The Creditor Duty Post Sequana: Lessons For Legislative Reform, John Quinn, Philip Gavin Jan 2023

The Creditor Duty Post Sequana: Lessons For Legislative Reform, John Quinn, Philip Gavin

Articles

UK common law recognises that directors owe a fiduciary duty to consider creditors' interests when a company is insolvent or in financial difficulty. However, the scope of this duty remains unclear, particularly the degree of financial difficulty necessary for it to arise. In 2022, in BTI v Sequana, the Supreme Court did little to resolve these uncertainties, retaining a context first approach, where the duty's triggering point is based on the facts and the risk borne by creditors in the specific case. In contrast, Ireland codified its creditor duty in 2022, setting out a series of legislatively defined financial situations …

Views Of The Irish Judiciary On Technology In Courts: Results Of A Survey, Brian M. Barry Dr, Rónán Kennedy Dr Jan 2023

Views Of The Irish Judiciary On Technology In Courts: Results Of A Survey, Brian M. Barry Dr, Rónán Kennedy Dr

Articles

Technology continues to transform how judges perform their functions, both in Ireland and elsewhere. This article reports the results of a survey of Irish judges on their use of technology in their role, their attitudes towards technology, and their views on how it impacts on the judicial function. The survey, part of a global survey, found that Irish judges habitually used digital technologies, and were broadly satisfied with the technology available in chambers, but less so with what was provided in courtrooms. Although generally happy to embrace change, the majority of respondents were concerned with, and did not prefer, online …

Do Games Reduce Math Anxiety? A Meta-Analysis, Pierpaolo Dondio, Viacheslav Filonenko, Mariana Rocha Jan 2023

Do Games Reduce Math Anxiety? A Meta-Analysis, Pierpaolo Dondio, Viacheslav Filonenko, Mariana Rocha

Articles

In this paper, we meta-analyse the empirical evidence about the effectiveness of game-based interventions to reduce students' level of math anxiety. After performing a search for randomised controlled studies relevant to game-based intervention for math anxiety, 16 experimental studies with a total of 686 participants described in 11 peer-review articles met the selection criteria.A random-effects meta-analysis indicated a small and non-significant reduction of math anxiety (mean effect size ES=-0.32, CI=[-0.64,0.01]). The results were moderated by several factors: non-digital games were more effective, while digital games had a negligible mean effect size of $ES=-0.13$, $CI=[-0.33,0.08]$. The effect size was moderated also …

Decision Making For Process Control Management In Control Rooms: A Survey Methodology And Initial Findings, Chidera Winifred Amazu, Ammar N. Abbas, Micaela Demichela, Davide Fissore Jan 2023

Decision Making For Process Control Management In Control Rooms: A Survey Methodology And Initial Findings, Chidera Winifred Amazu, Ammar N. Abbas, Micaela Demichela, Davide Fissore

Articles

Control rooms and their operators are active elements in complex socio-technical systems such as process plants. Control room operators monitor process operations, respond to alarms, and manage process deviations until emergencies. The increase in automation of plants and equipment makes the operators less involved in manual process control or other physical roles while more exposed to cognitive load generated, for example, by increasing the number of alarms or potential system failures in abnormal situations. A shift in process control design and management techniques to holistically capture risks due to evolving process or monitoring capabilities and the related influencing factors is …

The Quest For Influence: Examining Russia's Public Diplomacy Mechanisms In Africa, Isaac Antwiboasiako Dec 2022

The Quest For Influence: Examining Russia's Public Diplomacy Mechanisms In Africa, Isaac Antwiboasiako

Articles

This article examines Russian public diplomacy mechanisms in Africa. These include the intentional use of historical ties, various aid programmes in education and health, the targeted use of international broadcasting and digital media, and the exploitation of anti-Western sentiments on the continent. Russia employs these to win the hearts and minds of African publics for its national interest. The article first explores Moscow’s public diplomacy in general and analyses the challenges Russia faces in Africa, which has become a ‘dumping ground’ for public diplomacy campaigns by the US, the EU and its members, the UK, and China. The article argues …

The Eudemonic And Hedonic Impacts Of Attending Live And Virtual Music And Art Events, Philippa Kirwan, Samantha Morris

