Holiday Home Owners, A Route To Sustainable Tourism Development? An Economic Analysis Of Tourist Expenditure Data, Ziene Mottiar Jan 2006

Holiday Home Owners, A Route To Sustainable Tourism Development? An Economic Analysis Of Tourist Expenditure Data, Ziene Mottiar

Articles

Although sustainability comprises economic social and environmental aspects, economic analysis has been less evident in this literature. This article takes an economic perspective to evaluate the contribution of holiday home owners to a local economy. Tourism destinations which are at the mature stages of the tourism lifecycle wish to maximise revenue from tourism while minimising costs such as overcrowding. A prime objective has to be to attract the more valuable tourists. The analysis of North Wexford in Ireland poses questions such as: How does the holiday home owners’ expenditure in the local area compare to that of traditional tourists? Do …

Process Modeling For Simulation, John Ryan, Cathal Heavey Jan 2006

Process Modeling For Simulation, John Ryan, Cathal Heavey

Articles

This paper discusses shortfalls in relation to the requirements gathering phases of simulation. While many developments have taken place around supporting the model coding task of simulation, there are few tools available to assist in the requirements gathering phase. This is surprising as it has been reported by several researchers that the requirements phase can absorb twice as much resources as the coding phase. There are numerous process modeling tools available (over 100) that can and have been used to support the requirements phase of simulation. This paper provides a selective review of some of the most important in relation …

Chevronizing Foreign Relations Law, Eric A. Posner, Cass R. Sunstein Jan 2006

Chevronizing Foreign Relations Law, Eric A. Posner, Cass R. Sunstein

Articles

A number of judge-made doctrines attempt to promote international comity by reducing possible tensions between the United States and foreign sovereigns. For example, courts usually interpret ambiguous statutes to conform to international law and understand them not to apply outside of the nation's territorial boundaries. The international comity doctrines are best understood as a product of a judicial judgment that in particular contexts the costs of deference to foreign interests are lower than the benefits to American interests. Sometimes Congress balances these considerations and incorporates its judgment in a statute, but usually it does not. In such cases, executive interpretations …

The Role Of The Judge In The Twenty-First Century, Richard A. Posner Jan 2006

The Role Of The Judge In The Twenty-First Century, Richard A. Posner

Articles

In my youthful, scornful way, I recognized four kinds of judgments; first the cogitative, of and by reflection and logomancy; second, aleatory, of and by the dice; third, intuitive, of and by feeling or "hunching;" and fourth, asinine, of and by an ass; and in that same youthful, scornful way I regarded the last three as only variants of each other, the results of processes all alien to good judges.

Articles

Objectives: There are no prevalence data for childhood sexual abuse among Tanzanian university students. This investigation addressed this paucity. The nature of sexual abuse was also investigated. Method: Participants (N= 487) from a university in Tanzania completed a questionnaire which assessed abusive childhood sexual experiences, gathering information about age of victim, duration of abuse, perpetrators, amount of force or persuasion involved, and potential causes of child sexual abuse. A number of individuals were also interviewed about their experiences. Results: The overall prevalence rate for child sexual abuse was 27.7%, with rates being higher for females than for males. The average …

The present analysis is the phase one of a broader project, the Sign2 Project, which is focused on a complete technological approach to the translation of American Sign Language (ASL) finger-spelling to digital audio and/or text. The methodology adopted in this analysis employs a grayscale image processing technique. We will describe the latest results as well as future enhancements to the system. This paper will also discuss the application of the approach to the telecommunication Industry.

Using A 2-D Simulation Program To Support Interactive Learning Of 3-D Vehicle Dynamics, George Sutherland Jan 2006

Using A 2-D Simulation Program To Support Interactive Learning Of 3-D Vehicle Dynamics, George Sutherland

Articles

The author has developed an undergraduate course to introduce students to the basic principles of land vehicle dynamics. Many students, though they are intrinsically interested in the subject, have difficulty grasping the physical principles needed to enable a sufficient understanding of the subject to support their aspirations of making informed vehicle design decisions. An intriguing potentially useful fact is that the computer gaming world has developed widely available very sophisticated vehicle computer models with realistic human driver interfaces. However, while very entertaining, these computer games are not suitable for helping undergraduate engineering students understand the basic principles needed for land …

U.S. Torture As Tort, Richard Henry Seamon Jan 2006

U.S. Torture As Tort, Richard Henry Seamon

Articles

Now that the United States has used torture in the war on terrorism and the victims of this torture have begun to sue, it is useful to analyze the potential liability of the United States and its officials for torture under current domestic law. This Article conducts that analysis, and, based on it, assesses the adequacy of current law. The Article concludes that the United States and its officials have no more than minimal liability for torture under current law. The Article also concludes that current law is inadequate. It is inadequate because it is based on considerations of when …

