Disclosure, Endorsement, And Identity In Social Marketing, William Mcgeveran Jan 2009

Disclosure, Endorsement, And Identity In Social Marketing, William Mcgeveran

Articles

Social marketing is among the newest advertising trends now emerging on the internet. Using online social networks such as Facebook or MySpace, marketers can send personalized promotional messages featuring an ordinary customer to that customer's friends. Because they reveal a customer's browsing and buying patterns, and because they feature implied endorsements, the messages raise significant concerns about disclosure of personal matters, information quality, and individuals' ability to control the commercial exploitation of their identity. Yet social marketing falls through the cracks between several different legal paradigms that might allow its regulation-spanning from privacy to trademark and unfair competition to consumer …

When The Lawyer Knows The Client Is Guilty: Client Confessions In Legal Ethics, Popular Culture, And Literature, Michael Asimow, Richard H. Weisberg Jan 2009

When The Lawyer Knows The Client Is Guilty: Client Confessions In Legal Ethics, Popular Culture, And Literature, Michael Asimow, Richard H. Weisberg

Articles

The article explores the ethical dilemma faced by criminal defense lawyers when they know their client is factually guilty but the client insists on a vigorous defense. It examines the tension between the lawyer’s duty of zealous representation and the duty of candor toward the court, proposing a compromise that allows lawyers discretion to choose between strong or weak adversarial approaches based on the context. The analysis draws on historical cases, such as the Courvoisier case of 1840 and the modern case of Steven Feldman, as well as insights from popular culture and literary sources, to argue that the discretionary …

Next Door They Have Regulation, But Not Here …: Assessing The Opinions Of Actors In The Opaque World Of Unregulated Lobbying, John Hogan Dec 2008

Next Door They Have Regulation, But Not Here …: Assessing The Opinions Of Actors In The Opaque World Of Unregulated Lobbying, John Hogan

Articles

The lobbying of government by various interests is regarded as central to the democratic process. Deliberative democratic theorists tell us that the regulation of lobbying has a positive effect on political systems, and the behaviour of those within them. Yet, only a small number of democracies have implemented legislation regulating lobbyists’ activities. Even within these countries, certain jurisdictions still have not enacted lobbying regulations. Here we examine the attitudes of actors in these unregulated provinces, states and institutions towards the idea of lobbying legislation. This ensures that in the broader context the actors we deal with have knowledge of lobbying …

The Consequences Of Technostress For End Users In Organizations: Conceptual Development And Empirical Validation, T. Ragu-Nathan, Monideepa Tarafdar, Bhanu Ragu-Nathan Dec 2008

The Consequences Of Technostress For End Users In Organizations: Conceptual Development And Empirical Validation, T. Ragu-Nathan, Monideepa Tarafdar, Bhanu Ragu-Nathan

Articles

The research reported in this paper studies the phenomenon of technostress, that is, stress experienced by end users of Information and Communication Technologies (ICTs), and examines its influence on their job satisfaction, commitment to the organization, and intention to stay. Drawing from the Transaction-Based Model of stress and prior research on the effects of ICTs on end users, we first conceptually build a nomological net for technostress to understand the influence of technostress on three variables relating to end users of ICTs: job satisfaction, and organizational and continuance commitment. Because there are no prior instruments to measure constructs related to …

A 60 Ghz Wireless Network For Enabling Uncompressed Video Communication, Harkirat Singh, Jisung Oh, Changyeul Kweon, Xiangping Qin, Huai-Rong Shao, Chiu Ngo Dec 2008

A 60 Ghz Wireless Network For Enabling Uncompressed Video Communication, Harkirat Singh, Jisung Oh, Changyeul Kweon, Xiangping Qin, Huai-Rong Shao, Chiu Ngo

Articles

Uncompressed high-definition video streaming over wireless personal area networks is a challenging problem because of the high data rate requirement and channel variations. With the advances in RF technology and the huge bandwidth available worldwide in the 57–66 GHz millimeter-wave unlicensed spectrum, mmWave WPANs that can support multigigabit transmission are being developed. However, compared to low-frequency signals (2.4 or 5 GHz), mmWave signals are more fragile; indeed, the propagation losses are significantly higher. In this article we present an mmWave system for supporting uncompressed HD video up to 3 Gb/s. The system includes various efficient error protection and concealment schemes …

Reviewing Digital Scholarship: The Need For Discipline-Based Peer Review, Jeanne Glaubitz Cross Dec 2008

Reviewing Digital Scholarship: The Need For Discipline-Based Peer Review, Jeanne Glaubitz Cross

Articles

Digital scholarship connects scholarly research to students and the public in nontraditional ways. Authors present research in a digital form, which may include links to primary source material and teaching guides. In this format, design and accessibility are important, and unfortunately, those quick to dismiss all digital work as teaching or outreach can overlook the research element. The confusion over what digital scholarship is and how to evaluate it raises questions that can affect promotion and tenure decisions in academic institutions. This paper will examine issues surrounding the availability of peer review for digital scholarship, especially in the field of …

The Politics Of Economic Performance, And The Trade Union Movement, 1970-1982, John Hogan, Gary Murphy Nov 2008