Articles

This paper examines the under-investigated well-being impacts of arts and music events attendance, in both a live and virtual capacity. Using eudaimonia and hedonia as a measure for well-being, three objectives were investigated; 1) Do live arts and music events meet attendees eudemonic and hedonic needs? 2) Do virtual arts and music events meet attendees eudemonic and hedonic needs? 3) How do live and virtual music and art events compare in meeting attendees eudemonic and hedonic needs? The study focused on attendee’s experiences having attended both live and virtual events. Using nine semi-structured interviews this research found that live music …

The Unfulfilled Promise Of Environmental Constitutionalism, Amber Polk Dec 2022

The Unfulfilled Promise Of Environmental Constitutionalism, Amber Polk

Articles

The political push for the adoption of state-level "green amendments" in the United States has gained significant traction in just the last couple of years. Green amendments add an environmental right to a state's constitution. Five such amendments were made in the 1970s in Pennsylvania, Montana, Hawaii, Massachusetts, and Illinois. This Article looks in depth at the case law that has developed the contours of these constitutional environmental rights in the wake of the political revival of environmental constitutionalism in the United States. I distill two lessons from this jurisprudence. First, constitutional environmental rights are interpreted by the courts as …

Delegation At The Founding: A Response To Critics, Julian Davis Mortenson, Nicholas Bagley Dec 2022

Delegation At The Founding: A Response To Critics, Julian Davis Mortenson, Nicholas Bagley

Articles

This essay responds to the wide range of commentary on Delegation at the Founding, published previously in the Columbia Law Review. The critics’ arguments deserve thoughtful consideration and a careful response. We’re happy to supply both. As a matter of eighteenth-century legal and political theory, “rulemaking” could not be neatly described as either legislative or executive based on analysis of its scope, subject, or substantive effect. To the contrary: Depending on the relationships you chose to emphasize, a given act could properly be classified as both legislative (from the perspective of the immediate actor) and also executive (from the perspective …

Correction Of Velopharyngeal Insufficiency Secondary To Palatal Gunshot Wound: Case Presentation And Review Of The Literature, Rogelio Martinez-Wagner, Cristopher Cardenas-Cruz, Ivan Ortiz-Monasterio, Edgar Vargas, Maria M. Cabrera, Pablo A. Ysunza, M. Del Carmen Pamplona, Diane E. Campos-Lopez

Articles

Reconstruction of midfacial traumatic defects secondary to a gunshot wound (GSW) is one of the most challenging head surgeries. The high impact on the functional and aesthetic quality of life, and the small margin of error to achieve a successful outcome are significant hurdles in the surgical treatment of these cases. Here we report a 33-years old patient who suffered a GSW with an entrance wound penetrating between the soft and hard palate and an exit wound on the right malar region. A description of the case and a systematic review of the literature were conducted. The treatment depends on …

Moving From Access To Inclusion By Making Communication A Priority, Sara Schley, Marchetti E. Carol Nov 2022

Moving From Access To Inclusion By Making Communication A Priority, Sara Schley, Marchetti E. Carol

Articles

What does it mean to be a full participant in a faculty-student partnership? We tackled this question by considering disability identity and communication access as pivotal mindsets in facilitating not only pedagogical change in the college classroom, but also student transformation into change agents. Via a series of semester-long FLCs, we used a partnership model to develop strategies aimed at increasing interaction and inclusion in postsecondary courses (Schley et al., 2021). The student partners were all deaf or hard of hearing (DHH), with a diverse set of communication preferences. Faculty partners were also diverse: some were DHH though most were …

Wto Security Exceptions: A Sliding Scale Approach To Protect The Rules-Based System For Global Free Trade, Ts Somashekar, Kanchan Yadav Nov 2022

Wto Security Exceptions: A Sliding Scale Approach To Protect The Rules-Based System For Global Free Trade, Ts Somashekar, Kanchan Yadav

Articles

Since the enforcement of the General Agreement on Tariffs and Trade (GATT) in 1947 and subsequently with the establishment of the World Trade Organization, the global community has been moving towards a more secure and rule-based international trade law regime. The cornerstones of the system are predictability and transparency, which ensure that a state, no matter how powerful, cannot undertake a discriminatory trade measure against another going above and beyond the rules. However, the recent instances of unilateral invocation of the security exceptions found in the various trade agreements endanger the very basis of the WTO system. The very first …

