Personal Jurisdiction And Choice Of Law In The Cloud, Damon C. Andrews, John M. Newman Jan 2013

Personal Jurisdiction And Choice Of Law In The Cloud, Damon C. Andrews, John M. Newman

Articles

Cloud computing has revolutionized how society interacts with, and via, technology. Though some early detractors criticized the "cloud" as being nothing more than an empty industry buzzword, we contend that by dovetailing communications and calculating processes for the first time in history, cloud computing is--both practically and legally-a shift in prevailing paradigms. As a practical matter, the cloud brings with it a previously undreamt-of sense of location independence for both suppliers and consumers. And legally, the shift toward deploying computing ability as a service, rather than as a product, represents an evolution to a contractual foundation for interacting.

Already, substantive …

Cyber-Conflict, Cyber-Crime, And Cyber-Espionage, David Weissbrodt Jan 2013

Cyber-Conflict, Cyber-Crime, And Cyber-Espionage, David Weissbrodt

Articles

Computers and the Internet have changed and are continuing to change the way governments, militaries, businesses, and other organs of society manage their activities. While computers can improve efficiency, they are vulnerable to cyber-attack, cyber-crime, and cyber-espionage. 1 The international community, states, and businesses are still adapting to the unique set of challenges posed by cyber-attack, cyber-crime, and cyber-espionage. States are creating military operations that specialize in cyber-attack and defense to adapt to these relatively new threats to national security operations. 2

Litigation's Regulatory Pathways And The Administrative State: Lessons From U.S. And Australian Climate Change Governance, Hari Osofsky, Jacqueline Peel Jan 2013

Litigation's Regulatory Pathways And The Administrative State: Lessons From U.S. And Australian Climate Change Governance, Hari Osofsky, Jacqueline Peel

Articles

The administrative state struggles to address massive, complex problems such as ameliorating the financial crisis, preventing terrorism, or responding to climate change. These problems cut across levels of government — local, state, national, international — and substantive areas of law. Yet our governance structures, for the most part, are not designed to deal well with issues that involve multiple types of governance authority and institutions. A burgeoning literature by leading U.S. scholars describes this problem and proposes solutions. These analyses often include some case law, but their primary focus has been on the legislative and executive branches in the United …

Dynamic Energy Federalism, Hari M. Osofsky, Hannah J. Wiseman Jan 2013

Dynamic Energy Federalism, Hari M. Osofsky, Hannah J. Wiseman

Articles

U.S. energy law and the scholarship analyzing it are deeply fragmented. Each source of energy has a distinct legal regime, and limited federal regulation in some areas has resulted in divergent state and local approaches to regulation. Much of the existing energy law literature reflects these substantive and structural divisions, and focuses on particular aspects of the energy system and associated federalism disputes. However, in order to meet modern energy challenges — such as reducing risks from deepwater drilling and hydraulic fracturing, maintaining the reliability of the electricity grid in this period of rapid technological change, and producing cleaner energy …

Reflections On A Decade Of Global Rankings: What We've Learned And Outstanding Issues, Ellen Hazelkorn Jan 2013

Reflections On A Decade Of Global Rankings: What We've Learned And Outstanding Issues, Ellen Hazelkorn

Articles

Ten years after the first global rankings appeared, it is clear that they have had an extraordinary impact on higher education. While there are fundamental questions about whether rankings measure either quality or what’s meaningful, they have succeeded in exposing higher education to international comparison. Moreso, because of the important role higher education plays as a driver of economic development, rankings have exposed both an information deficit and national competitiveness. Accordingly, both nations and institutions have sought to maximise their position vis-á-vis global rankings with positive and perverse effects. Their legacy is evident in the way rankings have become an …

Risks And Safety On The Internet: Comparing Brazilian And European Children, Alexander Barbosa, Brian O'Neill, Cristina Ponte, Simões Simões, Tatiana Jereissati Jan 2013

Risks And Safety On The Internet: Comparing Brazilian And European Children, Alexander Barbosa, Brian O'Neill, Cristina Ponte, Simões Simões, Tatiana Jereissati

Articles

A child’s home and school are the most frequently reported locations of internet use in Brazil: 60% of Brazilian children aged 9 to 16 who used the internet claimed to access it from home, and 42% from school, whereas in Europe this proportion is 87% for home access and 63% for schools.

