Asian American Females In Educational Leadership In K-12 Public Schools, Dina Castillo Pacis Edd May 2005

Asian American Females In Educational Leadership In K-12 Public Schools, Dina Castillo Pacis Edd

Dissertations

The research on educational leadership has largely excluded the perspectives of women and minorities. As school age populations become increasingly diverse, the need for principals from diverse backgrounds also increases. However, the research data shows that females and ethnic minorities are underrepresented in educational leadership positions. In an effort to address the lack of minority females in educational leadership, particularly Asian American females, more research needs to be conducted on their perceived barriers to upward mobility, as well as their perceptions of educational leadership. Only when the voices of Asian American female minority administrators are heard, will they be better …

Navigating The Change Of Life: The Menopausal Transition Of Thai Immigrant Women, Bulaporn Natipagon-Shah Phd, Msn, Rn

Dissertations

Given that women continue to live more than three decades after menopause and their health and well-being in later life are determined by quality of health during the menopausal transition, menopause has become an important issue in the healthcare arena. The growing number of immigrant women in the United States signifies a need for healthcare providers to develop cultural knowledge and sensitivity toward each immigrant group regarding the issue of menopause. The purpose of this qualitative study was to build a substantive grounded theory of the experiences of menopausal transition among Thai immigrant women in the United States. Data collection …

Omesubel A Ureor: Workforce Development In Palau From Pre-Contact To 1999, Patrick Ubal Tellei Edd May 2005

Omesubel A Ureor: Workforce Development In Palau From Pre-Contact To 1999, Patrick Ubal Tellei Edd

Dissertations

After being a ward of many nations for over 250 years, the Republic of Palau gained its independence on October 1, 1994. One of the many challenges facing this young nation is the workforce preparation of its people to engage in nation building. After many years of being subjugated by foreign governments, the people have developed a taste of material consumerism. This has driven people away from their subsistence way of life in favor of a market driven economy which calls for infrastructure development that cannot be accomplished if there is a nonexistent skilled workforce to undertake this challenge. To …

Word Meaning In Legal Interpretation, Walter Sinnott-Armstrong May 2005

Word Meaning In Legal Interpretation, Walter Sinnott-Armstrong

San Diego Law Review

Professor Sinnott-Armstrong argues against the arguments published by Professor Prakash and Professor Alexander in an article on legal interpretation in which they defended the thesis that all interpretation properly so-called seeks to uncover the intended meaning of the author(s). Against their arguments, the Author defends coherence and importance of word meaning. In Part I, he more precisely defines the these that Alexander and Prakash deny and Professor Sinnott-Armstrong defends. In Part II, he will show why Alexander and Prakash's arguments fail to rule out word meanings. In PArt III, he will put these debates in a larger theoretical context and …

A Synthetic Approach To Legal Adjudication, Samuel C. Rickless May 2005

A Synthetic Approach To Legal Adjudication, Samuel C. Rickless

San Diego Law Review

Almost every interesting dispute that arises under the law is the product of disagreement among reasonable and competent speakers of the language of the relevant provision. If the meaning of the provision is not clear, then, even if the facts are fixed, how the judge should proceed is a matter of controversy. The Author offers three main suggestions.

A Pluralist Approach To Interpretation: Wills And Contracts, Kent Greenawalt May 2005

A Pluralist Approach To Interpretation: Wills And Contracts, Kent Greenawalt

San Diego Law Review

This account of legal interpretation focuses mainly on wills and contracts. It adopts a pluralist approach, one that treats a number of factors as potentially relevant and does not assume that all relevant factors necessarily reduce to one overarching inquiry that is the same whatever legal text is being interpreted.

There Is No Textualist Position, Stanley Fish May 2005

There Is No Textualist Position, Stanley Fish

San Diego Law Review

The Author argues that there is no textualist position because there is no candidate on behalf of whom a would-be textualist could argue. He argues that lexical items and grammatical structures by themselves will yield no meaning - will not even me seen as lexical items and grammatical structures - until they are seen as having been produced by some intentional agent. A text whose meaning seems perspicuous and obvious right off the bat is a text for which an intentional context has already been assumed, and it is also a text whose clarity and stability can always be troubled …

Not A Matter Of Interpretation, Steven Knapp, Walter Benn Michaels May 2005

Not A Matter Of Interpretation, Steven Knapp, Walter Benn Michaels

San Diego Law Review

This Article explores the basic question of statutory interpretation. The disagreement among scholars is a theoretical one - it is a dispute about what the proper object of interpretation should be, about whether it should be what Scalia calls "the objective indication of the words" (what the authors said), or whether it should be "the intent of the legislature" (what the authors meant).

