Deductible Tax Planning Expenses: The Scope Of Internal Revenue Code Section 212-3, George L. Bevan Jr.

An understanding of the scope of section 212(3) requires an examination of several factors: judicial and administrative law developed prior to its enactment; the events which precipitated its enactment; legislative conceptualization of its intended scope; judicial and administrative construction of the statute since its enactment; and the relationship of section 212(3) to other sections of the Code.

Juvenile Justice: The Economics Of Ineptitude, William M. Mccarty
San Diego Law Review
The Juvenile Justice System is complex and wrought with problems. This Article reviews the scope and cost of the juvenile justice system. The article looks at the national and human costs of the system, with an eye towards change where the federal government assumes more of a leadership position, but not full control of the system. To alter the current juvenile justice system, the Article proposes a formula with which to measure the benefits and gauge the attitude towards the system. The author concludes that the government should focus efforts on modifying the system’s objective, putting constructive materials in the …

The public interest is an oft-used elusive concept that often emerges from the adversarial system. This Comment analyzes whether economic barriers to using the adversary system make it difficult to link the public interest as the product of the adversarial system. This Comment address whether middle income people need more legal services than they are presently receiving because of the economics of the legal system. Present restrictions on group legal services, such as the ban on solicitation and advertising, increases the difficulty of obtaining legal services. Command Control: Lawful Versus Unlawful Application, Anthony P. De Giulio
San Diego Law Review
Congress empowered the commander to perform certain judicial functions which has resulted in commander control of the court-martial system. This Article examines the disciplinary policies established by command directives, the prohibition against the accuser as convening authority, and the command control over court personnel, counsel, military judges, and case review. Proposed legislation, such as the Hatfield Bills, and the Bayh and Bennett Proposals, would change the existing system. Currently, the command directives establish the commander's prosecutorial discretion and prohibitions on improper imposition of nonjudicial punishment. Also, when the convening authority becomes an accuser, in cases involving willful disobedience, such cases …

David Meets Goliath In The Legislative Arena: A Losing Battle For An Equal Charitable Voice, Edward W. Wachtel

It is discriminatory not to allow tax exempt organizations to advocate directly before Congress on an equal basis with private business. Moreover, these organizations can be a valuable source of information. They can broaden legislators' understanding of proposed legislation, and they can suggest valuable legislative alternatives.