The Politics Of Economic Performance, And The Trade Union Movement, 1970-1982, John Hogan, Gary Murphy

Articles

Here we argue that the relationship between the main Irish political parties and the trade unions, in the 1970s, was largely based upon political imperatives, with an economic subtext. The absence of strong ideological difference between the two largest Irish political parties meant they were willing to deal with the trade union moment in a somewhat similar fashion. At the start of the 1970s, the Fianna Fail government prodded the ICTU into a “voluntary” national wage agreement. This agreement was regarded as a means of stabilising the economy, attracting foreign investment, and improving Fianna Fail’s image with the electorate. While …

Critical Junctures? Privatization Policy In Brazil And Argentina At The Start Of The Century, John Hogan Nov 2008

Critical Junctures? Privatization Policy In Brazil And Argentina At The Start Of The Century, John Hogan

Articles

This paper uses the critical junctures framework developed by Hogan and Doyle (2007) to determine if there were critical junctures in privatization policy in Brazil and Argentina at the start of the 21st century. The framework constitutes a rigorous approach to the identification of crisis, ideational change, and policy change. It is used to examine the economic disasters in Brazil in 1999 and Argentina in 2001. Previously, we would have had to wait decades before making such an assessment, as there were few tools with which to identify critical junctures, and these were usually only effective long after the event.

What's Law Got To Do With It?: The Bosnia V. Serbia Decision's Impact On Reconciliation, Sheri P. Rosenberg Oct 2008

What's Law Got To Do With It?: The Bosnia V. Serbia Decision's Impact On Reconciliation, Sheri P. Rosenberg

Articles

During the twentieth century a particular ideology inspired specific efforts to utilize the power of the law to redress episodes of mass atrocity-in particular genocide. The idea has been that accountability and reparations are necessary for moving beyond a past marred with crimes of genocide and crimes against humanity. Trials are often claimed to aid this process on the grounds that they create an irrefutable historic record, punish the perpetrators for the sake of justice and deterrence, and promote peace and reconciliation. This Article interrogates the stated goals of accountability, in particular the goal of reconciliation, against the impact, within …

Hand-Held Flyback Driven Coaxial Dielectric Barrier Discharge: Development And Characterization, Victor J. Law, Vladimir Milosavljevic, Neil O’Connor, James F. Lalor, Steven Daniels Sep 2008

Hand-Held Flyback Driven Coaxial Dielectric Barrier Discharge: Development And Characterization, Victor J. Law, Vladimir Milosavljevic, Neil O’Connor, James F. Lalor, Steven Daniels

Articles

The development of a handheld single and triple chamber atmospheric pressure coaxial dielectric barrier discharge driven by Flyback circuitry for helium and argon discharges is described. The Flyback uses external metal-oxide-semiconductor field-effect transistor power switching technology and the transformer operates in the continuous current mode to convert a continuous dc power of 10–33 W to generate a 1.2–1.6 kV 3.5 μs pulse. An argon discharge breakdown voltage of ∼768 V is measured. With a 50 kHz, pulse repetition rate and an argon flow rate of 0.5–10 argon slm (slm denotes standard liters per minute), the electrical power density deposited in …

A Web-Based And Mobile Environmental Management System, James Carswell, Keith Gardiner, Michela Bertolotto, Andrea Rizzini, A Mandrak

Articles

This paper describes a Web-based and mobile system specifically developed to monitor fish species at risk. Such a system integrates spatial functionality to allow users not only to visualise maps and metadata of the area of concern but also to perform context-aware queries and updating of spatial datasets. The spatial datasets are provided by the Canadian Department of Fisheries and Oceans (DFO) and the prototype is customised to the specific needs of the Great Lakes Laboratory for Fisheries and Aquatic Sciences (GLLFAS) Fish Habitat Section requirements for fish species at risk assessment. Currently, researchers, habitat biologists and enforcement officers have …

Temperature Dependence Of Macrobending Loss In All-Fiber Bend Loss Edge Filter, Pengfei Wang, Yuliya Semenova, Gerald Farrell Sep 2008

Temperature Dependence Of Macrobending Loss In All-Fiber Bend Loss Edge Filter, Pengfei Wang, Yuliya Semenova, Gerald Farrell

Articles

A theoretical model for macrobending-induced temperature dependent loss (TDL) for a standard singlemode fiber (SMF28) with dual coating layers is presented, with good agreement demonstrated between theoretical calculations and experimental results. The impact of temperature on two examples of an all-fiber based edge filter is also investigated theoretically and experimentally and using the developed model, it is shown that it is possible to predict the impact of temperature variations on an all-fiber based edge filter.