However, when it comes to accessing the network from publicly sponsored internet access centres such as Local Area Network (LAN) Houses or cybercafés, the value in Brazil is considerably higher when compared to Europe, 35% against 12% respectively. Access from public libraries is far more popular in Europe …

Next Generation Civil Rights Lawyers: Race And Representation In The Age Of Identity Performance, Anthony V. Alfieri, Angela Onwuachi-Willig

Articles

This Book Review addresses two important new books, Professor Kenneth Mack's Representing the Race: The Creation of the Civil Rights Lawyer and Professors Devon Carbado and Mitu Gulati's Acting White? Rethinking Race in Post-Racial America, and utilizes their insights to both explore the challenges that face the next generation of civil rights lawyers and offer suggestions on how this next generation of civil rights lawyers can overcome these difficulties. Overall, this Book Review highlights one similarity in the roles of black civil rights attorneys past and present: the need for lawyers in both generations to perform their identities in …

The Bio-Nano-Interface In Predicting Nanoparticle Fate And Behaviour In Living Organisms: Towards Grouping And Categorising Nanomaterials And Ensuring Nanosafety By Design, Hugh Byrne, Arti Ahluwalia, Diana Boraschi,, Bengt Fadeel, Peter Gehr, Arno C. Gutleb, Michaela Kendall, Manthos Papadopoulos, Iseult Lynch

Articles

In biological media, nanoparticles acquire a coating of biomolecules (proteins, lipids, polysaccharides) from their surroundings, which reduces their surface energy and confers a biological identity to the particles. This adsorbed layer is the interface between the nanomaterial and living systems and therefore plays a significant role in determining the fate and behaviour of the nanoparticles. This review summarises the state of the art in terms of understanding the bio-nano interface and provides direction for potential future research directions and some recommendations for future priorities and strategies to support the safe implementation of nanotechnologies. The central premise is that nanomaterials must …

Decomposition Of Ireland’S Carbon Emissions From 1990-2010: An Extended Kaya Identity, Tadhg O'Mahony Jan 2013

Decomposition Of Ireland’S Carbon Emissions From 1990-2010: An Extended Kaya Identity, Tadhg O'Mahony

Articles

In recent decades, Ireland has been an important example of a development pathway where rapid economic growth was accompanied by rising energy demand and increasing carbon emissions. Understanding the driving forces of carbon emissions is necessary for policy formulation and decomposition analysis is widely used for this purpose. This study uses an extended Kaya identity as the scheme and applies the log mean Divisia index (LMDI I) as the decomposition technique. Change in carbon emissions is decomposed from 1990 – 2010 and includes a measure of the effect of renewable energy penetration. Results illustrate that scale effects of affluence and …

Augmented Resistance: The Possibilities For Ar And Data Driven Art, Conor Mcgarrigle Jan 2013

Augmented Resistance: The Possibilities For Ar And Data Driven Art, Conor Mcgarrigle

Articles

This article discusses the possibilities for Augmented Reality (AR) as a driver of data based art. The combination of AR and Open Data (in the broadest post-Wikileaks sense) is seen to provide a powerful tool-set for the artist/activist to augment specific sites with a critical, context-specific data layer. Such situated interventions offer powerful new methods for the political activation of sites which enhance and strengthen traditional non- virtual approaches and should be thought of as complementary to, rather than replacing, physical intervention.

I offer as a case study this author’s “NAMAland” project, a mobile artwork which uses Open Data and …

Subsidiary Innovation:A Phenomenon Under Threat?, Marty Reilly, Pamela Sharkey Scott Jan 2013

Subsidiary Innovation:A Phenomenon Under Threat?, Marty Reilly, Pamela Sharkey Scott

Articles

Rarely are the linkages between theory and practice as apparent as those between the strategic renewal literature and current structural transformations being realised within many multinationals (MNCs). Strategic renewal promotes the transformation of capabilities, structural models and organisational reform. Similarly, we can see similarly how many MNC organisations, cognizant of both global and technological change are championing these key tenets in choosing a new path, and shifting from networks of mini-replica subsidiaries towards more task-driven, integrated systems of activities. The advance of this transactional approach to operations is driven by an aim to create greater efficiencies, eliminate duplication of efforts …

Coffee Culture In Dublin: A Brief History, Máirtín Mac Con Iomaire May 2012

Coffee Culture In Dublin: A Brief History, Máirtín Mac Con Iomaire

Articles

This paper discusses the history and development of coffee and coffee houses in Dublin from the 17th century, charting how coffee culture in Dublin appeared, evolved, and stagnated before re-emerging at the beginning of the 21st century, with a remarkable win in the World Barista Championships. The historical links between coffeehouses and media—ranging from print media to electronic and social media—are discussed. In this, the coffee house acts as an informal public gathering space, what urban sociologist Ray Oldenburg calls a “third place,” neither work nor home. These “third places” provide anchors for community life and facilitate and foster broader, …

