Regional Integration Of Renewable Energy Systems In Ireland: The Role Of Hybrid Energy Systems For Small Communities, Craig Goodbody, Eileen Walsh, Kevin Mcdonnell, Philip Owende Jan 2013

Regional Integration Of Renewable Energy Systems In Ireland: The Role Of Hybrid Energy Systems For Small Communities, Craig Goodbody, Eileen Walsh, Kevin Mcdonnell, Philip Owende

Articles

Due to a lack of indigenous fossil energy resources, Ireland’s energy supply constantly teeters on the brink of political, geopolitical, and geographical unease. The potential risk to the security of the energy supply combined with the contribution of anthropogenic greenhouse gas emissions to climate change gives a clear indication of Ireland's need to reduce dependency on imported fossil fuels as primary energy source. A feasibility analysis to investigate the available renewable energy options was conducted using HOMER software. The Net Present Cost, the Cost of Energy, and the CO2 emissions of each potential energy combination were considered in determining the …

Decomposition Of Ireland’S Carbon Emissions From 1990-2010: An Extended Kaya Identity, Tadhg O'Mahony Jan 2013

Decomposition Of Ireland’S Carbon Emissions From 1990-2010: An Extended Kaya Identity, Tadhg O'Mahony

Articles

In recent decades, Ireland has been an important example of a development pathway where rapid economic growth was accompanied by rising energy demand and increasing carbon emissions. Understanding the driving forces of carbon emissions is necessary for policy formulation and decomposition analysis is widely used for this purpose. This study uses an extended Kaya identity as the scheme and applies the log mean Divisia index (LMDI I) as the decomposition technique. Change in carbon emissions is decomposed from 1990 – 2010 and includes a measure of the effect of renewable energy penetration. Results illustrate that scale effects of affluence and …

Augmented Resistance: The Possibilities For Ar And Data Driven Art, Conor Mcgarrigle Jan 2013

Augmented Resistance: The Possibilities For Ar And Data Driven Art, Conor Mcgarrigle

Articles

This article discusses the possibilities for Augmented Reality (AR) as a driver of data based art. The combination of AR and Open Data (in the broadest post-Wikileaks sense) is seen to provide a powerful tool-set for the artist/activist to augment specific sites with a critical, context-specific data layer. Such situated interventions offer powerful new methods for the political activation of sites which enhance and strengthen traditional non- virtual approaches and should be thought of as complementary to, rather than replacing, physical intervention.

I offer as a case study this author’s “NAMAland” project, a mobile artwork which uses Open Data and …

Simulation-Based Framework To Improve Patient Experience In An Emergency Department, Waleed Abo-Hamad, Amr Arisha Jan 2013

Simulation-Based Framework To Improve Patient Experience In An Emergency Department, Waleed Abo-Hamad, Amr Arisha

Articles

The global economic crisis has a significant impact on healthcare resource provision worldwide. The management of limited healthcare resources is further challenged by the high level of uncertainty in demand, which can lead to unbalanced utilisation of the available resources and a potential deterioration of patient satisfaction in terms of longer waiting times and perceived reduced quality of services. Therefore, healthcare managers require timely and accurate tools to optimise resource utility in a complex and ever-changing patient care process. An interactive simulation-based decision support framework is presented in this paper for healthcare process improvement. Complexity and different levels of variability …

Individual Responsibility For Mass Atrocity: In Search Of A Concept Of Perpetration, Neha Jain Jan 2013

Individual Responsibility For Mass Atrocity: In Search Of A Concept Of Perpetration, Neha Jain

Articles

International criminal law lacks a coherent account of individual responsibility. This failure is due to the inability of international tribunals to capture the distinctive nature of individual responsibility for crimes that are collective by their very nature. Specifically, they have misunderstood the nature of the collective action or framework that makes these crimes possible, and for which liability can be attributed to intellectual authors and leaders. In this paper, I draw on the insights of comparative law and methodology to propose a new doctrine of perpetration that reflects the role and function of high level participants in mass atrocity while …

Behind Closed Doors: What Really Happens When Cops Question Kids, Barry C. Feld Jan 2013

Behind Closed Doors: What Really Happens When Cops Question Kids, Barry C. Feld

Articles

Police interrogation raises difficult legal, normative, and policy questions because of the State's need to solve crimes and obligation to protect citizens' rights. These issues become even more problematic when police question juveniles. For more than a century, justice policies have reflected two competing visions of youth: vulnerable and immature versus responsible and adult-like. A century ago, Progressive reformers emphasized youths' immaturity and created a separate juvenile court to shield children from criminal trials and punishment. 2 By the end of the twentieth century, lawmakers adopted "get tough" policies, which equated adolescents with adults and punished youths more severely. 3 …

The Youth Discount: Old Enough To Do The Crime, Too Young To Do The Time, Barry C. Feld Jan 2013

The Youth Discount: Old Enough To Do The Crime, Too Young To Do The Time, Barry C. Feld

