Beyond The Cisg: Utilizing Unidroit Principles To Synchronize International Contract Law Beyond Sales Of Goods, Noor Albandar

Modern advancements have made it easier than ever for individuals and businesses to enter into cross-border transactions. Contract law in the United States employs legal instruments such as the UCC to aid contracting parties, and international law consists of tools such as the CISG supporting cross-border contracts for the sale of goods. Such tools are important because international transactions for goods occur frequently. This Comment will examine the complexities that arise in the face of international contracts, discuss tools for uniform law that are currently utilized by various governing bodies, and propose further implementation of uniform international contract law. Proportionality And Theft, Christopher T. Wonnell

San Diego Law Review

Criminal law can serve a variety of utilitarian purposes including deterrence, incapacitation, and rehabilitation.  Nevertheless, there is broad agreement among criminal justice scholars that the pursuit of these purposes should be constrained by a requirement that punishment not be disproportionately severe relative to the offense charged.  The proportionality constraint is likely to be especially important when considering the less heinous predatory crimes such as nonviolent thefts.  Recent years have seen experiments by progressive prosecutors who deemphasize theft offenses as well as statutory schemes that treat many thefts as misdemeanors.  With some empirical support, critics charge that these experiments have increased …

Navigating Risk Factor Disclosures: A New, Outlier Ninth Circuit Approach Remains After The Supreme Court Declines To Resolve A Circuit Split In In Re Facebook Securities Litigation, Jessica K. Kocinski

This Casenote examines the implications of the Supreme Court’s recent decision in Amalgamated Bank to dismiss Facebook’s writ of certiorari as improvidently granted, thereby allowing the shareholders’ securities fraud class action lawsuit to proceed in the lower courts.  Specifically, it focuses on whether Facebook shareholders adequately alleged securities fraud under Section 10(b) and Rule 10b-5 as to challenged risk factor disclosures in Facebook’s 2016 Form 10-K under the PSLRA’s heightened pleading standard.  Part II of this Casenote provides background on the Cambridge Analytica data breach, which Facebook allegedly failed to disclose in its 2016 Form 10-K risk factor disclosures.  Part …

The Voices Of Educators And Elders: Examining A Supplemental Educational Program Through A Culturally Responsive Lens In Gullah Geechee And African American Communities, Kelly D. Shelton

African American students in South Carolina experience historical educational suppression (Anderson, 1988; Bowers et al., 2018; Fabel, 2019). This qualitative case study investigated how the use of African Diaspora and Gullah Geechee culture in supplemental education programs supported the academic success of youth. Using a culturally and historically responsive literacy and critical race theoretical framing (Gay, 2013; Hammond, 2015; Ladson-Billings, 2014; Ladson-Billings & Tate, 1997; Mills, 1997; Muhammad, 2020), this study captured the voices and insights of community elders and program directors of The Village Group, that makes use of Gullah Geechee cultural, academic, and vocational practices to engage and …

In Search Of Resilience: A Case Study Of Leadership In Challenging Times In An International School Setting, Bradylee W. Mcgeough

This study investigated the leadership of a long-serving head of an international school during six periods of significant crisis affecting the school. The study was conducted at a private school in Islamabad, Pakistan, often referred to locally as The American School.

The study paid particular attention to the development of resilience in the leader and in the follower group during and after periods of crisis. Initially designed as a heuristic inquiry, in practice the study emerged more as a collection of oral histories, although heuristic inquiry methods were employed throughout the study. Playa Sediment Bioaccessibility Presents Previously Unknown Risks To Population Health In A Water-Stressed Region Undergoing Lake Desiccation: Salton Sea, Usa, Jordan Jaeger

Globally, drylands are expanding, and endorheic basins are in rapid decline. Saline lake desiccation exposes lakebed playa likely to become dust, posing potential health risks to surrounding communities. Studies investigating health risks from playa dust exposure often focus on health effects associated with the presence of airborne particulates, but fewer studies investigate health risks associated with dust source chemistry. This study examines dust source particle composition in a desiccating inland sea in a water-stressed agricultural region of California. Specifically, chemical bioaccessibility of bound trace elements uncovers risks to children, adults, and agricultural worker health. Arsenic exposure via sediment ingestion poses …
