Experiments In Agency Justice: Informal Adjudicatory Procedures In Administrative Procedure Acts, Karen E. Boxx
Washington Law Review
The 1961 Revised Model State Administrative Procedure Act and most state administrative procedure acts ("APAs") provide for only one type of agency adjudication: a formal, trial-type hearing. The 1981 Model Act and five state APAs have departed from this approach by providing additional, more informal adjudicatory procedures. This Comment examines the developments since 1961 that prompted the drafters of these acts to include informal procedures. The major impetus for the change was the "due process explosion," which extended hearing rights to interests that had been considered too minor for formal hearings. Ethical Conduct In A Judicial Campaign: Is Campaigning An Ethical Activity?, J. Scott Gary

The purpose of this comment is twofold. First, through a comprehensive survey of the codes that comprise the sources of legal ethics, the comment elucidates a body of ethical law governing the conduct of candidates in a judicial campaign. Second, after identifying the basic principle found to underlie these ethical codes, this comment argues that the scope of permissible judicial campaigning should be strictly confined.

Legal Malpractice—Expansion Of The Standard Of Care: Duty To Refer—Horne V. Peckham, 97 Cal. App. 3d 404, 158 Cal. Rptr. 714 (1979), Karen J. Feyerherm

This note analyzes the Home court's reasoning in expanding the standard of care in legal malpractice actions to include a duty to refer and in holding attorneys to the same standard of care as physicians. This note also evaluates the considerations relevant to distinguishing "specialist" cases from "generalist" cases and the need for expert testimony in determining liability for failure to refer.

This addition to the title of the book gives appropriate, if not exact, warning that a reader is about to fall under the influence of a spell-binding author, whose sense of theatre equals that of the lawyers whose exploits he exposes. It does not, however, prepare one for his serious analysis, arguments, and proposals concerning how law should distribute the losses of accidental injuries which occur in our society.

Benign Solicitation Of Clients By Attorneys, Joe Wishcamper

The purpose of this comment is to discuss the social benefits offered by benign commercial solicitation, examine the weaknesses in the current ABA rules and court doctrine, and suggest arguments that could be presented to persuade a court to abandon the traditional doctrine and provide protection for such solicitation. An alternative approach is presented which suggests dealing with solicitation cases by applying a "circumstances" oriented test. The suggested test would avoid some of the infirmities of the present doctrine and would be more useful in predicting outcomes of such cases.
