Everyday Dharma And Perfect Enlightenment: Contemporary Buddhist Hermeneutics, Karma Lekshe Tsomo Phd

Theology and Religious Studies: Faculty Scholarship

Professor Karma Lekshe Tsomo examines the contradictions and innovations that characterize the adoption of Buddhism by Americans. Adapting Buddhism to fit Westerners has brought fruitful new directions to Buddhism, she argues, at the same time that it has resulted in some distortion of or discarding of traditional Buddhist practices and goals.

Nobody's Ever Asked Me That Before: Middle School Students Talk About Motivation To Achieve In School Contexts, Erika Daniels Edd May 2004

Nobody's Ever Asked Me That Before: Middle School Students Talk About Motivation To Achieve In School Contexts, Erika Daniels Edd

Dissertations

The purpose of this study was to explore whether or not a connection exists between students' school contexts and their academic and social choices by listening to the voices of first year middle school students. The intent of this study was to provide teachers with a way to reconceptualize adolescents as learners. Research suggests that there are two distinct approaches to the study of motivation. Some researchers believe that motivation can be externally enacted through exams, assessments, and other accountability measures. Other researchers believe that motivation is internally generated through the relationships students build, through their beliefs about learning, and …

An Examination Of Teachers’ Beliefs About Critical Reading And Academic Writing, Cindi Davis Harris Edd May 2004

An Examination Of Teachers’ Beliefs About Critical Reading And Academic Writing, Cindi Davis Harris Edd

Dissertations

The ability to compose a well-written research paper is evidence o f a student's ability to read critically and write academically. However, evidence suggests that many college-bound high school graduates have not learned these skills. While the research literature overwhelmingly supports the notion that teachers are an important factor in students’ academic success, and that in order to be academically successful, students need to have critical reading and writing skills, there has been little research about how teachers' beliefs and knowledge about critical reading and academic writing influence instruction with regard to these skills. This naturalistic case study employed in-depth …

Implementing Student Learning Outcomes: The Link To Accreditation In California Community Colleges, Lori Waite Edd May 2004

Implementing Student Learning Outcomes: The Link To Accreditation In California Community Colleges, Lori Waite Edd

Dissertations

As the public demands accountability in higher education, regional accrediting bodies are under pressure from external governmental agencies, as well as from key stakeholders, to demonstrate their effectiveness and more specifically, provide evidence of student learning. All regional accrediting agencies now have incorporated some level of student learning outcomes into their criteria for reaffirmation of accreditation. This case study describes how three California public community colleges are implementing student learning outcomes on their campuses. Administrators, faculty and staff were interviewed about perceptions and insights related to learning outcomes. Artifact analysis was conducted to establish credibility and data triangulation. Findings suggest …

Explicit Writing Instruction: Effects On Sixth Grade Students’ Writing And Reading Achievement, Jennifer Hamby Edd May 2004

Explicit Writing Instruction: Effects On Sixth Grade Students’ Writing And Reading Achievement, Jennifer Hamby Edd

Dissertations

The purpose of this quantitative study was to examine the effect of explicit writing instruction on sixth grade students' writing growth and achievement as measured by holistic and analytic assessment. This research responds directly to the need for additional research on effective reading and writing instruction (Langer & Allington, 1992; The College Board, 2003). The preponderance of research in writing has been devoted to early writing. Less evidence is available to examine the effect of writing instruction at the sixth grade level. Writing samples from 124 sixth grade students at two elementary schools were used in this study. The two …

Examining The Lived Experiences Of Out Gay And Lesbian K-12 Educators, William Dejean Edd May 2004

Examining The Lived Experiences Of Out Gay And Lesbian K-12 Educators, William Dejean Edd

Dissertations

The purpose of this study was to examine the lived experience of gay and lesbian K-12 educators who consider themselves out within the classrooms in which they teach. With gay and lesbian issues receiving increased visibility within the K-12 setting, researchers have begun to examine the experiences of gay and lesbian K-12 educators (Harbeck, 1992; Letts IV & Sears, 1999; Jennings, 1994; Kissen, 1996; Parker, 2001; Sanlo, 1999) within this context. Yet few research studies have specifically examined gay and lesbian educators who consider themselves out in the classroom in which they teach. Five gay male teachers and five lesbian …

Military Detention And The Judiciary: Al Qaeda, The Kkk And Supra-State Law, Wayne Mccormack May 2004

Military Detention And The Judiciary: Al Qaeda, The Kkk And Supra-State Law, Wayne Mccormack

