Black Power And Neighborhood Organizing In Minneapolis, Minnesota: The Way Community Center, 1966-1971, Sarah Jayne Paulsen
Black Power And Neighborhood Organizing In Minneapolis, Minnesota: The Way Community Center, 1966-1971, Sarah Jayne Paulsen
Theses and Dissertations
The Way Opportunities Unlimited, Inc. was a non-‐profit community center that operated from 1966—1984 in Minneapolis, Minnesota. Inspired by the national black power movement that arose in the 1960s, this community center led a local movement for African American equality. This thesis investigates The Way as a unique example of how black power ideology was implemented at the local level, in a city with a statistically small black population, presenting a northern urban context often overlooked by historians. The Way offered a space where aspiring young black musicians could perform, including Prince.
Hiv In The United States: A Spatial Examination Of Testing And Outcomes, Sazid Shameem Khan
Hiv In The United States: A Spatial Examination Of Testing And Outcomes, Sazid Shameem Khan
Theses and Dissertations
The main objectives of this dissertation were to provide a complete depiction of the prevalence of HIV across the United States and to assess HIV testing trends among various subpopulations. Additionally, we focused on measuring spatial access to HIV testing resources across the U.S. South, where HIV is rapidly becoming more burdensome and resources have historically been allocated disproportionately. We sought to identify disparate populations and locations that require further focus moving forward to stem the HIV epidemic. We utilized a variety of data sources such as the Behavioral Risk Factor Surveillance System (BRFSS) which was used to assess national …

Endrew F.'S Unintended Consequences, Claire Raj, Emily Suski

More than thirty years ago, the Supreme Court held that students with disabilities have a substantive right to a “free appropriate public education,” or “FAPE,” under the Individuals with Disabilities Education Act (IDEA). At that time, however, it declined to set a standard for evaluating that right. This year, the Court re-visited the issue in Endrew F. ex rel. Joseph F. v. Douglas County School District and finally and unanimously set that standard. The Court determined that a child’s individualized education program (IEP), the document that sets out a child’s special education services, must be “reasonably calculated to enable a …

The European Union's Response To The Syrian Refugee Crisis: National Factors That Affect Compliance In France And Spain, Sarah Cockcroft, Nicole Provax
The European Union's Response To The Syrian Refugee Crisis: National Factors That Affect Compliance In France And Spain, Sarah Cockcroft, Nicole Provax
Senior Theses
Beginning in 2011, the Syrian Refugee Crisis refers to refugees that come to Europe in an effort to escape the civil war in Syria. The influx of refugees from Non-European Union Member States, specifically those from Syria, threatens the stability and the status quo of the European Union. This population is particularly relevant because their status as refugees and their large numbers indicates a level of uncertainty about short term and long term assistance expectations. In order to understand the European Union’s response to the Syrian refugee crisis, it is necessary to determine the ways in which the national implementation …

Funding South Carolina’S Monuments: The Growth Of The Corporate Person In Monument Financing, Justin Curry Davis
Funding South Carolina’S Monuments: The Growth Of The Corporate Person In Monument Financing, Justin Curry Davis
Theses and Dissertations
The post-Reconstruction monuments in South Carolina have attracted scholarly interest for their role in promoting an alternative “Lost Cause” interpretation of the Civil War and its aftermath. Once established, this monument tradition continued to flourish throughout the twentieth century. The emphasis on a grassroots monument financing campaign has existed from the beginning of the monument building movement in South Carolina, as elsewhere in the American South, since the turn of the twentieth century. What has shifted is the role of the corporation in providing private funding for monuments. As the twentieth century progressed, the state came to play a much …

Tailoring Class Actions To The On-Demand Economy, Joseph Seiner
Tailoring Class Actions To The On-Demand Economy, Joseph Seiner
Faculty Publications
In O’Connor v. Uber Technologies, Inc., a federal district court permitted a class action case to proceed on the question of whether 160,000 drivers were misclassified by their employer as independent contractors rather than employees. The case has garnered widespread interest, making headlines across the country. Yet, it represents only one of many class action cases currently pending against technology companies in the modern economy. Indeed, similar systemic claims have already been brought against Yelp, GrubHub, Handy, CrowdFlower, Amazon, and many others.
The courts have struggled in their efforts to address the proper scope of class cases brought against corporations …

Multinational Foreign Affiliates In The Least Developed Countries: A Multilevel Approach, R. Scott Hibbs
Multinational Foreign Affiliates In The Least Developed Countries: A Multilevel Approach, R. Scott Hibbs
Theses and Dissertations
Several studies have examined the country-level effects on multinational enterprises that go into the developing countries, including the least developed countries. Few studies have considered the firm-level effects. This study uses the multilevel modeling method as outlined by Klein and Kozlowski (2000), Raudenbush and Bryk (2002), and Bliese and Hanges (2004) to examine whether there are any systemic patterns of multinational enterprises across the least developed countries. This paper uses information on foreign affiliates in the least developed countries to examine the overall trends of multinational firms in the least developed countries. Using data from the United Nations’ most recent …

Bridging The Justice Gap In Family Law: Repurposing Federal Iv-D Funding To Expand Community-Based Legal And Social Services For Parents, Lisa V. Martin, Stacy Brustin

Parents in family court overwhelmingly proceed pro se; however, in child support courtrooms, government attorneys representing the state child support agency frequently play a pivotal role. These attorneys represent the state’s ostensible interests in ensuring that children are financially supported and in preventing welfare dependence; they do not represent individual parents. The outcomes of child support proceedings have profound, long-term constitutional and financial implications for parents, yet litigants rarely understand their rights or the role of the government.
Originally, the goal of state child support enforcement efforts was to recapture the costs of welfare expenditures. In 1990, two-thirds of cases …
Nothing Could Be Finer? The Role Of Agency General Counsel In North And South Carolina, Elizabeth Chambliss, Dana Remus
Nothing Could Be Finer? The Role Of Agency General Counsel In North And South Carolina, Elizabeth Chambliss, Dana Remus
Faculty Publications
There is amazingly little contemporary research on the counseling function of government agency lawyers. Most research on federal government lawyers focuses on the Department of Justice, the Attorney General, or the birth of the modern administrative state during the New Deal. Much of this work focuses on the organization of federal litigation authority. At the state level, likewise, recent scholarship focuses on the litigation function of state attorneys general. Meanwhile, we know very little about the agency counseling function or the role of agency counsel in shaping agency policy and practice.
The role of state agency general counsel is an …

Ongoing, systematic research on civil legal needs and services is an essential component of improving the quality and availability of such services. Collaboration among researchers, legal services providers, and regulators will only become more important as innovations in the delivery of legal services progress. This volume brings together sixteen white papers by subject matter experts who assess "what we know and need to know" about various aspects of civil legal services delivery. The product of a partnership between the South Carolina Law Review and the ABA Commission on the Future of Legal Services, the collection is intended to serve as …
