Dickerson V. United States: The Case That Disappointed Miranda's Critics--And Then Its Supporters, Yale Kamisar
Dickerson V. United States: The Case That Disappointed Miranda's Critics--And Then Its Supporters, Yale Kamisar
University of San Diego Public Law and Legal Theory Research Paper Series
It is difficult, if not impossible, to discuss Dickerson v. United States intelligently without discussing Miranda, whose constitutional status Dickerson reaffirmed (or, one might say, resuscitated). It is also difficult, if not impossible, to discuss the Dickerson case intelligently without discussing cases the Court has handed down in the five years since Dickerson was decided. The hard truth is that in those five years the reaffirmation of Miranda’s constitutional status has become less and less meaningful.
In this paper I want to focus on the Court’s characterization of statements elicited in violation of the Miranda warnings as not actually “coerced” …

To Be Or Not To Be: Status Of Guam's Middle Schools, Judith T. Won Pat Edd
To Be Or Not To Be: Status Of Guam's Middle Schools, Judith T. Won Pat Edd
Dissertations
In an effort to help middle school programs respond to the unique developmental needs of their students, in 1995 the National Middle School Association issued their influential list of twelve essential characteristics for a developmentally sound middle school. Although this paper spawned a significant amount of research regarding the importance of these essential characteristics, there has been little, if any, research in the last decade describing the extent to which these characteristics have been implemented in middle schools outside of the continental United States. To remedy this situation, this study surveyed all 471 middle school teachers on Guam as well …
Securing A Journalist's Testimonial Privilege In The International Criminal Court, Anastasia Heeger
Securing A Journalist's Testimonial Privilege In The International Criminal Court, Anastasia Heeger
San Diego International Law Journal
This Article argues that given the unique and significant contribution of journalists to uncovering and documenting war crimes, the ICC should amend its evidentiary rules to recognize a qualified journalist's privilege. In doing so, the ICC should clearly identify who may benefit from such a privilege, clarify a procedure for balancing the need of reportorial testimony against prosecution and defense interests, and, lastly provide for mandatory consultations between the court and affected news organizations or journalists before allowing the issuance of a subpoena. Such clarity will benefit not only journalists working in war zones and the ICC, but will provide …
A Synthetic Approach To Legal Adjudication, Samuel C. Rickless
A Synthetic Approach To Legal Adjudication, Samuel C. Rickless
San Diego Law Review
Almost every interesting dispute that arises under the law is the product of disagreement among reasonable and competent speakers of the language of the relevant provision. If the meaning of the provision is not clear, then, even if the facts are fixed, how the judge should proceed is a matter of controversy. The Author offers three main suggestions.

Why I Write (And Why I Think Law Professors Generally Should Write), Yale Kamisar
Why I Write (And Why I Think Law Professors Generally Should Write), Yale Kamisar
San Diego Law Review
Looking back on forty-five years of law review writing, Professor Kamisar concludes that, to use George Orwell's words, he has been moved to write by "a sense of injustice" and the need to "expose" "some lie," e.g., the lie that the trial judge or the prosecuting attorney can be counted on to protect the rights of unrepresented defendants. He maintains further that law professors generally should feel an obligation to write because they can think through and research exhaustively any and every problem they meet along the way without worrying about billable hours and they can do so "under working …
