It is a fundamental principle of U.S. trademark law that to serve as a trademark, a word or phrase must "indicate the source" of the goods or services with which it is associated and, conversely, that a term that is understood to be the common name of a good or service is "generic" and cannot be protected as a trademark. Yet it still seems difficult to determine exactly what each concept means, particularly when the actual "source" of any goods or services might be opaque to consumers.

In March 2020, the COVID-19 pandemic made a swift and devastating impact in New York State. Virtually all of life's routines-working, socializing, commuting-were affected, subject to mask mandates, strictly reduced occupational capacities, and widespread working from home for those fortunate to do so. The state court system was no exception to the pandemic's reach. Constitutional guarantees and the preservation of essential legal rights necessitated that the courts always remain available to court users, but the protection of public health mandated that court processes that were traditionally conducted in-person could only remain operational by adapting those processes to new virtual formats.

When I began helping the New York State Unified Court System design a pilot online dispute resolution ("ODR") system back in October 2016, I never imagined more than four years would pass before a system was implemented. One reason our journey was so long is because our target kept moving. After completing a detailed credit card debt collection ODR platform, we had to change direction before implementation and focus instead on small claims cases. The Rise Of Decentralized Autonomous Organizations: Opportunities And Challenges, Aaron J. Wright

The article explores the rise of Decentralized Autonomous Organizations (DAOs), highlighting their potential to transform traditional organizational structures through blockchain technology and smart contracts. DAOs offer operational efficiencies, such as decentralized governance and transparent decision-making, but face significant legal challenges, including lack of recognition, liability concerns, and regulatory uncertainties. The article argues that U.S. business law, with its emphasis on private ordering, could accommodate DAOs, but legal adaptations are necessary to address their unique characteristics and ensure widespread adoption.

Most people would agree with Frederick Wilmot-Smith that the rich have no greater claim to justice than the poor. And yet, as Wilmot-Smith points out in his provocative book, Equal Justice: Fair Legal Systems in an Unfair World, our laissez-faire legal-services markets ensure sharply unequal justice for rich and poor. The prescription at the heart of Equal Justice is the deprivatization of markets for legal services. To realize the ideal of equal justice, Wilmot-Smith would equalize the legal talent available to all and replace the market system with a centralized regime loosely analogous to socialized medicine.

In 2002, developer Jerry Wolkoff invited aerosol artists to transform a series of dilapidated warehouse buildings that he owned in Long Island City, New York. Among those was distinguished aerosol artist Jonathan Cohen, enlisted as the curator to turn the warehouse into an exhibition space for artists and fill the walls with aerosol art. The site became known as “5Pointz,” to represent the confluence of the five NYC boroughs and attracted global attention for aerosol art, drawing thousands of daily visitors and significant media coverage.
