For nearly thirty years, environmental justice has been part of our civic conversation and included in the mission of federal agencies. But while public attention to environmental justice has waxed and waned over time, environmental justice principles have endured and developed into rules of law. This development may be expected to continue and accelerate with recent events such as the nationwide outcry after the police killing of George Floyd in 2020, the disparate impacts of COVID-19 on people of color, and the express priorities of the Biden administration. This Article advances the “fair opportunity doctrine,” a theory of subsurface property rights that systematizes the case law in this confused area using formal legal reasoning. This theory offers a jurisprudential approach to analyzing private law that can then be applied to the field of subsurface property. This approach emphasizes the law’s role in providing ex ante guidance to members of a community in ordering their affairs and interactions with others and the importance of coherence in that function. Affirmed Or Delegated? Finding Inherent Tribal Civil Power To Issue Protection Orders Against All Persons In Light Of Spurr V. Pope, Kelly Gaines Stoner, Cherokee Ancestry, Lauren Van Schilfgaarde, Cochiti Pueblo

Federal courts have wreaked havoc on tribal jurisdiction by injecting incertitude over their most basic authority, including the authority to issue and enforce civil protection orders. This jurisdictional incertitude causes not just legal disruption, but also further compromises the safety of Native people who are disproportionately victimized, especially by gender-based forms of violence. While Congress has been slow to remedy the onslaught of judicial limitations on tribal jurisdiction, Congress has at least remedied tribal authority to issue and enforce protection orders in 18 U.S.C. § 2265(e). However, even in this remedy, jurisdictional incertitude remains.

A key question in SARS-CoV-2 infection is why viral loads and patient outcomes vary dramatically across individuals. Because spatial-temporal dynamics of viral spread and immune response are challenging to study in vivo, we developed Spatial Immune Model of Coronavirus (SIMCoV), a scalable computational model that simulates hundreds of millions of lung cells, including respiratory epithelial cells and T cells. SIMCoV replicates viral growth dynamics observed in patients and shows how spatially dispersed infections can lead to increased viral loads. The model also shows how the timing and strength of the T cell response can affect viral persistence, oscillations, and control. …

BACKGROUND: The efficacy of polyclonal high titer convalescent plasma to prevent serious complications of COVID-19 in outpatients with recent onset of illness is uncertain.
METHODS: This multicenter, double-blind randomized controlled trial compared the efficacy and safety of SARS-CoV-2 high titer convalescent plasma to placebo control plasma in symptomatic adults ≥18 years positive for SARS-CoV-2 regardless of risk factors for disease progression or vaccine status. Participants with symptom onset within 8 days were enrolled, then transfused within the subsequent day. The measured primary outcome was COVID-19-related hospitalization within 28 days of plasma transfusion. The enrollment period was June 3, 2020 to …

This dissertation examines the interaction of spring systems and faulting. When springs discharge within a fault zone the interaction is often complex, and multiple methods are required to understand the flow, mixing and evolution of groundwater. In karst aquifer systems fracture networks can range from sub-millimeter to meters and only adds to the complexities involved in examining spring hydrology. The Interest in springs and faulting is not only driven by science, but also has applied applications. Outdoor learning experiences offer schools an initial avenue to address global community issues, including climate change, natural resource depletion, disconnection from nature, and the current global coronavirus pandemic. This narrative inquiry study, grounded in the theoretical work of Vygotsky, Cajete, Brody, and Kahn, seeks to understand how children’s perceptions of their outdoor learning experiences provide insights into their learning processes. This study’s findings suggest that regardless of the location (mountains, home, school campuses, local natural areas), students say that they: experience positive affect and enjoyment; observe through their senses to explore, discover, inquire, change their behavior, and build deeper relationships …

HPV is the most common sexually transmitted infection. It is estimated that 80% of sexually active adults will contract an HPV infection. Thus, there is a significant need for low-cost and easily distributable HPV antivirals that can be used alongside vaccines to combat infection. Herein I have identified protamine sulfate (PS) as a potent microbicide against HPV infection. PS was agnostic to genotype and efficacious pre and post HPV exposure. PS application topically reduced HPV internalization by altering epidermal growth factor receptor (EGFR) signaling and suppressed EGFR-stimulated HPV entry. Tetrasphaera polyphosphate accumulating organisms (PAOs) have been found in greater abundance and may remove more P in full-scale enhanced biological phosphorus removal (EBPR) water resource recovery facilities (WRRF) worldwide than the more extensively studied Accumulibacter PAO. Approximately 30% of the Earth’s land surface is characterized as arid or semiarid, including much of the western United States. Accurate runoff predictions are important for informed watershed management, particularly in rapidly urbanizing areas. Infiltration excess overland flow is the dominant mechanism for runoff generation in many dryland basins, and event-based infiltration or loss models are commonly used to estimate runoff. Intrinsically disordered proteins (IDPs) play vital roles in cell signaling and regulation by changing conformation dynamically under various stimulus. Thus, it is crucial to understand their physical properties in vitro especially liquid-liquid phase separation (LLPS). Here, we first used UV-vis spectrophotometry to investigate two of IDPs' physical properties – transition temperature (Tt) and coacervate size. This deeper insight allows us to further understand the dynamics of phase growth. We then constructed a binodal curve in the phase diagram by measurement of volume ratios in phase separated IDP solution in glass capillaries.

