Culture Clash: Teaching Cultural Defenses In The Criminal Law Classroom, Susan S. Kuo Jul 2004

Culture Clash: Teaching Cultural Defenses In The Criminal Law Classroom, Susan S. Kuo

Faculty Publications

In the law school classroom, the Socratic method of legal analysis removes a dispute at issue in a given case from its sociocultural context and takes the cultural backgrounds of the parties into account only when they serve the legal argument. The language of the law commands law students to siphon off the emotional and cultural content because of the enduring belief that the law is neutral and impartial. Accordingly, cultural conflicts are deemed irrelevant to legal analysis because laws are unbiased and culture-blind. This detached outlook has been termed perpectivelessness to denote a neutral, odorless, colorless non-perspective.

Pritchard Shipyard Kaolin Pipe Analysis, Geoffrey R. Hughes Jul 2004

Pritchard Shipyard Kaolin Pipe Analysis, Geoffrey R. Hughes

Publications

This report analyzes fragments of Kaolin tobacco pipes recovered at the Pritchard Shipyard archaeological site (38CH1049) in an attempt to assess the site’s stratigraphic integrity. Kaolin tobacco pipes, as a class of archaeological material has the potential to address this question because of their temporal attribute: the direct relationship between bore diameter to manufacturing period. As a result, tobacco pipes offer insight into the following questions: 1) When was the site’s earliest possible occupation? 2) On average, what were the most intensive occupational periods? 3) What was the site’s maximum possible occupational range? 4) To what extent is the site’s …

A Management Plan For Known And Potential United States Navy Shipwrecks In South Carolina, James D. Spirek, Christopher F. Amer

Faculty & Staff Publications

This report, A Management Plan For Known and Potential United States Navy Shipwrecks in South Carolina, presents the results of a multi-year study that partnered the Maritime Research Division (MRD) of the South Carolina Institute of Archaeology and Anthropology (SCIAA) at the University of South Carolina (USC) with the Naval Historical Center (NHC) in Washington, DC. The project was conducted in two phases. The first phase called for compiling historical and cultural data of United States Navy vessels lost in South Carolina waters to document the losses and subsequent wreck history of each vessel. The resultant information was then …

Is Modernism Really Modern? Uncovering A Fallacy In Postmodernism, William D. Harpine Jan 2004

Is Modernism Really Modern? Uncovering A Fallacy In Postmodernism, William D. Harpine

Faculty Publications

Some postmodernists criticize the view that the logics of Western thought can be employed universally. In doing so, they assume without adequate proof that different human societies have greatly different rationalities and employ completely different logics. This essay argues that, on the contrary, widely different cultures often share noteworthy similarities in rationality.

Citizenship, Identity, And Transnational Migration: Arab Immigrants To The Us, Caroline R. Nagel, Lynn A. Staeheli Jan 2004

Citizenship, Identity, And Transnational Migration: Arab Immigrants To The Us, Caroline R. Nagel, Lynn A. Staeheli

Faculty Publications

The aim of this paper is to evaluate the changing relationships between identities, citizenship and the state in the context of globalisation. We first examine the ways in which scholars discuss changes in the ways in which citizenship and political identity are expressed in the context of international migration. We argue that much of the discussion of transnationalism and diaspora cling to an assumption that citizenship remains an important—though not defining—element of identity. Our position, by contrast, is that migration is one of a number of processes that transform the relationship between citizenship and identity. More specifically, we argue that …