Articles

In a trilogy of cases, the Supreme Court applied the Eighth Amendment to the entire category of juvenile offenders, repudiated its “death is different” jurisprudence, and required states to consider youthfulness as a mitigating factor in sentencing. Roper v. Simmons prohibited states from executing offenders for murder they committed when younger than eighteen years of age.1 Roper reasoned that immature judgment, susceptibility to negative influences, and transitory personalities reduced youths’ culpability and barred the most severe sentence.2 Graham v. Florida extended Roper’s diminished responsibility rationale and prohibited states from imposing life without parole (LWOP) sentences on youths convicted of nonhomicide …

Dynamic Energy Federalism, Hari M. Osofsky, Hannah J. Wiseman Jan 2013

Dynamic Energy Federalism, Hari M. Osofsky, Hannah J. Wiseman

Articles

U.S. energy law and the scholarship analyzing it are deeply fragmented. Each source of energy has a distinct legal regime, and limited federal regulation in some areas has resulted in divergent state and local approaches to regulation. Much of the existing energy law literature reflects these substantive and structural divisions, and focuses on particular aspects of the energy system and associated federalism disputes. However, in order to meet modern energy challenges — such as reducing risks from deepwater drilling and hydraulic fracturing, maintaining the reliability of the electricity grid in this period of rapid technological change, and producing cleaner energy …

Cyber-Conflict, Cyber-Crime, And Cyber-Espionage, David Weissbrodt Jan 2013

Cyber-Conflict, Cyber-Crime, And Cyber-Espionage, David Weissbrodt

Articles

Computers and the Internet have changed and are continuing to change the way governments, militaries, businesses, and other organs of society manage their activities. While computers can improve efficiency, they are vulnerable to cyber-attack, cyber-crime, and cyber-espionage. 1 The international community, states, and businesses are still adapting to the unique set of challenges posed by cyber-attack, cyber-crime, and cyber-espionage. States are creating military operations that specialize in cyber-attack and defense to adapt to these relatively new threats to national security operations. 2

Next Generation Civil Rights Lawyers: Race And Representation In The Age Of Identity Performance, Anthony V. Alfieri, Angela Onwuachi-Willig

Articles

This Book Review addresses two important new books, Professor Kenneth Mack's Representing the Race: The Creation of the Civil Rights Lawyer and Professors Devon Carbado and Mitu Gulati's Acting White? Rethinking Race in Post-Racial America, and utilizes their insights to both explore the challenges that face the next generation of civil rights lawyers and offer suggestions on how this next generation of civil rights lawyers can overcome these difficulties. Overall, this Book Review highlights one similarity in the roles of black civil rights attorneys past and present: the need for lawyers in both generations to perform their identities in …

Does The Individual Mandate Coerce?, Raphael Boleslavsky, Sergio J. Campos Jan 2013

Does The Individual Mandate Coerce?, Raphael Boleslavsky, Sergio J. Campos

Articles

The Patient Protection and Affordable Care Act includes an individual mandate that penalizes individuals who do not purchase health insurance. Critics of the individual mandate, including a majority of justices on the Supreme Court, contend that Congress cannot use its Commerce Clause power to coerce individuals to buy a product. Supporters concede that the mandate coerces but argue that it is otherwise permissible under the Commerce Clause. This article questions whether the individual mandate coerces. It uses a simple economic model to show that, under certain conditions, the individual mandate induces insurers to sell health insurance at a price each …

The Contraception Mandate, Caroline Mala Corbin Jan 2013

The Contraception Mandate, Caroline Mala Corbin

Articles

Under the new health care regime, health insurance plans must cover contraception. While religious employers are exempt from this requirement, religiously affiliated employers are not. Several have sued, claiming that the "contraception mandate" violates the Free Exercise Clause, the Free Speech Clause, and the Religious Freedom Restoration Act. This Essay explains why the contraception mandate violates none of them.

Protecting Elites: An Alternative Take On How United States V. Jones Fits Into The Court's Technology Jurisprudence, Tamara Rice Lave Jan 2013

Protecting Elites: An Alternative Take On How United States V. Jones Fits Into The Court's Technology Jurisprudence, Tamara Rice Lave

Articles

This Article argues that the Supreme Court's technology jurisprudence can be best understood as protecting the privacy interest of elites. After providing an overview of the major technology cases from Olmstead to Kyllo, the Article focuses on the recent case of United States v Jones. The Article does not contend that the Court intended to protect elites, but instead posits that this motive likely operated at a more unconscious level because of the Justices' greater relative affluence and elevated social position.

Copyright In Teams, Anthony J. Casey, Andres Sawicki Jan 2013

Copyright In Teams, Anthony J. Casey, Andres Sawicki

Articles

Dozens of people worked together to produce Casablanca. But a single person working alone wrote The Sound and the Fury. While almost all films are produced by large collaborations, no great novel ever resulted from the work of a team. Why does the frequency and success of collaborative creative production vary across art forms?

