Not Your Mother's Will: Gender, Language, And Wills, Karen J. Sneddon Jan 2015

Not Your Mother's Will: Gender, Language, And Wills, Karen J. Sneddon

Articles

“Boys will be boys, but girls must be young ladies” is an echoing patriarchal refrain from the past. Formal equality has not produced equality in all areas, as demonstrated by the continuing wage gap. Gender bias lingers and can be identified in language. This Article focuses on Wills, one of the oldest forms of legal documents, to explore the intersection of gender and language. With conceptual antecedents in pre-history, written Wills found in Ancient Egyptian tombs embody the core characteristics of modern Wills. The past endows the drafting and implementation of Wills with a wealth of traditions and experiences. The …

Simultaneous Modelling Of Initial Conditions And Time Heterogeneity In Dynamic Networks: An Application To Foreign Direct Investments, Johan Koskinen, Alberto Caimo, Alessandro Lomi Jan 2015

Simultaneous Modelling Of Initial Conditions And Time Heterogeneity In Dynamic Networks: An Application To Foreign Direct Investments, Johan Koskinen, Alberto Caimo, Alessandro Lomi

Articles

In dynamic networks, the presence of ties are subject both to endogenous network dependencies and spatial dependencies. Current statistical models for change over time are typically defined relative to some initial condition, thus skirting the issue of where the first network came from. Additionally, while these longitudinal network models may explain the dynamics of change in the network over time, they do not explain the change in those dynamics. We propose an extension to the longitudinal exponential random graph model that allows for simultaneous inference of the changes over time and the initial conditions, as well as relaxing assumptions of …

Spatial Time-Dependent Reliability Analysis Of Reinforced Concrete Slab Bridges Subject To Realistic Traffic Loading, Donya Hajializadeh, Mark Stewart, Bernard Enright, Eugene J. Obrien Jan 2015

Spatial Time-Dependent Reliability Analysis Of Reinforced Concrete Slab Bridges Subject To Realistic Traffic Loading, Donya Hajializadeh, Mark Stewart, Bernard Enright, Eugene J. Obrien

Articles

Resistance and loads are often correlated in time and space. The paper assesses the influence of these correlations on structural reliability/probability of failure for a typical two-lane RC slab bridge under realistic traffic loading. Spatial variables for structural resistance are cover and concrete compressive strength, which in turn affect the strength and chloride-induced corrosion of RC elements. Random variables include pit depth and model error. Correlation of weights between trucks in adjacent lanes and inter-vehicle gaps are also included and are calibrated against Weigh-In-Motion (WIM) data. Reliability analysis of deteriorating bridges needs to incorporate uncertainties associated with parameters governing the …

Articles

Premature deterioration of reinforced concrete structures due to lack of durability and subsequent poor state of their health, has led to a significant part of the construction budget being spent on repair and rehabilitation works. As a direct consequence, asset owners are often forced to take decisions to repair and maintain existing ailing infrastructure, as opposed to investing in new ones.

Cathodic Protection For Reinforced Concrete Structures: Present Practice And Moves Toward Using Renewable Energy, Aimee Byrne, Niall Holmes, Brian Norton Jan 2015

Cathodic Protection For Reinforced Concrete Structures: Present Practice And Moves Toward Using Renewable Energy, Aimee Byrne, Niall Holmes, Brian Norton

Articles

Abstract: Cathodic protection (CP) limits the corrosion of a metal by making it the cathode of an electrochemical cell. This is achieved either by (i) using more active sacrificial anodes to create a driving current, or (ii) using inert anodes and impressing an external direct current (DC). This paper presents up-to-date CP systems available for reinforced concrete, particularly Impressed Current Cathodic Protection (ICCP) and self-sufficient or renewable energy systems. The potential for overcoming the mismatch in energy provision from renewable sources (intermittent current) with energy needs for CP (constant current) is discussed by exploring novel designs and examining current requirments.

Current Advances In The Application Of Raman Spectroscopy For Molecular Diagnosis Of Cervical Cancer, Ines Martins Ramos, Alison Malkin, Fiona Lyng Jan 2015

Current Advances In The Application Of Raman Spectroscopy For Molecular Diagnosis Of Cervical Cancer, Ines Martins Ramos, Alison Malkin, Fiona Lyng

Articles

Raman spectroscopy provides a unique biochemical fingerprint capable of identifying and characterizing the structure of molecules, cells and tissues. In cervical cancer, it is acknowledged as a promising biochemical tool due to its ability to detect pre-malignancy and early malignancy stages. This review summarizes the key research in the area and the evidence compiled is very encouraging for ongoing and further research. In addition to the diagnostic potential, promising results for HPV detection and monitoring treatment response suggest more than just a diagnosis prospective. A greater body of evidence is however necessary before Raman spectroscopy is fully validated for clinical …

Analyses Of Ionizing Radiation Effects In – Vitro In Peripheral Blood 1 Lymphocytes With Raman Spectroscopy, Adrian Maguire, Isabel Vegacarrascal, Lisa White, B. Mcclean, Orla L. Howe, Fiona Lyng, Aidan Meade Jan 2015

Analyses Of Ionizing Radiation Effects In – Vitro In Peripheral Blood 1 Lymphocytes With Raman Spectroscopy, Adrian Maguire, Isabel Vegacarrascal, Lisa White, B. Mcclean, Orla L. Howe, Fiona Lyng, Aidan Meade