San Diego International Law Journal

This Article touches on the choice of whether to use the language and tools of war or the language and tools of law enforcement in responding to terrorism. The principal focus, however, is on the limited issue of judicial review and military detentions. The Article reviews the case law created on this subject during the Civil War and World War II. Historical considerations are found by the author to be relevant and helpful in solving the incoherency of current legal responses to terrorism. For instance, indefinite military detention is not coherent with either the international law concept of violations of …

The New Partnership For Africa's Development: Institutional And Legal Challenges Of Investment Promotion, Victor Mosoti

San Diego International Law Journal

This paper is divided into five parts. Part I introduces NEPAD, its philosophical basis and objectives. Part II discusses the investment promotion role of NEPAD and its difference from past development thinking about Africa's problems. In Part III we discuss NEPAD's strategy for realizing investment flows into Africa, some of the NEPAD's institutional weaknesses, and the repercussions thereof in realizing the NEPAD objectives. It also highlights the potential implications of NEPAD to the regional integration plan in Africa. Taking into account the supposed political clash between NEPAD and the AU, Part IV discusses possible ways of restructuring NEPAD to enable …

The Creation Of International Commercial Law: Sovereignty Felled, Sandeep Gopalan May 2004

The Creation Of International Commercial Law: Sovereignty Felled, Sandeep Gopalan

San Diego International Law Journal

The creation of international commercial law presents an interesting paradox for proponents of sovereignty in international law. Indeed, it could be argued that the creation of international commercial law is the vanishing point of sovereignty in that nation states are becoming increasingly less important in the creation of international commercial law with the growth of regional organizations, non-state actors, and international arbitration. This is spurred on by the march of globalization and the consequent need for international commercial law. The term "harmonization" will be used as a surrogate to discuss the creation of international commercial law, as it is the …

Soldiers Of Semipalatinsk: Seeking A Theory And Forum For Legal Remedy, Anne Miers Kammer May 2004

Soldiers Of Semipalatinsk: Seeking A Theory And Forum For Legal Remedy, Anne Miers Kammer

San Diego International Law Journal

This Comment will address the unique dilemma of individuals in Kazakhstan whose health has been compromised by the former Soviet Union's 40-year period of nuclear testing on what is now Kazakhstan soil. The principal legal analysis of this Comment will focus on the availability of remedies (in the form of monetary damages available through legal resolution) to the citizens and/or state of Kazakhstan, and potential judicial forums in which to seek those remedies. Particular attention will be paid to the comparative likelihood of successful remedial legal action if pursued by a private class of Kazakhstan citizens versus action pursued by …

From The Nuremberg Charter To The Rome Statute: Defining The Elements Of Crimes Against Humanity, Mohamed Elewa Badar

San Diego International Law Journal

The purpose of this study is to examine the past and present contours of the prohibition of "crimes against humanity", analyzing and scrutinizing the essential elements of this crime, with a view to obtaining and drawing together basic criteria that could eventually guide the adjudication of this offence. Furthermore, this clarification of "crimes against humanity" is particularly timely with respect to the soon functioning International Criminal Court (ICC).

The Race To The Bottom: The United States' Influence On Mexican Labor Law Enforcement, Jenna L. Acuff May 2004

The Race To The Bottom: The United States' Influence On Mexican Labor Law Enforcement, Jenna L. Acuff

San Diego International Law Journal

There are several theories why the Mexican government has refused to enforce the stringent laws enumerated in the Mexican Constitution. For example, the North American Social Dumping Theory and Mexico's desire to retain foreign direct investment from foreign countries as a source of revenue and employment. This Comment seeks to analyze and expound on these theories and to develop two additional theories that have only been discussed in passing. Part II begins with a brief look at the history of Mexican labor, including pre- and post-Revolution working conditions. Part III discusses Mexico's encouragement and protection of foreign direct investment and …

Using Architectural Constraints And Game Theory To Regulate International Cyberspace Behavior, Van N. Nguy May 2004

Using Architectural Constraints And Game Theory To Regulate International Cyberspace Behavior, Van N. Nguy

San Diego International Law Journal

The debate over whether cyberspace can or should be regulated is essentially dead. This is the conclusion being taught in law schools today. The battle between Judge Frank Easterbrook and Professor Lawrence Lessig over "laws" and "horses", infamous among cyberspace legal scholars, became irrelevant when geographically-based governments began regulating Internet related activities. However, debate over how the Internet should be regulated continues. One way of framing this debate is in terms of deciding how to regulate behavior in cyberspace. Professor Lessig postulated four kinds of constraints regulate behavior: (1) social norms, (2) markets, (3) law, and (4) architecture. This comment …