Government Secrets, Constitutional Law, And Platforms For Judicial Intervention, Adam M. Samaha Jan 2006

Government Secrets, Constitutional Law, And Platforms For Judicial Intervention, Adam M. Samaha

Articles

American law has yet to reach a satisfying conclusion about public access to information on government operations. But recent events are prompting reconsideration of the status quo. As our current system is reassessed, three shortfalls in past debates should be overcome. The first involves ignorance of foreign systems. Other democracies grapple with information access problems, and their recent experiments are illuminating. Indeed they expose two additional domestic weaknesses. One is a line we have drawn within constitutional law. Courts and commentators tend to treat constitutional issues of public access separately from those of executive discretion to withhold information, but these …

Piercing The Confidentiality Veil: Physician Testimony In International Criminal Trials Against Perpetrators Of Torture, David Weissbrodt, Ferhat Pekin, Amelia Wilson Jan 2006

Piercing The Confidentiality Veil: Physician Testimony In International Criminal Trials Against Perpetrators Of Torture, David Weissbrodt, Ferhat Pekin, Amelia Wilson

Articles

Physician-patient confidentiality is a notion deeply rooted in most medical traditions throughout the world. 2 Many nations have codified patient protections and rights with statutes that emphasize the inviolability of this confidence. 3 Physicians are prohibited, except in limited circumstances, to reveal any confi-dential information or communication. 4 Violating confiden-tiality often exposes the physician to professional, civil, and sometimes criminal sanctions. 5 Confidentiality is designed to protect the patient's most intimate information as well as foster a candid relationship between physician and patient to facilitate successful diagnosis and treatment. 6 And yet despite the raison d'etre of confidentiality laws and …

Convergence, Culture And Contract Law In China, John H. Matheson Jan 2006

Convergence, Culture And Contract Law In China, John H. Matheson

Articles

At the height of the Industrial Revolution, Britain was called "the Workshop of the World." 1 That title surely belongs to the People's Republic of China (PRC) 2 today. For example, China already is the world's fastest-growing large economy and the second largest holder of foreign-exchange reserves. 3 Furthermore, China is now the world's largest producer of coal, steel, and cement. 4 It is the second largest consumer of energy and the third largest importer of oil. 5 China's exports to the United States have grown by 1600% over the past fifteen years, and U.S. exports to China have grown …

Prospects For Ratification Of The Convention On The Rights Of The Child, David Weissbrodt Jan 2006

Prospects For Ratification Of The Convention On The Rights Of The Child, David Weissbrodt

Articles

Since early in the development of international human rights law, the particular need to care for children has been acknowledged. Beginning with the Geneva Declaration on the Rights of the Child in 1924 1 and the Declaration of the Rights of the Child, adopted by the U.N. General Assembly in 1959, 2 children's rights have been recognized by human rights organizations and instruments alike. Rights of the child were included in the Universal Declaration of Human Rights; 3 the Geneva Convention for the Protection of Civilian Persons in Time of War; 4 the International Covenant on Economic, Social and Cultural …

Why The Generation-Skipping Transfer Tax Sparked Perpetual Trusts, Mary Louise Fellows Jan 2006

Why The Generation-Skipping Transfer Tax Sparked Perpetual Trusts, Mary Louise Fellows

Articles

Max M. Schanzenbach and Robert H. Sitkoff, in the work they presented at this Symposium and in their earlier work, Jurisdictional Competition for Trust Funds: An Empirical Analysis of Perpetuities and Taxes, provide data to support what practitioners, policymakers, and academics already believe - the generation-skipping transfer (GST) tax exemption encouraged the creation of dynastic trusts and made those states that had no Rule Against Perpetuities (RAP) and no income tax on trusts particularly attractive as sites for settlors to establish their trusts. 1 Their work with the state-level panel data assembled from annual reports to federal banking authorities by …

Goliath Has The Slingshot: Public Benefit And Private Enforcement Of Minnesota Consumer Protection Laws, Prentiss Cox Jan 2006

Goliath Has The Slingshot: Public Benefit And Private Enforcement Of Minnesota Consumer Protection Laws, Prentiss Cox

Articles

The phrase "consumer protection case" may conjure up a used-car buyer trying to get recompense for a vehicle that turned out to be less than promised, or an elderly homeowner victimized by predatory lending tactics trying to maintain possession of her home. In August 2000, the private right of action to enforce Minnesota consumer protection laws was held to be something entirely different. After the Minnesota Supreme Court's decision in Ly v. Nystrom, 1 a business complaining about a competitor's advertising is more likely to have available a private right of action to enforce these laws than either the frustrated …