Correlation Of Vibrational Intensity With Fluorescence Lifetimes In Π Conjugated Polymers, Luke O'Neill, Patrick Lynch, Mary Mcnamara, Hugh Byrne Sep 2008

Correlation Of Vibrational Intensity With Fluorescence Lifetimes In Π Conjugated Polymers, Luke O'Neill, Patrick Lynch, Mary Mcnamara, Hugh Byrne

Articles

A series of novel pi (p) conjugated polymers, originating from the archetypical Polyphenylene vinylene, in which the phenyl units are successively replaced by the larger naphthyl and anthryl acene units, were previously found to have a well-defined relationship between their relative fluorescence yields and their vibrational characteristics, as determined by Raman spectroscopy. In this study the Strickler–Berg equation is used to probe the influence of continual substitution of higher order acene units into the conjugated backbone in terms of the variation of the radiative and non-radiative rates. The deconvolution of the radiative and non-radiative rates enables the correlation of the …

Demographics, Trends, And A Call To Action, Toby Golick Sep 2008

Demographics, Trends, And A Call To Action, Toby Golick

Articles

Every discussion of aging in America seems to begin with demographic statistics showing that our population is increasingly old and getting older. But the figures are truly stunning: In 2006 (the latest year for which data are available), 37.3 million persons were 65 years old or older in America; this represents 12.6 percent of the U.S. population-more than one in every eight Americans. By 2030 the number of older people is expected to increase to 71.5 million older persons, over 20 percent of the total population.

The Production Of High-Quality Video For E-Learning, Eugene Mcgovern, Audrey Martin, Roy Moore Jul 2008

The Production Of High-Quality Video For E-Learning, Eugene Mcgovern, Audrey Martin, Roy Moore

Articles

As video capture, editing and transmission capabilities become more accessible, video is increasingly being considered when developing e-learning content. However, the skills required for video production are not commonly part of many e-learning developers backgrounds. This paper presents the experiences of academics from the spatial information sciences when developing high quality video content for an on-line e-learning module in Global Navigation Satellite Systems (GNSS). Video comprises one element of the module and is designed to, as far as possible, address the lack of ‘hands-on’ experience of GNSS equipment and observing procedures. The video element of the module was used by …

Children's Perspectives On Coping And Support Following Parental Separation, Ann Marie Halpenny, Sheila Greene, Diane Hogan Jul 2008

Children's Perspectives On Coping And Support Following Parental Separation, Ann Marie Halpenny, Sheila Greene, Diane Hogan

Articles

Increasingly, children experience ongoing change in family formation and structure and such fluctuation may threaten or diminish children’s feelings of security with regard to established family roles, relationships and routines. A number of studies have explored available support for children in the context of family transition, focusing in particular upon those organisations providing services to children and families. However, in order to gain more precise insight into the mechanisms through which children can best be supported, it is necessary to consult children themselves and to elicit their perspectives and responses to the changes in their family contexts. A primary aim …

A Parallel Gravitational N-Body Kernel, Simon Portegies Zwart, Stephen Mcmillan, Derek Groen, Alessia Gualandris, Michael Sipior, Willem Vermin

Articles

We describe source code level parallelization for the kira direct gravitational Nbody integrator, the workhorse of the starlab production environment for simulating dense stellar systems. The parallelization strategy, called “j-parallelization”, involves the partition of the computational domain by distributing all particles in the system among the available processors. Partial forces on the particles to be advanced are calculated in parallel by their parent processors, and are then summed in a final global operation. Once total forces are obtained, the computing elements proceed to the computation of their particle trajectories. We report the results of timing measurements on four different parallel …

Artlog: Archiving The Artistic Process, Yvonne Desmond, John Mcauley, Evin Mccarthy, Ciaran Mcdonnell, Charles Pritchard, Pat Donlon

Articles

Currently there is little or no formal attempt to document the processes an Irish artist undergoes when producing a piece of art. With Artlog we aim to provide the artistic community at the Tyrone Guthrie Centre, Annaghmakerring, Co. Monaghan with a forum to not only develop their profile as an artist but also to document their work practices. In this paper we describe how Artlog came about, the relationship between the aesthetics and the importance of heritage, the approach of the project team in organising the archive and finally how interdisplinary collaboration has impacted the project.

Haptic feedback in telesurgical applications refers to the relaying of position and force information from a remote surgical site to the surgeon in real-time during a surgical procedure. This feedback, coupled with visual information via microscopic cameras, has the potential to provide the surgeon with additional ‘feel’ for the manipulations being performed at the instrument-biological tissue interface. This increased sensitivity has many associated benefits which include, but are not limited to; minimal tissue damage, reduced recuperation periods, and less patient trauma. The inclusion of haptic feedback leads to reduction in surgeon fatigue which contributes to enhanced performance during operation. Commercially …

Rethinking Tax Nexus And Apportionment: Voice, Exit, And The Dormant Commerce Clause, Edward A. Zelinsky Jul 2008

Rethinking Tax Nexus And Apportionment: Voice, Exit, And The Dormant Commerce Clause, Edward A. Zelinsky

Articles

The dormant Commerce Clause concept of tax nexus is best understood as a rough, but serviceable, proxy for the taxpayer's standing in the political process. This perspective leads me to defend Quill Corporation v. North Dakota and the much maligned physical presence test for tax nexus. As a matter of legislative policy, the critics of this test may be correct. However, as a matter of constitutional law, the courts should adhere to an expanded physical presence standard as Congress crafts for the long term broader nexus rules based on economic presence. Taxation is an inherently and irreducibly political matter. An …
