Gas Plume Species Identification By Regression Analyses, David Pogorzala, David W. Messinger, Carl Salvaggio, John R. Schott Jan 2004

Gas Plume Species Identification By Regression Analyses, David Pogorzala, David W. Messinger, Carl Salvaggio, John R. Schott

Articles

Identification of constituent gases in effluent plumes is performed using linear least-squares regression techniques. Overhead thermal hyperspectral imagery is used for this study. Synthetic imagery is employed as the test-case for algorithm development. Synthetic images are generated by the Digital Imaging and Remote Sensing Image Generation (DIRSIG) Model. The use of synthetic data provides a direct measure of the success of the algorithm through the comparison with truth map outputs. In image test-cases, plumes emanating from factory stacks will have been identified using a separate detection algorithm. The gas identification algorithm being developed in this work will then be used …

Alternative Velocity Measurement Techniques In Synchroballistic Photography, Andrew Davidhazy

Articles

Synchroballistic cameras have many applications but mostly these are buried in specialized laboratories, hard to access military installations or in technical literary archives. This article illustrates and explains two data reduction approaches for obtaining useful data from synchroballistic photographs of missiles in flight.

The First Free Exercise Case, Walter J. Walsh Jan 2004

The First Free Exercise Case, Walter J. Walsh

Articles

Part I of this Article tells the colonial history of religious freedom in New York State from a minority perspective, with specific reference to the secrecy of the confessional-the very practice that would be constitutionally tested in Philips. Part II describes the immediate social and political issues raised by the influx of Irish Catholic refugees into New York City in the wake of the failed United Irish Rebellion of 1798. Part III treats the unfriendly 1811 ruling of the federalist Chief Justice James Kent in People v. Ruggles as representative of the dominant Anglocentric constitutional legacy of imperial Protestant …

Flawed Justice: Limitation Of Parental Remedies For The Loss Of Consortium Of Adult Children, William S. Bailey Jan 2004

Flawed Justice: Limitation Of Parental Remedies For The Loss Of Consortium Of Adult Children, William S. Bailey

Articles

This article presents the inherent contradiction between a parent-child relationship that has steadily evolved from the early 20th Century to the present and the multitude of court decisions on damages that remain studiously ignorant of this shift.

Part I of the article will set forth the common law origins of restrictions on recovery for wrongful death within the context of a shifting view of children from economic units to objects of adoration. Part II will examine the devastating impact that the loss of an adult child has on parents both from their perspectives and from now existing research.

Improving Laws, Declining World: The Tort Of Contamination, William H. Rodgers, Jr. Jan 2004

Improving Laws, Declining World: The Tort Of Contamination, William H. Rodgers, Jr.

Articles

This article considers nature's "baseline" through the lens of modern environmental laws. We measure this "baseline" like never before and are proud of our databases on fish advisories, beach closures, and impaired water bodies, to mention a few. The ubiquitous legal response to these measures of environmental decline is the public warning "Don't Eat the Fish" and "Don't Drink the Water."

This article assesses the function, utility, and purpose of these public warnings and finds them wanting. Their principal value is that they serve as measures of lost natural capital and harbingers of shifting baselines.

Our descriptive journey leaves us …

Ionizing Radiation Induces A Stress Response In Primary Cultures Of Rainbow Trout Skin, Fiona Lyng, M. Lyons-Alcantara, P. Owell, Sharon Ni Shuilleabhain, Colin Seymour, D. Cottell, Carmel Mothersill Jan 2004

Ionizing Radiation Induces A Stress Response In Primary Cultures Of Rainbow Trout Skin, Fiona Lyng, M. Lyons-Alcantara, P. Owell, Sharon Ni Shuilleabhain, Colin Seymour, D. Cottell, Carmel Mothersill

Articles

Fish skin is very vulnerable to damage from physical and chemical pollutants because it is in direct contact with the aquatic environment. In this study, the effect of g radiation on primary cultures of rainbow trout skin was investigated. Primary cultures containing two cell types, epidermal cells and goblet mucous cells, were exposed to doses ranging from 0.5–15 Gy 60Co g radiation. Expression of PCNA, c-myc and BCL2 was investigated as well as growth and levels of apoptosis and necrosis. Morphological and functional changes were also studied. The irradiated cultures showed evidence of a dose-dependent increase in necrosis and enhanced …

An Investigation Of The Relationship Between In-Vitro And In-Vivo Ultrasound Image Quality Parameters, Jacinta Browne, Amanda Watson, Cathy Muir, Peter Hoskins, Alex Elliott

Articles

The aim of this paper is to investigate the relationship between Bmode and colour Doppler technical test methods with the clinical perception of Bmode and Doppler invivo test parameters. It was found that technical and clinical comparisons between the Bmode test parameters: lateral resolution versus clinical resolution; anechoic target detection versus clinical noise; and penetration depth versus clinically useful penetration depth, demonstrated moderate correlations, (r= 0.69, p

How Do The Social Benefits And Costs Of The Patent System Stack Up In Pharmaceuticals?, Daniel J. Gifford Jan 2004

How Do The Social Benefits And Costs Of The Patent System Stack Up In Pharmaceuticals?, Daniel J. Gifford