Is Neuro-Symbolic Ai Meeting Its Promises In Natural Language Processing? A Structured Review, Kyle Hamilton, Kyle Hamilton, Aparna Nayak, Bojan Bozic, Luca Longo Nov 2022

Is Neuro-Symbolic Ai Meeting Its Promises In Natural Language Processing? A Structured Review, Kyle Hamilton, Kyle Hamilton, Aparna Nayak, Bojan Bozic, Luca Longo

Articles

Advocates for Neuro-Symbolic Artificial Intelligence (NeSy) assert that combining deep learning with symbolic reasoning will lead to stronger AI than either paradigm on its own. As successful as deep learning has been, it is generally accepted that even our best deep learning systems are not very good at abstract reasoning. And since reasoning is inextricably linked to language, it makes intuitive sense that Natural Language Processing (NLP), would be a particularly well-suited candidate for NeSy. We conduct a structured review of studies implementing NeSy for NLP, with the aim of answering the question of whether NeSy is indeed meeting its …

Inclusion And Belonging In Irish Higher Education For Black And Minority Ethnic Students, Fionnuala Darby Nov 2022

Inclusion And Belonging In Irish Higher Education For Black And Minority Ethnic Students, Fionnuala Darby

Articles

Using Critical Race Theory (CRT) as an analytical prism, this study interrogates the sense of belonging and inclusion experienced by Black and Minority Ethnic (BME) students on one higher education campus in Ireland. The most important story told within the study is as simple as it is complicated. The simple part is that the BME students felt that the campus was inclusive and that they experienced a sense of belonging. The complicated part is that the findings are premised in a normative assumption of whiteness as evidenced by numerous and incremental moments of exclusion in the daily experience of microaggressions, …

An Evidence Review Of Behavioural Economics In The Justice Sector, Brian Barry, Lucia Morales, Aiden Carthy Nov 2022

An Evidence Review Of Behavioural Economics In The Justice Sector, Brian Barry, Lucia Morales, Aiden Carthy

Articles

Behavioural economics combines elements of economics and psychology to better understand how and why people behave the way they do in the real world. While behavioural economics originally sought to better understand economic decision-making, it has since grown in scope and application, and it is increasingly used by governments, government departments and other organisations to shape and implement public policies in a range of policy areas. This Review considers the application of behavioural economics theories and concepts (commonly referred to as behavioural insights) to the justice sector in a range of areas of justice policy in different jurisdictions. Areas of …

African Governments’ Foreign Publics Engagement: Public Diplomacy In African Perspective, Isaac Antwiboasiako Oct 2022

African Governments’ Foreign Publics Engagement: Public Diplomacy In African Perspective, Isaac Antwiboasiako

Articles

Scholars over the years have delved into the discourse of states’ foreign publics engagement in achieving their foreign policy objectives. This analysis is done generally with the western perspective of public diplomacy with recent Asian scholarship evolving. As a result, this study aims to reflect on public diplomacy from an African perspective. Therefore, it analyses how African governments have engaged their foreign publics (foreign governments and their citizens) to attract foreign aid, tourism, and investments in their nation-building and development trajectory. The article explores African public diplomacy mechanisms such as diasporas, nation branding, cultural diplomacy, and many others. It also …

Protecting Ocean Carbon Through Biodiversity And Climate Governance, Laura G. Elsler, Maartje Oostdijk, Lisa A. Levin, Erin V. Satterthwaite, Malin L. Pinsky, Guillermo Ortuño Crespo, Mary S. Wisz Oct 2022

Protecting Ocean Carbon Through Biodiversity And Climate Governance, Laura G. Elsler, Maartje Oostdijk, Lisa A. Levin, Erin V. Satterthwaite, Malin L. Pinsky, Guillermo Ortuño Crespo, Mary S. Wisz

Articles

Global policy goals for halting biodiversity loss and climate change depend on each other to be successful. Marine biodiversity and climate change are intertwined through foodwebs that cycle and transport carbon and contribute to carbon sequestration. Yet, biodiversity conservation and fisheries management seldom explicitly include ocean carbon transport and sequestration. In order to effectively manage and govern human activities that affect carbon cycling and sequestration, international biodiversity and climate agreements need to address both biodiversity and climate issues. International agreements that address issues for climate and biodiversity are best poised to facilitate the protection of ocean carbon with existing policies. …

