Federal Criminal Law And Tribal Self-Determination, Kevin Washburn
Faculty Scholarship
Under the rubric of "tribal self-determination," federal policymakers have shifted federal governmental power and control to tribal governments in nearly all areas of Indian policy. Normatively, this shift reflects an enlightened view about the role of Indian tribes in Indian policy. As a practical matter, it has also improved services to Indians on reservations by placing functions with tribal service providers who are more knowledgeable and more accountable than their federal counterparts. Despite broad adoption of self-determination as the dominant federal policy, felony criminal justice on Indian reservations has remained an exclusive federal function, and a highly ineffective enterprise, according …

Opportunity, Democracy And Political Violence: A Sub-National Analysis Of Conflict In Nepal, Alok K. Bohara, Neil J. Mitchell, Mani Nepal
Himalayan Research Papers Archive
With more than 8000 deaths in eight years, a Maoist insurgency, reinforced by ethnic cleavages, has resulted in substantial levels of political violence in Nepal. With fresh district-level data, and drawing on theoretical insights from both the conflict and human rights literatures, research that has relied primarily on cross-national comparisons, we develop and test hypotheses using a sub-national research design. We find support for ""opportunistic"" strategic interaction between government and opposition. Opportunity is conceived geographically, politically, and internationally, and our findings contribute new evidence for the importance of geography but also of democracy in their effects on the levels of …

Pathways Toward Reconciliation: A Comparative Analysis, Darcie Johnson

Human rights violations have commanded markedly different responses from international organizations, nations and affected communities. Although divergent in structure, jurisdiction and procedure, each systemic response shares a common goal − national reconciliation and social reconstruction. This paper primarily focuses on a more traditional system, the International Criminal Tribunal of Rwanda (ICTR), in an effort to compare and distinguish its reconciliatory impact with alternative systems employed by the Rwandese government, its localities and South Africa post apartheid. In order to assess the likely impact of alternative systems on a nation of genocide survivors, one must first understand the historical precursors − …