Articles

This paper explores the workings of the patent system in the context of the generation of new pharmaceutical products. First it identifies the relevant characteristics of the patent system and its relation to the market. The paper concedes that, in general, the patent system is probably the best way of generating new technology, in substantial part because that system uses the market to provide both incentives and rewards. The paper also identifies downsides of this patent/market system: deadweight loss and the unresponsiveness of that patent/market system to the needs of the poor. The paper then explores the social costs and …

Moral Judgment Of Law Students Across Three Years: Influences Of Gender, Political Ideology And Interest In Altruistic Law Practice, Maury Landsman, Steven P. Mcneel Jan 2004

Moral Judgment Of Law Students Across Three Years: Influences Of Gender, Political Ideology And Interest In Altruistic Law Practice, Maury Landsman, Steven P. Mcneel

Articles

Jokes and negative stereotypes about lawyers abound, suggesting low levels of honesty and morality. One commentator has suggested a reason for this: The joke rings true to a lot of people because of what many lawyers in this country - including many at the top of the profession - do for their clients: bend, distort, conceal, cover up, obfuscate, or misrepresent the facts, in ways that are simultaneously (1) regarded by ordinary people as just plain dishonest, and (2) defended by many lawyers and legal experts as embodying the finest traditions of the bar and of legal ethics in our …

Employment Discrimination Remedies And Tax Gross Ups, Gregg Polsky, Stephen Befort Jan 2004

Employment Discrimination Remedies And Tax Gross Ups, Gregg Polsky, Stephen Befort

Articles

This article considers whether a successful employment discrimination plaintiff may be entitled, under current law, to receive an augmented award (a gross up) to neutralize certain adverse federal income tax consequences. The question of whether such a gross up is allowed, the resolution of which can have drastic effects on litigants, has received almost no attention from practitioners, judges, and academics. Because of the potentially enormous impact of the alternative minimum tax (AMT) on discrimination lawsuit recoveries, however, the gross up issue is now beginning to appear in reported cases. The three principal federal anti-discrimination statutes - Title VII, the …

The Unknown Past Of Lawrence V. Texas, Dale Carpenter Jan 2004

The Unknown Past Of Lawrence V. Texas, Dale Carpenter

Articles

On the night of September 17, 1998, someone called the police to report that a man was going crazy with a gun inside a Houston apartment. When Harris County sheriff's deputies entered the apartment they found no person with a gun but did witness John Lawrence and Tyron Garner having anal sex. This violated the Texas Homosexual Conduct law,3 and the deputies hauled them off to jail for the night. Lawyers took the men's case to the Supreme Court and won a huge victory for gay rights.

The Limits Of Business Limited Liability: Entity Veil Piercing And Successor Liability Doctrines, John Matheson Jan 2004

The Limits Of Business Limited Liability: Entity Veil Piercing And Successor Liability Doctrines, John Matheson

Articles

The quest for limited liability in business enterprises and transactions has been a driving force in the development of business organization law for centuries. The historical development of corporations and limited partnerships evidences this primary goal. The recent development of the modern forms of limited liability partnerships and limited liability companies proves that this quest continues unabated. In addition, parties to significant business transfer transactions have long sought by construct and contract to apportion and limit their respective legal responsibilities and liabilities.Counterbalancing this inexorable trend toward limited liability has been the penchant of common law jurisprudence to define its limits. …

The Admissibility Of Expert Testimony About Cognitive Science Research On Eyewitness Identification, Edward D. Stein Dec 2003

The Admissibility Of Expert Testimony About Cognitive Science Research On Eyewitness Identification, Edward D. Stein

Articles

Eyewitness identifications are important to jurors, especially in criminal trials. Psychological research has shown, however, that eyewitness testimony is systematically fallible in ways that undermine the goals of the rules of evidence. This article assesses the arguments for and against admitting expert testimony concerning cognitive science research about eyewitness identification. The article concludes that experts should in many instances be allowed to testify about the problems with eyewitness identification testimony.

Mature Students - An Examination Of Dit’S Policy And Practice, Dáire Mag Cuill Nov 2003

Mature Students - An Examination Of Dit’S Policy And Practice, Dáire Mag Cuill

Articles

This paper examines the current position of mature students in the Technological University Dublin, the largest third-level institute in Ireland. It also deals with the treatment of mature applicants, and the position of mature students in the Republic of Ireland in general. The focus of the paper is on equity issues, and in all discussions of equity the underpinning principle is equality of opportunity. Where places on a third-level course are limited, for example, all applicants must be treated equally and the places allocated in a ‘fair’ manner. This does not mean that one cannot discriminate in the true sense …

A Two Phase Approach To Bayesian Network Model Selection And Comparison Between The Mdl And Dgm Scoring Heuristics, Michael Kane, Sahin Ferat, Andreas Savakis Oct 2003

A Two Phase Approach To Bayesian Network Model Selection And Comparison Between The Mdl And Dgm Scoring Heuristics, Michael Kane, Sahin Ferat, Andreas Savakis

Articles

This paper presents an efficient algorithm for learning a Bayesian belief network (BBN) structure from a database, as well as providing a comparison between two BBN structure fitness functions. A Bayesian belief network is a directed acyclic graph representing conditional expectations. In this paper, we propose a two-phase algorithm. The first phase uses asymptotically correct structure learning for efficient search space exploration, while the second phase uses greedy model selection for accurate search space exploration. The minimum description length (MDL) structure fitness function is also compared with the database given model probability (DGM) fitness function in the second phase. The …
