of a highly flexible strain sensor based on electrospun thermoplastic polyurethane (TPU) fibrous tubes comprising wavy and oriented fibers coated with carboxylated multiwall carbon nanotubes (CNTs) is described. By combining spraying and ultrasonic-assisted deposition, the number of CNTs deposited on the electrospun TPU fibrous tube could reach 12 wt%, which can potentially lead to the formation of an excellent conductive network with high conductivity …

The Legal Envelope Theorem, David A. Weisbach, Daniel J. Hemel Jan 2022

The Legal Envelope Theorem, David A. Weisbach, Daniel J. Hemel

Articles

Nontax legal rules regulating the workplace, the financial sector, real property, and many other areas affect the ability of governments to collect revenues and provide public goods. Yet tax-collection considerations rarely enter into economic analyses of nontax legal rules. Usually, tax-collection concerns are shunted aside to separate studies (and separate law school courses) rather than integrated into debates in nontax spheres. This separation between nontax legal rules and tax-collection considerations bears significant negative consequences for the ability of law and economics to generate descriptively accurate and normatively attractive accounts of important nontax legal questions.

This Article takes a step toward …

Regulatory Oscillation, Jonathan S. Masur Jan 2022

Regulatory Oscillation, Jonathan S. Masur

Articles

In the wake of the Reagan deregulation, America experienced twenty- eight years of regulatory progression, with precious little retrogression. That trend came to a crashing halt during the four years of Donald Trump's presidency. As a candidate, Trump campaigned on a series of pledges to reverse and undo as much of the work done by Barack Obama as possible. The Trump EPA was particularly active in this effort. In addition to reversing the Clean Power Plan, under Trump the EPA repealed or substantially weakened a number of other important Obama-era regulations, including a substantial increase in fuel economy standards and …

Antitrust And Inequality, Eric A. Posner, Cass R. Sunstein Jan 2022

Antitrust And Inequality, Eric A. Posner, Cass R. Sunstein

Articles

In its current form, antitrust law is sometimes said to advance consumer welfare and to disregard economic inequality. In fact, because monopoly and monopsony benefit shareholders at the expense of workers and consumers antitrust law redistributes resources from (generally wealthier) shareholders to (generally less wealthy) workers and consumers. Antitrust enforcement agencies seeking to reduce inequality might adjust their priorities and target markets that are disproportionately important for low-income people. Agriculture and health care would be good places to start; food and medicine compose a larger share of the budget of low-income people than of others, and these goods are essential …

The 4c’S Of Pal – An Evidence-Based Model For Implementing Peer Assisted Learning For Mature Students, Nevan Bermingham, Frances Boylan, Barry J. Ryan

Articles

Peer Assisted Leaning (PAL) programmes have been shown to enhance learner confidence and have an overall positive effect on learner comprehension, particularly in subjects traditionally perceived as difficult. This research describes the findings of a three-cycle Action Research study into the perceived benefits of implementing such a programme for mature students enrolled on a computer science programming module on an Access Foundation Programme in an Irish University. The findings from this study suggest that peer learning programmes offer students a valued support structure that aids transition and acculturation into tertiary education whilst simultaneously improving their subject-matter comprehension and confidence. An …

Feminist Ethics And Research With Women In Prison, Christina Quinlan, Lucy Baldwin, Natalie Booth Jan 2022

Feminist Ethics And Research With Women In Prison, Christina Quinlan, Lucy Baldwin, Natalie Booth

Articles

In this article, a new model, An Ethic of Empathy, is proposed as a guide for researchers, particularly new scholars to the discipline. This model emerged from the authors’ concerns regarding the application of ethics to studies that focus on the experience of female offenders in criminal justice systems. The key issue is the vulnerability of incarcerated and post-release women in relationship to the powerful status of social scientist researchers. The complexity of ethics in such research settings necessitates a particular ethical preparation, involving formation, reflection, understanding, commitment, care, and empathy. Three cases are outlined which document the authors’ ethical …

Passage Tombs And Wind Turbines—A Contested Relationship?, Frank Prendergast, Muiris O'Sullivan Prof

Articles

Geospatial and archaeoastronomical analysis of the proposed location of large-scale wind turbines showed a significant negative visual impact on two National Monuments (Knockroe and Kilkieran) and on a hilltop passage tomb at Baunfree. These places straddle county boundaries and their constituent monuments are components of a rare and internationally important prehistoric landscape. Tipperary County Council gave considerable weight to the findings described in this paper in making their decision to refuse planning permission.