The answer lies in significant part at the intersection of intellectual property law and the theory of the firm. Existing analyses in this area often focus on patent law and look almost exclusively to a property-rights theory of the firm. The implications of organizational …

Provisional Arrest And Incarceration In The International Criminal Tribunals, Melinda Taylor, Charles C. Jalloh

Articles

This article examines the widely ignored but important issue regarding the provisional arrest and detention of persons suspected of having committed international crimes by international or internationalized courts. The paper examines the pioneer case law and practice of the United Nations International Criminal Tribunals for the former Yugoslavia and Rwanda, the Extraordinary Chambers in the Courts of Cambodia, and the Special Tribunal for Lebanon, as well as the emerging practice of the permanent International Criminal Court, to evaluate how these courts have generally addressed the rights of these individuals to due process and freedom from arbitrary arrest and detention before …

Boilerplate, Freedom Of Contract, And "Democratic Degradation", Brian H. Bix Jan 2013

Boilerplate, Freedom Of Contract, And "Democratic Degradation", Brian H. Bix

Articles

In Margaret Jane Radin's provocative new book, Boilerplate: The Fine Print, Vanishing Rights, and the Rule of Law, 1 the author offers scathing observations regarding the motivation and effects of the terms placed in consumer and employee form contracts and on-line agreements. She argues that the current contracting practices make a mockery of consent, and undermine the rule of law. 2 Boilerplate's essential claim is that for many contracting parties, freedom of contract is less an ideal than a sham. 3 The book properly criticizes theories of contract law (and courses in contract law) that largely ignore boilerplate and its …

Supporting Professionalism In Educational Development In Irish Higher Education, Muireann Okeeffe Dec 2012

Supporting Professionalism In Educational Development In Irish Higher Education, Muireann Okeeffe

Articles

Higher education, in Ireland and globally, is undergoing profound change influenced by a variety of factors. In conjunction with these changes many initiatives to improve teaching and learning and the quality of graduates in higher education have been introduced in recent years. The changes and expansions in the sector has enabled growth of new roles in higher education described as ‘third space’ professionals by Whitchurch (2008).

This paper describes the struggle of those in third space professions, such as academic development, to establish a professional identity in higher education. The benefits of these contemporary roles to higher education are …

Predicting Stock Market Using Online Communities Raw Web Traffic Streams, Pierpaolo Dondio Dec 2012

Predicting Stock Market Using Online Communities Raw Web Traffic Streams, Pierpaolo Dondio

Articles

This paper investigates the predictive power of online communities traffic in regard to stock prices. Using the largest dataset to date, spanning 8 years and almost the complete set of SP500 stocks, we analyze the predictive power of raw unstructured traffic by filtering stock daily returns with traffic features. Our results partially challenge the assumption that raw traffic simply trails stock prices, as expected from a noisy signal without the sentiment direction. Raw traffic is shown to predict prices with statistical significance but with small economic impact. Anyway, this impact rises to moderate under the following conditions: 3 to 7 …

Required Features Of A Virtual Classroom Tool For Use In Higher Education, Arnold Hensman Dec 2012

Required Features Of A Virtual Classroom Tool For Use In Higher Education, Arnold Hensman

Articles

The integration of virtual-classroom systems into the arsenal of e-learning tools represents a major evolution in the landscape of modern distance education. For many courses, standard virtual learning environments (VLEs) provide only a foundation upon which to base a distance learning programme. However, synchronous live online-teaching software such as Microsoft Office Communicator and Adobe Connect allow educators to simulate a real-time classroom environment over the internet like never before. Since these tools are being used more and more within higher education, questions must be asked about how effective they ultimately can be in meeting student learning requirements. More importantly, what …

Custom, General Principles And The Great Architect Cassese, Mary Fan Dec 2012

Custom, General Principles And The Great Architect Cassese, Mary Fan

Articles

Major advances in international criminal law and procedure rose on the trusses of judicially elucidated sources of international law—custom and general principles. These sources depend on the crucial art of derivation advanced by the architect of modern international criminal justice, President Antonio Cassese. What has transformed international criminal justice into flourishing law able to address changing configurations of violence is the development of the art of finding law in the dark and wilds of murky unwritten norms. [para] President Cassese pioneered paths through a perilous bog. "[T]he law lives in persons," and to understand the law one must study the …

Articles

Age-related hearing impairment (ARHI), or presbycusis, is a common condition of the elderly that results in significant communication difficulties in daily life. Clinically, it has been defined as a progressive loss of sensitivity to sound, starting at the high frequencies, inability to understand speech, lengthening of the minimum discernable temporal gap in sounds, and a decrease in the ability to filter out background noise. The causes of presbycusis are likely a combination of environmental and genetic factors. Previous research into the genetics of presbycusis has focused solely on hearing as measured by pure-tone thresholds. A few loci have been identified, …

Exchanging Information Without Intellectual Property, Michael J. Burstein Dec 2012

Exchanging Information Without Intellectual Property, Michael J. Burstein

Articles

Contracting over information is notoriously difficult. Nearly fifty years ago, Kenneth Arrow articulated a “fundamental paradox” that arises when two parties try to exchange information. To complete such a transaction, the buyer of information must be able to place a value on the information. But once the seller discloses the information, the buyer can take it without paying. The conventional solution to this disclosure paradox is intellectual property. If the information is protected by a patent or a copyright then the seller can disclose the information free in the knowledge that the buyer can be enjoined against making, using, or …