Proportionality And Parole, Richard A. Bierschbach May 2012

Proportionality And Parole, Richard A. Bierschbach

Articles

Commentators analyzing the Supreme Court's watershed decision in Graham v. Florida, which prohibited sentences of life without parole for juveniles convicted of nonhomicide crimes, have generally done so in substantive proportionality terms, ignoring or downplaying parole in the process. This Article challenges that approach, focusing on the intersection of proportionality and parole as a jumping-off point. Taking parole seriously makes clear that Graham is difficult to understand solely in terms of substantive proportionality concepts like individual culpability and punishment severity. Instead, the decision can be seen as establishing a rule of constitutional criminal procedure, one that links the validity of …

Forum Choice For Terrorism Suspects, Aziz Huq Apr 2012

Forum Choice For Terrorism Suspects, Aziz Huq

Articles

What forum should be used to adjudicate the status of persons suspected of involvement in terrorism? Recent clashes between Congress and the president as to whether the status of terrorism suspects should be determined via Article III courts or military commissions have revived the debate about this venue question. The problem is typically framed as a matter of legal doctrine, with statutory and doctrinal rules invoked as dispositive guides for sorting suspects into either civilian or military venues. This Article takes issue with the utility of that framing of the problem. It argues that the forum question can more profitably …

The Dynamic Role Of Entrepreneurs In Destination Development, Theresa Ryan, Ziene Mottiar, Bernadette Quinn Feb 2012

The Dynamic Role Of Entrepreneurs In Destination Development, Theresa Ryan, Ziene Mottiar, Bernadette Quinn

Articles

This article explores the significant role that entrepreneurs play in destination development. It contends that while the influence of entrepreneurs is discussed in the literature, scant attention has been paid to the dynamic, catalytic and longstanding nature of this influence. This research shows that entrepreneurial activity is dynamic and creative, and has the ability to influence the creation of a culture for tourism that underpins tourism development over long periods of time. Employing a qualitative case study approach, the research investigates Killarney, Co. Kerry, a developed tourism area in Ireland. It identifies not only the way in which entrepreneurs can …

Motionless Monotony: New Nowheres In Irish Photography, Colin Graham

Articles

‘But my mind was too confused … so with a kind of madness growing upon me, I flung myself into futurity … What strange developments of humanity, what wonderful advances upon our rudimentary civilization, I thought, might not appear when I came to look into the dim elusive world that raced and fluctuated before my eyes. I saw great and splendid architecture rising about me, more massive than any buildings of our own time, and yet, it seemed, built of glimmer and mist … the earth seemed very fair. And so my mind came round to the business of stopping.’ …

Maritime Health: A Review With Suggestions For Research, Malcolm Maclachlan, Bill Kavanagh, Alison Kay Jan 2012

Maritime Health: A Review With Suggestions For Research, Malcolm Maclachlan, Bill Kavanagh, Alison Kay

Articles

International maritime health has largely developed within the sphere of occupational health services and international health problems. We reviewed publications in the journal International Maritime Health from 2000 to 2010 to establish the coverage of the journal and the scope of research in maritime health. We identified six thematic categories: healthcare access, delivery and integration; telehealth; non-communicable diseases and physical health problems; communicable diseases; psychological functioning and health; and safety-related issues. We describe the research within these themes and report on their publication prominence. We also analyse the research in terms of its geographical focus, the population groups addressed and …

Efficient Enforcement In International Law, Omri Ben-Shahar, Anu Bradford Jan 2012

Efficient Enforcement In International Law, Omri Ben-Shahar, Anu Bradford

Articles

Enforcement is a fundamental challenge for international law. Sanctions are costly to impose, difficult to coordinate, and often ineffective at accomplishing their goals. Rewards are likewise costly and domestically unpopular. Thus, efforts to address pressing international problems-such as reversing climate change and coordinating monetary policy-often fall short. This Article offers a novel approach to international enforcement and demonstrates the advantages of such an approach over traditional sanctions or rewards. It develops a mechanism of Reversible Rewards, which combines sticks and carrots in a unique, previously unexplored way. Reversible Rewards require that a sum of money be offered as a reward …

Spatial Diversity, Nicholas Stephanopoulos Jan 2012

Spatial Diversity, Nicholas Stephanopoulos

Articles

Why do Supreme Court opinions denounce some districts as political gerrymanders but say nothing about other superficially similar districts? Why does the Court deem some majority-minority districts unnecessary under the Voting Rights Act, or even unconstitutional, but uphold other apparently analogous districts? This Article introduces a concept - "spatial diversity" - that helps explain these and many other election law oddities. Spatial diversity refers to the variation of a given factor over geographic space. For example, a district with a normal income distribution is spatially diverse, with respect to earnings, if most rich people live in one area and most …