From Presence To “E-Presence” In Online Nursing Education, Lisa M. Kaiser Phd, Msn, Bsn, Rn

Dissertations

Online web-based course offerings are now common in many institutions of higher education In response to the current and severe nursing shortage, estimated to represent a 20% vacancy rate by the year 2015, (Tarkin, 2003) many more universities have created online nursing courses for registered nurses wishing to continue their education in nursing. The National League for Nursing (NLN) set research priorities that urged exploration of the impact that technology has on the content and nature of teaching and learning in nursing education (1999). Using a series of separate synchronous, online focus groups and 1:1 interviews with nurse educator experts …

"When Caterpillars Kill": Holding U.S. Corporations Accountable For Knowingly Selling Equipment To Countries For The Commission Of Human Rights Abuses Abroad, Zaha Hassan

San Diego International Law Journal

With the recent trend towards holding corporations accountable for aiding and abetting human rights abuses abroad, this paper asks the question whether corporations should be held liable for knowingly facilitating human rights abuses abroad by selling equipment widely known to be used in such abuses. To this end, the case of Caterpillar sales to Israel will here be examined. Part II provides an overview of the history of the Alien Tort Claims Act (ATCA) and its applicability in United States courts. Part III gives an overview of how corporate liability for human rights abuses abroad developed under the ATCA. Part …

The Prohibition Of Widespread Rape As A Jus Cogens, Dean Adams May 2005

The Prohibition Of Widespread Rape As A Jus Cogens, Dean Adams

San Diego International Law Journal

This Comment explains why the prohibition of widespread rape should be recognized as a jus cogens through analyses of the failure of existing international legal instruments, advances within international law towards the universal prohibition of widespread rape, and policy reasons for classifying widespread rape as a jus cogens. In doing so, this comment will demonstrate the particular timeliness of this topic by reviewing the use of widespread rape in several countries through the 1990s, the widespread rape presently occurring in Kenya, and the emerging reports from Iraq of rape committed at the hands of the Saddam Hussein regime. Finally, this …

Child Labor: The Pakistani Effort To End A Scourge Upon Humanity - Is It Enough?, Aine Smith May 2005

Child Labor: The Pakistani Effort To End A Scourge Upon Humanity - Is It Enough?, Aine Smith

San Diego International Law Journal

This Article will encompass the issues necessary to create such a report card. In the process of assessing Pakistan's efforts, this article will demonstrate that the measures taken in Pakistan are not sufficient to end bonded child labor. In addition, this comment proposes that the international community must expend more financial and legal resources to tackle the problem of child labor. Part II focuses on Pakistan's use of child labor. This includes a discussion of the history of child labor, the international rights being abrogated by child labor, the efforts implemented to combat child labor, and an evaluation of Pakistani …

Legislative Intentions, Legislative Supremacy, And Legal Positivism, Jeffrey Goldsworthy May 2005

Legislative Intentions, Legislative Supremacy, And Legal Positivism, Jeffrey Goldsworthy

San Diego Law Review

In this Article, the Author argues that the debate about the reality of legislative intentions and their utility in statutory interpretation is much more important than is generally realized. Its outcome could affect both the constitutional doctrine of legislative supremacy and the philosophy of legal positivism. Briefly stated, his argument will be that, for practical reasons, skepticism about legislative intentions threatens to undermine the doctrine of legislative supremacy.

Against Interpretation, Miranda Oshige Mcgowan May 2005

Against Interpretation, Miranda Oshige Mcgowan

San Diego Law Review

This essay argues that Intentionalism's definition of interpretation entails nothing about the legitimate scope of the judicial rule and commits a judge to no particular method of textual construction. The Author's argument follows in three parts. First, she will set the stage by explaining Intentionalism in greater detail and exploring how Intentionalism challengers lawyers' views of interpretation. Second, she will discuss the role interpretation plays in legal decision making. She will argue that deciding a case under law necessarily includes noninterpretive tasks. Even when it appears that a legal decision entirely depends on a question of statutory meaning, interpretation alone …

Linking Succession Planning To Employee Training: A Study Of Federal Employees, Douglas E. Fenner Edd

Dissertations

The purpose of this study was to examine whether differences emerged in federal male and female middle managers and supervisors' perceptions concerning organizational career development culture, succession planning components used for linking employee-training activities, reasons for succession planning and barriers impacting succession planning within their organization. Quantitative methodology supported this research study. A test-retest of the eighty-two-statement survey instrument was conducted for reliability among 40 participants (20 male and 20 female). The survey was then administered to 300 federal middle managers and supervisors (150 male and 150 female). Participants' grade level ranged from general schedule (GS) GS-12 to GS-15. Of …
