From Clause A To Clause Z: The Transactional Reader And Narrative Transportation, Karen J. Sneddon Jan 2019

From Clause A To Clause Z: The Transactional Reader And Narrative Transportation, Karen J. Sneddon

Articles

You know the phrase “lost in a good book.” The book’s story is so compelling that you are absorbed by the characters, setting, actions, and plot. The book pulls you into the narrative such that you must continue to read—even if that means staying up all night to finish the book. Because many associate that immersive experience with reading a novel, the phrase “lost in a good book” is most often connected to reading for pleasure. But the experience of being transported by the words of a narrative can occur when reading a variety of texts, including legal texts. That …

Insight From Insiders: A Phenomenological Study For Exploring Food Tourism Policy In Ireland 2009-2019, Ketty Quigley, Margaret Connolly, Elaine Mahon, Máirtín Mac Con Iomaire

Articles

This paper focuses on how the phenomenon of food tourism developed in Ireland between 2009 and 2019. Employing a phenomenological epistemology, a qualitative methodology was adopted to explore key stakeholder’s lived experience of the Irish government’s approach to food tourism, identifying the primary drivers and key moments during the ten-year period. Extant literature was reviewed and critically evaluated. Using purposive sampling, and employing an emic posture, ten semi-structured interviews were conducted with senior governmental and tourism industry figures until saturation occurred. The findings highlight the influence that key policy makers, the formation of networks, clusters, and the role social entrepreneurs …

Biosensor For The Oxidative Stress Biomarker Glutathione Based On Sam Of Cobalt Phthalocyanine On A Thioctic Acid Modified Gold Electrode, Mohammed Nooredeen Abbas, Ayman Ali Saeed, Mounir Ben Ali, Abdelhamid Errachid, Nadia Zine, Abdullatif Baraket, Baljit Singh

Articles

Self-assembled monolayer (SAM) of cobalt teraaminophthalocyanine (CoTAPc) was developed on thioctic acid (TA) dithiol modified gold electrode and electrochemically evaluated as a glutathione (GSH) selective biosensor. The CoTAPc-TA-Au modified electrode was developed by the covalent immobilization of the CoTAPc as the electrochemical mediator onto previously prepared gold electrode modified with TA (TA-Au) via amid bond formation with the carboxylic group of TA, producing well-organized SAM of the mediator. For comparison, another electrode modified with 3-mercaptopropionic acid (MPA) as a monothiol linker instead of TA was similarly prepared. The electrode surface modification was characterized using SEM, AFM, CV, and EIS. The …

Neutrality In Irish Mediation, One Concept, Different Meanings, Aonghus Cheevers Jan 2019

Neutrality In Irish Mediation, One Concept, Different Meanings, Aonghus Cheevers

Articles

The Mediation Act 2017 places mediation at the heart of the civil justice system in Ireland and protects some of the key principles of mediation. This article discusses neutrality, one of these principles. The article shows how neutrality is discussed by two sets of mediation stakeholders (clients and mediators). Using two data sets, the article demonstrates that both groups recognize the influence of neutrality on the mediation process. At the same time, the article shows that the manner in which both groups discuss neutrality is different.

Fifty Years Of The Strategic Trade-Offs Model: In Memory And Honor Of Wickham Skinner, Roberto Sarmiento, Garvan Whelan, Matthias Thürer, Francisco Arturo Bribiescas-Silva

Articles

In 1969, Professor Wickham Skinner, whom many consider as “the father of manufacturing strategy,” published a seminal paper entitled “Manufacturing-Missing Link in Corporate Strategy.” Among the many interesting insights outlined in that article, Skinner is particularly careful to explain the importance of acknowledging the existence of specific trade-offs in the design of production systems. For example, he warns that a failure on the part of executives to recognize the limitations and compromises that are inherent to all technology and human based systems will inevitably result in a diminished ability of firms to compete successfully in the marketplace. Fifty years after …

Principles For State Prosecution Of Securities Crime In A Dual-Regulatory, Multi-Enforcer Regime, Wendy Gerwick Couture Jan 2019

Principles For State Prosecution Of Securities Crime In A Dual-Regulatory, Multi-Enforcer Regime, Wendy Gerwick Couture

Articles

This article proposes principles for the exercise of prosecutorial discretion when prosecuting securities crime under state law. Securities transactions in the United States are subject to a dual-regulatory, multi-enforcer regime. Securities are dually regulated by the federal government and the states, with each regulatory scheme including both civil and criminal enforcement provisions. Those laws are multi-enforced at each level by a regulator, private parties, and prosecutors. And yet, the role of state prosecution of securities crime within this regime is undertheorized, and there is little guidance for state prosecutors about how their prosecutorial decisions affect this regime. This article, drawing …

Trans Formations In The Vatican’S War On "Gender Ideology", Mary Anne Case Jan 2019

Trans Formations In The Vatican’S War On "Gender Ideology", Mary Anne Case

Articles

This article will trace the Vatican's decades-long, worldwide, multifront war on what it has come to call "gender ideology" from its very recent incarnation in Donald Trump's United States back through its origins in the last century, highlighting the central role that concerns about transgender rights have always played for the two popes who have most directly shaped the contours of this war, Benedict XVI and Francis. Among the claims of the paper is that the conceptual apparatus behind the Vatican's anathematization of the complex of feminist, reproductive, and LGBT rights issues it has for a quarter century lumped together …

Justifying Delay: Why Agencies Delay Compliance Dates And How They Do It, Nicholas Bednar Jan 2019

Justifying Delay: Why Agencies Delay Compliance Dates And How They Do It, Nicholas Bednar

Articles

Every administration since President Reagan has used compliance delays to postpone the implementation of midnight rules promulgated by the outgoing administration. Recent cases involving the Trump Administration’s delay of Obama Administration rules have reinvigorated courts’ interests in whether such delays require notice and an opportunity for comment under the Administrative Procedure Act (“APA”). Some scholars have written about why incoming administrations use compliance delays to prevent implementation of the previous administration’s “midnight rules.” These delays are often cast as a precursor to repeal, engendering fears that the now-postponed final rule will be reversed. Yet a more overarching discussion of compliance …

Cost-Effective, Time-Efficient Passenger Rail System For The Eastern United States, James A. Mathias, Dal Hyung Kim Jan 2019

Cost-Effective, Time-Efficient Passenger Rail System For The Eastern United States, James A. Mathias, Dal Hyung Kim

Articles

A program was developed using a genetic algorithm and automated lookup features to design an efficient passenger rail system for the eastern-half of the United States connecting large cities, metropolitan populations greater than two million, with overnight rail service. The results of the program predicted a passenger starting at the farthest point of the system boards the train at 16:02 on average and arrives at a different point of the system at 07:57 on average the following day, assuming the train travels an average speed of 70 mph. The design used actual distances by train track where possible. The system …
