San Diego International Law Journal

In the third section, the Article will briefly explain what a SOFA is, and how and why they are used, focusing on the North Atlantic Treaty Organization (NATO) SOFA. This section will also utilize examples of U.S. service member misconduct, both associated with and detached from official duty, to illustrate the application of an acts-based SOFA jurisdiction article. The fourth section turns to the Iraq SOFA’s status-based jurisdiction article, …

The Prohibition Of Large Partnerships In Nigerian Company Law: An Essay Into Postcolonial Legal Atavism, C. George Nnona
The Prohibition Of Large Partnerships In Nigerian Company Law: An Essay Into Postcolonial Legal Atavism, C. George Nnona
San Diego International Law Journal
Nigerian company law requires that partnerships of more than 20 persons be incorporated and penalizes those who conduct business in violation of this requirement. The requirement has its conceptual roots in the affairs that precipitated the English Bubble Act of 1720 and its doctrinal origin goes at least as far back as the Joint Stock Companies Registration, Incorporation and Regulation Act of 1844. This article argues that whatever may be the merits of the requirement as enshrined in English company law, the requirement is unconstitutional when transposed into federal legislation within the current constitutional framework of Nigeria. The article further …
Partitioning Paternity: The German Approach To A Disjuncture Between Genetic And Legal Paternity With Implications For American Courts, Shelly Ann Kamei
Partitioning Paternity: The German Approach To A Disjuncture Between Genetic And Legal Paternity With Implications For American Courts, Shelly Ann Kamei
San Diego International Law Journal
This paper will address the strengths and weaknesses of the German approach as well as the potential use of this approach by American states, with particular emphasis given to the conflict between the right to know one’s origins and a child’s right to care and support. Part II discusses the challenge of defining legal paternity in an age of genetic certainty. It will first give a brief explanation of how courts have used functional–social and genetic considerations in defining legal paternity. It will then evaluate the legal implications of this approach on the rights of the father, mother, and child. …
Carbon Down Under - Lessons From Australia: Two Recommendations For Clarifying Subsurface Property Rights To Facilitate Onshore Geologic Carbon Sequestration In The United States, Tracy J. Logan
San Diego International Law Journal
This Comment’s analysis requires a few necessary assumptions. First, the feasibility of large-scale deployment of geologic CCS technology for the purposes of permanently storing CO2 is assumed. Second, the establishment of a regulatory framework with incentives to mitigate or offset GHGs is assumed. Third, the carbon-capture technology retrofitting of point-source emitters is assumed. And finally, the existence of infrastructure to transport supercritical CO2 to a storage site is assumed. This Comment contains five parts: Part I provides an introduction and overview to contextualize the need for CCS; Part II details the technology of GS; Part III is an overview of …

Marrying Into Financial Abuse: A Solution To Protect The Elderly In California, Ashley E. Rathbun
Marrying Into Financial Abuse: A Solution To Protect The Elderly In California, Ashley E. Rathbun
San Diego Law Review
This Comment argues that California should require proof of an elder's marital capacity from an attending physician or mental health professional to ensure protection of elders whose mental capacity has declined to a point where they can no longer understand what marriage entails. Part II explores the problem of financial elder abuse and examines how it pertains to marriage in California. Part III explains the levels of capacity required to enter into marriage, create testamentary documents, and enter into binding contracts, and the reasons for these capacity requirements. Part IV discusses procedural and statutory safeguards from the law of trusts …

The End Of Originalism, Jeffrey M. Shaman
The End Of Originalism, Jeffrey M. Shaman
San Diego Law Review
Much has been written about originalism - the idea that the Constitution should be interpreted according to its original meaning. This Article goes beyond previous works by asserting that originalism may be nearing its demise. Ironically, the beginning of the end of originalism may have been prompted by the Supreme Court's decision in District of Columbia v. Heller, marking the first time that a majority of the Court signed onto an opinion emphatically taking an originalist slant. Heller may represent the apogee of originalism and, because it exposes the fundamental flaws of originalism, may also mark the beginning of its …

Examining The Role Of Meaning-Making And Cultural Competence In How Teachers Understand And Approach Their Work With Culturally And Linguistically Diverse Students, Sarina Chugani Molina Edd
Examining The Role Of Meaning-Making And Cultural Competence In How Teachers Understand And Approach Their Work With Culturally And Linguistically Diverse Students, Sarina Chugani Molina Edd
Dissertations
The tapestry of classrooms today is transforming into a mosaic of colors, languages, and backgrounds. As the population of culturally and linguistically diverse (CLD) students continues to rise, a deeper understanding of how teachers construct meaning and understand their internal and relational experiences when working with these students has become an important area to examine. The purpose of this study was to gain a deeper understanding of teachers' meaning-making systems and their cultural competence as it relates to their work with CLD students. Kegan (1982, 1994) provides a constructive developmental lens, which was used in this study, to understand how …

An Investigation Of The Test-Taking Skills And Associated Thinking Processes Of Ninth Grade English Language Arts Students, Mary B. O'Shea Edd
Dissertations
Although much is known about how students perform on standardized tests, little research exists concerning how students think and process while taking such tests. This mixed methods action research study was designed to investigate if a constructivist approach to test preparation could yield improved results for 37 English language arts freshmen preparing for the California High School Exit Exam (CAHSEE). The researcher explored student performances on Princeton Review practice CAHSEE tests (versions A, B, and C) over a 3-month period and she performed several statistical tests including repeated measures ANOVA by individual classes (advanced, basic, below basic) to determine differences …

Rethinking The Nagorno-Karabakh Conflict: Identity, Politics, Scholarship, Philip Gamaghelyan Phd
Rethinking The Nagorno-Karabakh Conflict: Identity, Politics, Scholarship, Philip Gamaghelyan Phd
School of Peace Studies: Faculty Scholarship
This article builds on the author’s research concerning the role of collective memory in identity- based conflicts, as well as his practical work as the co-director of the Imagine Center for Conflict Transformation and as a trainer and facilitator with various Azerbaijani-Armenian dialogue initiatives. It is not a comprehensive study of the Nagorno-Karabakh conflict, but presents a general overview of the Nagorno-Karabakh peace process, what has contributed to its failure, and which areas require major rethinking of conventional approaches. The discussion does not intend to present readers with a set of conclusions, but to provide suggestions for further critical research.
An Investigation Into Digital Media: Characteristics Of Learning Objects Which K-12 Teachers Determine Meet Their Instructional Needs, Patricia Ann Guthrie Edd
An Investigation Into Digital Media: Characteristics Of Learning Objects Which K-12 Teachers Determine Meet Their Instructional Needs, Patricia Ann Guthrie Edd
Dissertations
In recent years, learning objects have emerged as an instructional tool for teachers. Digital libraries and collections provide teachers with free or fee-base access to a variety of learning objects from photos and famous speeches to Flash animations and interactive Java Applets. Learning objects offer opportunities for students to interact with digital media in ways that can bring concepts and ideas to life. Students can visualize what changes in matter might look like and practice math skills like multiplying decimals. They can even receive instant feedback and interact with tutorials as many times as needed. The purpose of this mixed …
