Civil asset forfeiture allows the government to seize and forfeit property that is associated with criminal activity without arresting or charging the property owner. Although expansive in its potential application, little is understood about the characteristics of civil asset forfeiture cases, the property owners involved in forfeiture cases, or the characteristics of any criminal cases pursued parallel to the civil cases. Utilizing open-source, public court records, this dissertation provides an exploratory analysis of these gaps in the literature by examining the types of civil asset forfeiture used, the value of asset forfeiture cases, how money from asset forfeiture is divided …

Popular Justice Or Populist Justice? Penal Populism And Its Impact On Democracy, Kuan-Wu Chen

Populism, a pervasive phenomenon in contemporary politics, manifests as an anti-establishment, anti-pluralistic, morally charged framing that advocates for direct rule between leader and populace. Among its variants, penal populism emerges as a particularly concerning manifestation. It is characterized by a leader's deployment of panicking, punitive, and politically targeted rhetoric to enhance social control and accrue political capital rather than address crime prevention. This research argues that penal populism poses the most significant threat to democratic rule, as evidenced by theoretical, framing, and mobilization analyses. A novel categorization of populist variants is proposed based on dimensions of social categorization and exclusivity. …

The federal criminal courts are unique compared to the rest of the justice system. Cases in these courts pit a government backed prosecutor with an informational and first-moving advantage, against an often-disadvantaged defendant in an adversarial system that ultimately determines who wins and who loses. This asymmetry in criminal cases at the federal district courts presents a situation in which we can understand how courtroom actors matter for the justice process, and specifically if and how attorneys’ strategies differ and ultimately influence outcomes for their clients. In this action research study, the researcher sought to explore the influence of Professional Learning Community (PLC) participation on the recognition and awareness of general education teachers on neurodiversity in their classrooms. Additionally, the study aimed to investigate the effects of the teachers’ awareness on their instructional approaches. The participants of this study hail from a variety of cultures and languages from around the world. Conducted over a six-week period in an international school in southern Germany, the participants demonstrated an enhanced understandings of neurodiversity through their engagement in the PLC sessions. Knowing why people stop offending over time and the criminal justice agencies' role in this process is essential for designing effective crime control interventions. Legal authorities have the core function of ensuring that social norms and laws are obeyed. However, the coercive and punitive tactics that police, judicial, and penal authorities typically resort to have been shown to have only limited impact on controlling and preventing crime while having the unintended consequence of worsening the public's perception of their institutional legitimacy. This action research study sought to examine ways to narrow the racial discipline gap in South Carolina’s elementary schools. Employing both the Critical Race Theory and BlackCrit in schools as the theoretical frameworks, the research delved into the narratives of teachers in grades 3rd through 5th, exploring their encounters with school-based disciplinary practices. The study integrated Social-Emotional Learning and Culturally Responsive Teaching to ultimately uncover implicit biases held by teachers that positioned Black students as less innocent compared to their White counterparts. Beginning in the early 2000s, lawmakers sought to mitigate harm and reduce mortality rates by enacting various policies and increasing community outreach, such as educating society about the dangers of opioids. These efforts can be divided into two broad categories: Drug use prevention and harm reduction. Research has been conducted on both of these strategies, utilizing retrospective analysis on outcomes including crime and mortality, among others. It is of great interest to understand which policies are most effective. NALs are an example of harm reduction because they reverse overdoses should they occur. Preemptive naloxone distribution reduces the likelihood of fatal …

Neonatal transport is a unique aspect of preterm birth. This descriptive, exploratory dissertation study used a multiple-case study design, and mixed methods approach to describe the trajectory of Black preterm outborn infants and their mothers from birth, through transport to a referral center through NICU hospitalization until discharge, for a detailed analysis of each case. Almost every other day there is a news story about a college athletes’ involvement in an alleged crime. Indeed, one Sports Illustrated investigation found that, over an eight-month period in 2010, the number of crimes committed by college athletes averaged one every other day (Benedict, 2010). The current study is a secondary data analysis of a sample of 371 media articles documenting the arrests of college athletes between 2010 and 2015. The current study explores differences in the mean number of crimes committed by college athletes’ according to their classification, the number of perpetrators, and the perpetrators’ race across seven …

The Great Reforms of Alexander II are regarded as transformative policies in the history of Tsarist Russia, drastically changing the empire’s social and political fabric. The judicial reforms of 1864 in particular addressed longstanding issues within the existing criminal justice system, yet they also liberalized the institution at large. Following in the West’s footsteps, the reforms introduced an unprecedented level of democracy into Russia’s courtroom. Among the critics of these changes were renowned authors Fyodor Dostoevsky and Leo Tolstoy, both of whom used the realm of fiction to explore their respective concerns with reformed Russian jurisprudence. This thesis examines racial disparities in opioid-related outcomes within South Carolina, highlighting the disproportionate impact of the opioid epidemic on minority communities. Using a comprehensive literature review methodology, the study analyzes the intersection of race, socioeconomic status, and systemic factors that contribute to heightened risks of opioid misuse and overdose among African American populations. The paper identifies key factors such as poverty, incarceration rates, and limited access to healthcare that exacerbate the opioid crisis in these communities. Introduction The measure of sexual orientation and gender identity (SOGI) data in electronic health records (EHR) has been critical for addressing health disparities and inequalities, especially for HIV care. Given that gender and sexual minorities (eg, transgender, men who have sex with men and intersex) are key groups in people living with HIV (PLWH), SOGI data can facilitate a more accurate understanding about the HIV outcomes (eg, viral suppression) among this key group and then lead to tailored therapeutic services. The two-step SOGI collection method as an emerging gender measurement can be used to measure SOGI status in medical settings. …

Although counterproductivity (e.g., shirking responsibilities or lying to supervisors) is a focal topic for many industrial/organizational psychologists, the broader social psychology literature has historically focused on more serious and uncommon forms of individual-level deviance, often in terms of its relation to criminal activity or psychopathology. Additionally, sociologists study intentional harmful behaviors that individuals engage in but use the term deviance in lieu of counterproductivity. Regarding students, there has been some work that addresses the more common phenomenon of counterproductivity at school, such as lying to teachers and cheating on tests. For decades, the Supreme Court has been suspicious of litigation under warrant in capital cases. The Court has described last-minute litigation as manipulative and dilatory, a result of gamesmanship by people on death row and their lawyers. With the confirmation of Justice Brett Kavanaugh in 2018, the Court began to extinguish the opportunity to assert death row detainees’ rights against unlawful death sentences and executions, reaching a crescendo of stay vacaturs and denials during the Trump executions.
