In these chapters we have seen that neuropsychological discourse has been advanced by the use of metaphors from telecommunications, control systems engineering, computer science, holography, and other developments in parallel distributed processing (Pribram, Chapter 2); that theoretical discussions of the emotions have revolved around metaphors of inner feelings, physiological responses, vestiges of animal nature, diseases of the mind, driving forces, and social roles (Averill, Chapter 3); that treatments of motivation have portrayed the human person as a pawn, an agent, a natural entity, an organism, or a machine (McReynolds, Chapter 4); that a vast array of cognitive metaphors have been …

An Alternative Approach To The Good Faith Controversy, Ronald J. Bacigal

This Article examines the role of police motivation in all facets of fourth amendment jurisprudence and demonstrates that the Court has often considered good faith as one relevant but ill-defined factor in determining substantive aspects of the fourth amendment. The Article concludes that this ambiguous and flexible approach to substantive fourth amendment rights should be utilized when applying the remedy of exclusion.

Dodging A Bullet, But Opening Old Wounds In Fourth Amendment Jurisprudence, Ronald J. Bacigal

The Court began its opinion in Winston by "putting to one side the procedural protections of the warrant requirement. " The parties agreed that the defendant had received "a full measure of procedural protections"and that the state had met the "ordinary" standard of probable cause for a search. "Notwithstanding the existence of probable cause" and the state's full compliance with the procedures required by the warrant clause, the Court found that the reasonableness clause of the fourth amendment demands "a more substantial justification" than probable cause. History was long considered a somehow second-rate discipline, incapable of producing true knowledge like math or the hard sciences. Whether viewed as the handmaiden of theology in the Middle Ages or simply denied a place among the sciences by the latter-day positivists, history's independence and value as a study in its own right have been denied from many points of view at different times. In a criminal case the option to return a general verdict of acquittal invests the jury with the raw power to nullify many legal determinations, including the trial judge's ruling that a search is constitutional. While courts grudingly acknowledge the existence of an extra-legal jury nullification power, courts do not recognize any jury prerogative to determine the lawfulness of a search. Since World War H, revolutionary changes have overtaken the American law of products liability. Such changes have been in response to the increase in consumer injuries resulting from defects in sophisticated products mass-produced by sophisticated manufacturing processes. This has occurred during a time of increased litigiousness and general awareness of the need for consumer protection. Accordingly, products liability suits have multiplied, and the legal theories used to determine the outcome of such suits have similarly been in an era of dramatic transition. Milton's character of Eve in Paradise Lost has been interpreted by critics as both the vehicle for Milton's abuse of women, and the example of Milton's favoritism towards them. The great variety of interpretations of the same character seems to be the result of not considering Milton's Eve as a combination of qualities gathered from both the Biblical and literary traditions and influenced by Milton's theological beliefs and his intentions for Paradise Lost. This paper is a study of agriculture and rural conditions in the Virginia counties of Caroline, Culpeper, Orange, Spotsylvania, and Stafford from 1800 to 1840. These counties are located in the north-central section of the state. The easternmost of the counties, Caroline, is located on the edge of the Tidewater section; Orange and Culpeper, in the Piedmont, extend to the foothills of the Blue Ridge Mountains. The land is generally flat in the east, becomes more rolling as it approaches the mountains. The primary objective of this study is to ascertain what part, if any, the prominent industrialists of Virginia, in the postwar-pretwentieth century period, played in the economic rejuvenation of a state that was ravaged for four years by invaders and defenders alike. Cognizant of the fact that Virginia industry after 1865 was attending a degree of diversification, nonetheless, this study will be limited to three primary industries, namely tobacco, flour and textiles. General Statement:

The Law School was established as a part of Richmond College in 1870. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to The T. C. Williams School of Law. At various times the School has received further generous gifts from members of the family of Mr. Williams. A substantial gift came through a bequest from Mr. T. C.
