A Fission Decision: The Case For Extending Diablo Canyon’S Nuclear Operation, Isabelle Tyler

This Article examines the regulatory decisions and policy debates surrounding Diablo Canyon in the wake of recent legislation aimed at extending the plant’s operational timeline. Presenting a balanced analysis of the arguments both for and against the closure, this Article explores how the new bill reshapes the conversation around the plant’s future. While proponents of the shutdown emphasize safety concerns and the goal of an all-renewable grid, this Article argues that closing Diablo Canyon would hinder California’s decarbonization efforts and jeopardize energy reliability amid increasing power shortages and extreme weather events. This Local Evaluation Report assesses the implementation and outcomes of the Peace and Justice Law Center’s Legal Services to Support Gang Desistance (LSSGD) project, funded by the California Board of State and Community Correction’s California Violence Intervention and Prevention Program (CalVIP) Grant, Cohort 4. Through LSSGD, PJLC sought to provide direct legal services to current or formerly gang-involved individuals, as well as those treated by law enforcement as gang-involved, to reduce legal obstacles to desistance, expand access to lawful employment, promote family stability, and improve trust in legal institutions. Proportionality And Theft, Christopher T. Wonnell

Criminal law can serve a variety of utilitarian purposes including deterrence, incapacitation, and rehabilitation. Nevertheless, there is broad agreement among criminal justice scholars that the pursuit of these purposes should be constrained by a requirement that punishment not be disproportionately severe relative to the offense charged. The proportionality constraint is likely to be especially important when considering the less heinous predatory crimes such as nonviolent thefts. Recent years have seen experiments by progressive prosecutors who deemphasize theft offenses as well as statutory schemes that treat many thefts as misdemeanors. With some empirical support, critics charge that these experiments have increased …

African American students in South Carolina experience historical educational suppression (Anderson, 1988; Bowers et al., 2018; Fabel, 2019). This qualitative case study investigated how the use of African Diaspora and Gullah Geechee culture in supplemental education programs supported the academic success of youth. Using a culturally and historically responsive literacy and critical race theoretical framing (Gay, 2013; Hammond, 2015; Ladson-Billings, 2014; Ladson-Billings & Tate, 1997; Mills, 1997; Muhammad, 2020), this study captured the voices and insights of community elders and program directors of The Village Group, that makes use of Gullah Geechee cultural, academic, and vocational practices to engage and …

The South Carlsbad Climate Adaptation Project (Project) is an initiative led by the City of Carlsbad (City) designed to address the growing risks of coastal erosion and sea level rise within the city. The Project focuses on a one mile segment of South Carlsbad Boulevard that runs directly along the coast and has experienced decades of coastal erosion, shoreline retreat, and recurring flooding–all of which are expected to intensify due to climate change. In February 2024, in LePage v. Center for Reproductive Medicine, the Alabama Supreme Court held that embryos created through in-vitro fertilization (IVF) were legal persons. The national conversation about this ruling focused on the implications for IVF treatment. The impact of fetal personhood on the realm of vital records law has, to date, gone unnoticed. Vital records laws in the United States mandate the registration and collection of data for legislatively determined vital events. Vital records law influenced by fetal personhood, as well as broader trends to criminalize pregnancy, has profound and troubling implications for individuals experiencing spontaneous abortion …

Archival Articulations Of Belonging: Resistance, Reimagination, And Resilience In School And In Incarceration, Caroline Hastings

Belonging is a universal desire, providing purpose and comfort, that supports our ability to survive and triumph through difficulty. A lack of belonging can impact one’s likelihood of becoming incarcerated. In turn, incarceration stigmatizes individuals and disrupts connections with family, friends, and community members. This study of individual’s experiences of belonging analyzed reflective written accounts created during incarceration. This phenomenological qualitative examination of belonging for formerly and currently incarcerated individuals, disproportionately people of color and individuals with disabilities, sought to deepen our understanding of belonging as a force in their lives. This research project examines how grassroots social organizations contribute to the advancement of immigrant legal protections and shape immigration policy, with a particular focus on formerly incarcerated migrants in California. I focus on case studies and the personal experiences of organizers from Homies Unidos, Border Angels, and other organizations that operate near the San Diego–Tijuana border region. The study illustrates how these groups provide essential services, mental health support, and community-based initiatives for vulnerable and formerly incarcerated immigrants. By conducting oral histories and ethnography as methods for preserving emotional labor and shared memory, this research challenges prevailing narratives that criminalize …

The following qualitative study examines a new increase of technological surveillance used on immigrants by San Diego’s local law enforcement. Drawing from in-depth interviews of the San Diego Privacy Advisory Board and Trust SD, insights of technological related violations are sanctioned by the San Diego Police Department. This is done through ambiguous language regarding “criminal investigations” and lack of definitive use policy, despite several memorandums and recommendations by the SD Privacy Advisory Board. Present findings reveal a duality of immigrant surveillance instigating hyper-visible tracking and broadcasting an image of their criminality. This policy paper advocates for a structural transformation in mental health crisis response, moving beyond police-led interventions toward trauma-informed, community-rooted models grounded in public health and equity. Drawing on Critical Race Theory (CRT), neuroscience, and program evaluations of models like CAHOOTS, 988, Denver’s STAR, and Durham’s HEART, it examines how systemic racism, institutional mistrust, and implicit bias contribute to disproportionate harm for BIPOC individuals. Latinxs make up 40% of California's population but account for 45% of the prison population and 47% of the jail population (Sawyer, 2023). Their overrepresentation in carceral custody not only impacts the individual but also affects families and communities by limiting access to social, political, and educational capital and agency. In response to gaps in research specific to the collateral impact, this interdisciplinary arts-based qualitative study highlights the experiences of five formerly incarcerated Latino men who participated in an Arts in Corrections playwriting class during their time in a California state prison. Background: Aesthetic nursing is a new branch of nursing practice. Formal nursing education and standards are lacking, making it challenging to assess competency of an aesthetic nurse. Adverse events (AEs) range from minor (bruising) to severe (vascular compromise and blindness) and can be associated with poor technique or lack of knowledge. Standardized practice using evidence-based (EB) protocols is necessary to provide safe, high-quality care. The purpose of my research was to learn how student conduct systems within The Division of Student Affairs at the University of San Diego (USD) could be improved by staff and students learning from one another. My research involved guiding staff and students from various conduct processes across campus to learn from each other through improved communication and restorative practices, while ensuring USD’s Mission was emphasized. The seminal Supreme Court decisions Meyer v. Nebraska and Pierce v. Society of Sisters, now commemorated on their centenary anniversary, are odd doctrinal ducks. They are both still routinely cited as the foundation for ascribing to persons on whom the state has conferred legal parent status a right under the Fourteenth Amendment Due Process Clause of the United States Constitution. (According to Westlaw, judicial citation count for Meyer now nears 3000, and secondary-source citations have surpassed 7000.) For a century, the U.S. Supreme Court has provided substantive protection, through the Due Process Clause of the Fourteenth Amendment, to a parent’s liberty interest in directing the education and upbringing of her children. The seminal cases for this protection—Meyer v. Nebraska and Pierce v. Society of Sisters—are widely considered part of the Court’s canon, and the Court has long referred to the liberty interest, or right, that they recognized as “fundamental.” But despite the long pedigree and significance of this right—and despite the Court’s common application of strict scrutiny to laws that restrict or draw classifications impacting …
