With Access And Justice For All, Sagit Mor
Cardozo Law Review
The article explores the intersection of the "right to access" and "access to justice," particularly for persons with disabilities, emphasizing how these concepts interact across various legal and social dimensions. It argues that the Convention on the Rights of Persons with Disabilities (CRPD) provides a comprehensive framework for addressing these issues, focusing on legal capacity, physical accessibility, and effective participation in legal proceedings. The analysis highlights the need to move beyond formal barriers to justice and address deeper structural and ideological challenges, including biased legal norms and the exclusion of disabled individuals from lawmaking processes. Life After Daca: Immigration Reform In The Age Of Trump, Hasan Shafiqullah, Martin Batalla, Michael Wildes, Anthony Enriquez, Javeria Ahmed

The symposium examines the revocation of the Deferred Action for Childhood Arrivals (DACA) program by the Trump administration, its legal challenges, and the ongoing debate over immigration reform. It highlights the impact on approximately 900,000 DACA recipients and the lawsuits arguing the revocation was arbitrary, capricious, and motivated by racial discrimination. The analysis emphasizes the need for comprehensive immigration reform, advocating for a "clean" Dream Act to provide a pathway to citizenship without compromising the rights of other immigrants or increasing enforcement measures. Alternatives To Immigration Detention, Fatma E. Marouf
Cardozo Law Review
The United States places over 440,000 people each year in immigration detention, far more than any other country in the world. This Article argues that there are compelling humanitarian and financial reasons to utilize more alternatives to detention. It examines the strengths and limitations of existing alternatives, including the need to develop more community-based case management programs and to rely less on electronic monitoring. The Article then sets forth several legal arguments under the Constitution, Rehabilitation Act, and international human rights law for requiring greater consideration of alternatives to detention.

In Part II, I provide a brief overview of ODR systems, describing the largest, most well-known, and most sophisticated platforms now in place, to give the reader a sense of the- richness, variety, and benefits of online disputing, and a hint of developments still to come. In Part III, I describe certain legal, political, and moral concerns that have yet to be addressed in the ODR literature, and identify some of the unintended consequences the widespread adoption of ODR systems might produce. This Note evaluates the future of arbitration in China and Hong Kong as the two approach their twentieth year working toward reunification under the implications of the "one country, two systems" model, which was implemented in Hong Kong when Hong Kong's sovereignty was transferred back to China in 1997. First, this Note explains Hong Kong's unique identity, the factors that triggered the Umbrella Movement and the Fishball Revolution, and Hong Kong's current relationship with China. Where Sovereign Immunity Ends And Liability Begins: A Functional Restructuring Of The United States Military Tort Compensation Scheme, Jordon Parker

The note critiques the current system of tort claims against the United States, particularly in cases involving the military, arguing that it is overly complex and fails to provide adequate compensation for injured individuals. It proposes replacing the existing tort system with a no-fault compensation scheme, similar to New Zealand’s Accident Compensation Act 2001, to better address the needs of victims.

The Second Circuit is renowned for its landmark rulings in fields such as white collar crime and securities law — bread and butter issues growing out of Wall Street’s preeminence in the financial landscape of the nation. At the same time, the Second Circuit has a long tradition of breaking new ground on issues of social justice. Human Capital Discrimination, Law Firm Inequality, And The Limits Of Title Vii, Kevin Woodson

This Article advances the legal scholarship on workplace inequality through use of evidence derived from interviews of a sample of black attorneys who have worked in large, predominantly white law firms. It does so by calling attention to the manner in which these firms operate as sites of human capital discrimination-patterns of mistreatment that deprive many black associates of access to the substantive work opportunities crucial to their professional development and career advancement. On Thursday, September 8th, 2016 Ohio police officers posted photographs of a couple and their son on Facebook. The pictures display a woman and man, unconscious in the front seats of their vehicle, and a four-year-old child awake in the back seat. The city police took these pictures after conducting a traffic stop on September 7th; they had noticed the couple’s car weaving between traffic lanes, and upon stopping the car, noticed “the man’s head ‘bobbing back and forth his speech was almost unintelligible.’” James Acord, the driver of the vehicle, informed officers that he was taking the passed out …