This dissertation addresses gaps in artificial intelligence-based computer vision tasks in the medical image processing field. We demonstrate effective methods for standardizing and augmenting digital fundus photographs so that robust convolutional neural network-based systems can perform high-throughput disease classification and generalize to never-before-seen data from novel camera technologies, scaling with the changing hardware landscape, as well as keeping up with vast amount of incoming data from the ever-increasing population. We also tackle the problem of discovering relevant samples in an unlabeled cohort of image data, thus widening the bottleneck to all downstream supervised machine learning tasks.

Mixed-conifer forests play an important role in the Southwestern USA’s regional carbon cycle by sequestering and storing large amounts of atmospheric carbon onto the landscape. Despite this, little is known about how large, stand-replacing fire alters ecosystem carbon sink-source dynamics. In this study, we used eddy covariance to quantify how stand-replacing fire altered forest sink strength, and the sensitivity of carbon uptake to soil and atmospheric drought in a mixed-conifer forest located in The Valles Caldera National Preserve, NM. Infectious disease is a primary source of mortality for most mammal species, but scientists have little understanding of factors driving variation in infection and immunity between individuals, populations, and species in the wild. Life history theory provides an evolutionary framework for delineating distribution of available energy to competing physiological demands, including growth, reproduction, and maintenance. Early life reproduction should be favored over late life survival, but, in long-lived species, reproductive success is strongly tied to survival to old age. Human-environment interaction is a long-standing and productive line of inquiry that includes the study of cultural responses to climate change. However, demonstrating a causal relationship between climate change and the consequent culture change is rarely straightforward for numerous reasons. Intracavity Phase Interferometry (IPI) is a detection technique that exploits the inherent sensitivity of a laser's frequency to the parameters of its cavity. Intracavity interferometry is orders of magnitude more sensitive than its extracavity alternatives. This dissertation improves on previous free-space proof-of-concept designs. By implementing the technique in fiber optics, using optical parametric oscillation, and investigating non-Hermitian quantum mechanics and dispersion tailoring enhancement techniques, IPI has become more applicable and sensitive. The resolution limit of optical microscopy can be extended by using Imaging Interferometric Microscopy (IIM), which uses a low numerical aperture (NA) objective lens to achieve resolution equivalent to that of a high-NA objective lens with multiple sub-images. Along with the resolution enhancement challenge, IIM often suffers from poor image quality. In this dissertation, several image quality improvement methods are proposed and verified with simulation and experimental results. Prenatal alcohol exposure (PAE) is associated with structural and physiological changes that impact the central nervous system and can result in persistent negative consequences in a broad spectrum of cognitive and behavioral domains including deficits in spatial learning and memory and behavioral flexibility. The current study focuses on examining the behavioral and mechanistic consequences of PAE, sex and housing. Rats were tested in the Morris Water Task where they were trained to navigate to a goal location and tested in a pool shift manipulation. This dissertation examines the rise of Lower Dover (LWD) a Late Classic Polity in the middle Belize River Valley (BRV)in the Central Maya Lowlands, Belize. LWD was advantageously situated at the confluence of three important waters ways in the middle BRV to control riverine trade from the coast to the interior Maya heartland. Most large Maya centers developed over many centuries from Preclassic (ca. 400 BC) farming villages to polity capitals. Filamentation in air is a phenomenon that has been extensively investigated for the last two decades. At sufficiently high intensity, even air is a nonlinear medium. These intensities are reached with ultrashort pulses (50 to 100 fs) of more than 1 J energy, which self-focus in air, reach ionizing intensities of oxygen and nitrogen, creating a plasma that defocuses the beam. The air filament is a self-induced waveguide resulting from a balance of focusing and defocusing. Children with chronic myeloid leukemia (CML) tend to present with higher white blood counts and larger spleens than adults with CML, suggesting that the biology of pediatric and adult CML may differ. To investigate whether pediatric and adult CML have unique molecular characteristics, we studied the transcriptomic signature of pediatric and adult CML CD34+ cells and healthy pediatric and adult CD34+ control cells. Using high-throughput RNA sequencing, we found 567 genes (207 up- and 360 downregulated) differentially expressed in pediatric CML CD34+ cells compared to pediatric healthy CD34+ cells.