Whose Debt Is It Anyway?, Luís C. Calderón Gómez Oct 2022

Whose Debt Is It Anyway?, Luís C. Calderón Gómez

Articles

Every year, companies issue hundreds of billions of dollars of debt with a feature carrying unclear tax consequences. So do individuals, who frequently tie their most significant financial asset to this type of instrument. Yet this instrument is not an exotic or innovative financial derivative, but is simple vanilla debt with two or more borrowers, or “co-obligated debt”. Co-obligated debt poses a conceptual problem for the law because it does not fit neatly into the simple and dyadic legal framework underlying the law’s conception of debt, where one creditor lends money to one borrower in exchange for a direct promise …

Visual Attention For Linguistic And Non-Linguistic Body Actions In Non-Signing And Native Signing Children, Rain G. Bosworth, So One Hwang, David P. Corina Sep 2022

Visual Attention For Linguistic And Non-Linguistic Body Actions In Non-Signing And Native Signing Children, Rain G. Bosworth, So One Hwang, David P. Corina

Articles

Evidence from adult studies of deaf signers supports the dissociation between neural systems involved in processing visual linguistic and non-linguistic body actions. The question of how and when this specialization arises is poorly understood. Visual attention to these forms is likely to change with age and be affected by prior language experience. The present study used eye-tracking methodology with infants and children as they freely viewed alternating video sequences of lexical American sign language (ASL) signs and non-linguistic body actions (self-directed grooming action and objectdirected pantomime). In Experiment 1, we quantified fixation patterns using an area of interest (AOI) approach …

A Framework For Sexism Detection On Social Media Via Byt5 And Tabnet, Arjumand Younus, Muhammad Atif Qureshi Sep 2022

A Framework For Sexism Detection On Social Media Via Byt5 And Tabnet, Arjumand Younus, Muhammad Atif Qureshi

Articles

Hateful and offensive content on social media platforms particularly content directed towards a specific gender is a great impediment towards equality, diversity and inclusion. Social media platforms are facing increasing pressure to work towards regulation of such content; and this has directed researchers in text mining to work towards hate speech identification algorithms. One such attempt is sexism detection for which mostly transformer-based text methods have been proposed. We propose a combination of byte-level model ByT5 with tabular modeling via TabNet that has at its core an ability to take into account platform and language aspects of the challenging task …

“It's So Normal, And … Meaningful.” Playing With Narrative, Artifacts, And Cultural Difference In Florence, Dheepa Sundaram, Owen Gottlieb

Articles

This article considers how player interactions with religious and ethnic markers, create

a globalized game space in the mobile game Florence (2018). Florence is a multiaward-

winning interactive novella game with story-integrated minigames that weave

play experiences into the narrative. The game, in part, explores love, loss, and

rejuvenation as relatable experiences. Simultaneously, the game produces a unique

experience for each player, as they can refract the game narrative through their own

cultural, identitarian lens. The game assumes the shared cultural space of the player,

the player-character (PC), and the non-player-character (NPC) while blurring the

boundaries between each of these …

Design/methodology/approach

The induction-driven, 18-month longitudinal empirical inquiry focused on six early-stage nascent entrepreneurs. Qualitative methods included participant observation during an enterprise program, qualitative interviews and ongoing informal communication.

Findings

The data uncovered the interplay between the nascent immigrant entrepreneurship and cross-cultural adaptation. This led to the …

Physiognomic Artificial Intelligence, Luke Stark, Jevan Hutson Aug 2022

Physiognomic Artificial Intelligence, Luke Stark, Jevan Hutson

Articles

The reanimation of the pseudosciences of physiognomy and phrenology at scale through computer vision and machine learning is a matter of urgent concern. This Article—which contributes to critical data studies, consumer protection law, biometric privacy law, and antidiscrimination law—endeavors to conceptualize and problematize physiognomic artificial intelligence (“AI”) and offer policy recommendations for state and federal lawmakers to forestall its proliferation.

Physiognomic AI, as this Article contends, is the practice of using computer software and related systems to infer or create hierarchies of an individual’s body composition, protected class status, perceived character, capabilities, and future social outcomes based on their physical …
