Schoolhouse Rock! Rules: Orthodoxies And Unorthodoxies In Congressional Procedure, John Cannan Dec 2022

Schoolhouse Rock! Rules: Orthodoxies And Unorthodoxies In Congressional Procedure, John Cannan

Faculty Publications

Is the Schoolhouse Rock! cartoon version of the conventional legislative process really dead? According to some legal academics, traditional Congressional procedures, documented in the cartoon I’m Just a Bill, have been replaced by unorthodox lawmaking—frequent and significant procedural legislative deviations. In actuality, the iconic cartoon and the traditional process are not ready for the grave just yet.

This paper documents the many nuances in orthodox and unorthodox lawmaking by reviewing over 1,500 laws passed between the 111th to116th Congresses and the information sources produced for each to evaluate how pervasive unorthodox law-making really is. The results show the true balance …

Manipulating Facebook's Notification System To Provide Evidence Of Techno-Social Engineering, Brett Frischmann, Katherine Haenschen, Paul Ellenbogen Dec 2022

Manipulating Facebook's Notification System To Provide Evidence Of Techno-Social Engineering, Brett Frischmann, Katherine Haenschen, Paul Ellenbogen

Faculty Publications

Techno-social engineering (TSE) theory argues that digital platforms shape and program human behaviors. We provide empirical evidence of this theory by introducing a novel method to conduct in-network studies on Facebook. We manipulate Facebook’s birthday notification system by recruiting confederates to change their birthday to a randomly assigned date and then measure network members’ responses in terms of whether they leave a greeting or question the veracity of the date. TSE theory leads us to expect that more participants will wish happy birthday on the fake date than question its veracity. We explore variables expected to predict heterogeneity in terms …

Sex And Coercion: Comments On Green's Criminalizing Sex, Michelle Madden Dempsey Dec 2022

Sex And Coercion: Comments On Green's Criminalizing Sex, Michelle Madden Dempsey

Faculty Publications

In chapter seven of Stuart Green’s magnificent book, Criminalizing Sex, he considers the crime of rape by coercion. In doing so, he takes up several related questions, including how we should distinguish between coercive threats and so-called coercive offers, and how to distinguish between coercive and non-coercive offers. My comments proceed in five steps. In section one, I argue that we should not bother making any distinction between threats and offers, since the two are intertranslatable. In section two, I examine various baselines that might be used to identify coercive proposals (regardless of whether they appear in the form of …