Perceived Social Support And Stress: A Study Of 1st Year Students In Ireland, Lavinia Mclean, David Gaul, Rebecca Penco

Articles

Social support is consistently associated with positive outcomes for students, in terms of wellbeing and academic achievement. For first year students, social support offers a way to deal with stressors associated with the challenge of transitioning to university. The current research was conducted with a range of first year students (n = 315) early in their first semester in university. Both male and female students reported moderate levels of social support and perceived stress, while those with higher levels of social support reported lower levels of stress. Gender differences were apparent in both the levels and sources of social …

The Sec's Fight To Stop District Courts From Declaring Its Hearings Unconstiutional, Linda Jellum Jan 2022

The Sec's Fight To Stop District Courts From Declaring Its Hearings Unconstiutional, Linda Jellum

Articles

Can the Securities and Exchange Commission (SEC) unilaterally deny a United States citizen the right to challenge the constitutionality of the agency's administrative hearings in district court? The SEC thinks so, but it makes no sense for these constitutional challenges to be brought in the very proceeding that allegedly, and likely, violates the U.S. Constitution. The appellate courts mostly agreed with the SEC, until recently when the Fifth Circuit held that the district courts should hear these claims. Given this circuit split, this issue will soon reach the Supreme Court, making this Article extremely timely. The Securities Exchange Act of …

Hemp was legalized as a matter of federal law in the 2018 Farm Bill, but the use of cannabis for recreational and medicinal purposes remains a federal crime. This has not stopped an increasing number of states from legalizing recreational and medicinal cannabis as a matter of state law. Unless and until cannabis is legalized on a federal level, coordinated activity to produce and distribute it for recreational and medicinal use can constitute "racketeering activity" under the federal Racketeer Influenced and Corrupt Organizations Act ("RICO') and give rise to "civil RICO" lawsuits by private plaintiffs. This article examines one particular …

Whither The Lofty Goals Of The Environmental Laws?: Can Statutory Directives Restore Purposivism When We Are All Textualists Now?, Stephen M. Johnson

Articles

Congress set ambitious goals to protect public health and the environment when it enacted the federal environmental laws through bipartisan efforts in the 1970s. For many years, the federal courts interpreted the environmental laws to carry out those enacted purposes. Over time, however, courts greatly reduced their focus on the environmental and public health purposes of the environmental laws when interpreting those statutes due to the rise in textualism, the declining influence of the Chevron doctrine, and the increasing willingness of courts to defer to agency underenforcement of statutory responsibilities across all regulatory statutes.

In 2020, the Environmental Protection Network, …

Reasoning V. Rhetoric: The Strange Case Of “Unconstitutional Beyond A Reasonable Doubt”, Hugh D. Spitzer Jan 2022

Reasoning V. Rhetoric: The Strange Case Of “Unconstitutional Beyond A Reasonable Doubt”, Hugh D. Spitzer

Articles

An odd formulation has frequented American constitutional discourse for 125 years: a declaration that courts should not overturn a statute on constitutional grounds unless it is “unconstitutional beyond a reasonable doubt.” This concept has been thought of as a presumption, a standard, a doctrine, or a philosophy of coordinate branch respect and judicial restraint. Yet it has been criticized because “beyond a reasonable doubt” is at root an evidentiary standard of proof in criminal cases rather than a workable theory or standard for deciding constitutional law cases. This article discusses the history and use of “unconstitutional beyond a reasonable doubt,” …

Inclusion And Belonging In Irish Higher Education For Black And Minority Ethnic Students., Fionnuala Darby

Articles

Using Critical Race Theory (CRT) as an analytical prism, this study interrogates the sense of belonging and inclusion experienced by Black and Minority Ethnic (BME) students on one higher education campus in Ireland. The most important story told within the study is as simple as it is complicated. The simple part is that the BME students felt that the campus was inclusive and that they experienced a sense of belonging. The complicated part is that the findings are premised in a normative assumption of whiteness as evidenced by numerous and incremental moments of exclusion in the daily experience of microaggressions, …