Articles

The use of Raman spectroscopy to measure the biochemical profile of healthy and diseased cells and tissues may be a potential solution to many diagnostic problems in the clinic. Although extensively used to identify changes in the biochemical profiles of cancerous cells and tissue, Raman spectroscopy has been used less often for analyzing changes to the cellular environment by external factors such as ionizing radiation. In tandem with this, the biological impact of low doses of ionizing radiation remains poorly understood. Extensive studies have been performed on the radiobiological effects associated with radiation doses above 0.1 Gy, and are well …

Foreign Relations Law And The Purported Shift Away From “Exceptionalism”, Curtis A. Bradley Jan 2015

Foreign Relations Law And The Purported Shift Away From “Exceptionalism”, Curtis A. Bradley

Articles

The field of “ foreign relations law ” encompasses a variety of constitutional, statutory, and common law rules and doctrines that regulate how the United States interacts with the rest of the world.1 In their article on The Normalization of Foreign Relations Law, Professors Ganesh Sitaraman and Ingrid Wuerth contend that there has been a revolution in U.S. foreign relations law during the past twenty-five years.2 In particular, they claim that there has been a shift away from treating foreign relations law issues as “exceptional ” toward treating them as “normal ” — that is, “as if they …

The U.S. executive branch has long declined to recognize any country’s sovereignty over Jerusalem, insisting that the matter be worked out through negotiations between Israel and the Palestinians. The U.S. Congress, by contrast, has tended to support Israeli sovereignty over the city. In 2002, Congress enacted the Foreign Relations Authorization Act for Fiscal Year 2003, Section 214(d) of which provides that, “[f]or purposes of the registration of birth, certification of nationality, or issuance of a passport of a United States citizen born in the city of Jerusalem, the Secretary [of State] shall, upon the request of the citizen or the …

Best Practices For Conducting Evaluations Of Sign Language Animation, Matt Huenerfauth, Hernisa Kacorri Jan 2015

Best Practices For Conducting Evaluations Of Sign Language Animation, Matt Huenerfauth, Hernisa Kacorri

Articles

Automatic synthesis of linguistically accurate and natural-looking American Sign Language (ASL) animations would make it easier to add ASL content to websites and media, thereby increasing information accessibility for many people who are deaf. Based on several years of studies, we identify best practices for conducting experimental evaluations of sign language animations with feedback from deaf and hard-of-hearing users. First, we describe our techniques for identifying and screening participants, and for controlling the experimental environment. Finally, we discuss rigorous methodological research on how experiment design affects study outcomes when evaluating sign language animations. Our discussion focuses on stimuli design, effect …

Materiality And A Theory Of Legal Circularity, Wendy Gerwick Couture Jan 2015

Materiality And A Theory Of Legal Circularity, Wendy Gerwick Couture

Articles

This Article argues that the materiality doctrine, which lies at the heart of securities fraud, has the potential to operate as a self-fulfilling prophecy. This Article labels this phenomenon "legal circularity." In order to place the potential legal circularity of materiality in context among the various other legal doctrines that share this potential, this Article proposes a two part Theory of Legal Circularity. First, this Article proposes the following Legal Circularity Test to identify potentially circular doctrines: A legal doctrine is potentially circular if: (1) the legal doctrine incorporates the behavior or attitude of a population or person, either hypothetical …

Fearing The Bogeyman: How The Legal System's Overreaction To Perceived Danger Threatens Families And Children, David Pimentel Jan 2015

Fearing The Bogeyman: How The Legal System's Overreaction To Perceived Danger Threatens Families And Children, David Pimentel

Articles

In the last generation, American parenting norms have shifted dramatically, reflecting a near obsession with child safety and especially the risk of stranger abduction. A growing body of literature shows, however, that the threats to children are more imagined than real, and that the effort to protect children from these "bogeymen" may be doing more harm than good. Advocates of "Free-Range" parenting argue that giving children a long leash can help them learn responsibility, explore the world outside, get physical exercise, and develop self-sufficiency. But the state, usually acting through Child Protective Services (CPS), is likely to second-guess parents' judgments …

The Constitution, Desegregation, And Public Opinion: Swan V. Charlotte-Mechlenburg Board Of Education, James L. Hunt

Articles

The first three words of the preamble to the Constitution are "We the People." Yet the vast majority of constitutional scholarship is limited to the opinions of judges, lawyers, law professors, and other political and economic elites. This article takes a different approach to constitutional understanding. It describes the legal thoughts of the citizens for whom the Constitution exists. It does so through an analysis of the public's reaction to the federal court decisions in Swann v. Charlotte-Mecklenburg Board of Education, a desegregation case. The lead attorney for the Swann plaintiffs was Julius LeVonne Chambers, an alumnus and future …

The Role Of Non-Governmental Organizations In Advancing International Criminal Justice, Charles C. Jalloh Jan 2015

The Role Of Non-Governmental Organizations In Advancing International Criminal Justice, Charles C. Jalloh

Articles

This article examines the role of non-governmental organizations (NGOs) in advancing international criminal justice. I argue that NGOs have had considerable impact by contributing, among other things, to the global struggle against impunity through advocacy for the creation of more robust institutional mechanisms to prosecute those who perpetrate such crimes. This ranges from supporting the processes that led to the creation of several ad hoc international tribunals for Yugoslavia, Rwanda and Sierra Leone, all the way through to their support for the establishment of an independent permanent international penal court based in The Hague. The crux of my claim is …
