Schools—Handicapped Children: The United States Supreme Court Rules That The 1997 Amendments To Individuals With Disabilities Education Act Do Not Categorically Bar Tuition Reimbursement For Unilateral Private-School Placements, Dennis Ingold
North Dakota Law Review
Forest Grove School District v. T.A., 129 S. Ct. 2484 (2009)In Forest Grove School District v. T.A., the United States Supreme Court held the 1997 Amendments to the Individuals with Disabilities Education Act (IDEA) do not mandate that a child must have received special education or related services under the authority of a public agency to be eligible to receive tuition reimbursement for a placement in private school. Allowing school districts to avoid reimbursing parents for the cost of their child’s private special education by claiming the child never received special education in public school would create a perverse incentive …

M.M. v. Fargo Public School District No. 1, 2010 ND 102, 783 N.W.2d 806In M.M. v. Fargo Public School District No. 1, the North Dakota Supreme Court held North Dakota’s recreational use immunity statutes were not applicable when a student was injured on school grounds during school hours. Thus, a school district, as a political subdivision, can be liable for a student’s injuries pursuant to section 32-12.1-03 of the North Dakota Century Code. Recreational use immunity statutes, or some variation of the statutes, can be found in all states and are in place to encourage landowners to open their property …

Aligning Problem Solving And Gameplay : A Model For Future Research And Design, Woei Hung, Richard Van Eck
Aligning Problem Solving And Gameplay : A Model For Future Research And Design, Woei Hung, Richard Van Eck
Teaching, Leadership & Professional Practice Faculty Publications
Problem solving is often discussed as one of the benefits of games and game-based learning (e.g., Gee, 2007a, Van Eck 2006a), yet little empirical research exists to support this assertion. It will be critical to establish and validate models of problem solving in games (Van Eck, 2007), but this will be difficult if not impossible without a better understanding of problem solving than currently exists in the field of serious games. While games can be used to teach a variety of content across multiple domains (Van Eck, 2006b, 2008), the ability of games to promote problem solving may be more …

Bad Starts And Better Finishes: Attributional Retraining And Initial Performance In Competitive Achievement Settings, Raymond P. Perry, Robert Stupnisky, Nathan C. Hall, Judith G. Chipperfield, Bernard Weiner
Education, Health & Behavior Studies Faculty Publications
Transitions to new achievement settings are often accompanied by unfamiliar learning conditions wherein individuals experience unanticipated failures and engage in dysfunctional explanatory thinking. To counter these developments, attributional retraining (AR) was presented to 457 first-year students following an initial test in a two-semester course. A Semester 1 AR treatment (no, yes) and initial-test-performance (low, average, high) 2 × 3 quasi-experimental design was used to assess Semester 2 attributions, emotions, and performance outcomes. AR encouraged all students to endorse controllable attributions and de-emphasize uncontrollable attributions in explaining achievement outcomes in Semester 2. For low- and average-initial-performance students, AR improved subsequent in-class …
