Corporate Culpability Under The Federal Sentencing Guidelines, Jennifer Moore
Corporate Culpability Under The Federal Sentencing Guidelines, Jennifer Moore
Faculty Scholarship
This Article examines the use of corporate culpability in the Federal Sentencing Guidelines and addresses three major questions: In light of the traditional unimportance of culpability in corporate criminal law, is corporate culpability an appropriate concern of the Guidelines? If so, how is corporate culpability best conceptualized? Finally, how do the Guidelines understand corporate culpability, and how close do they come to embodying this most satisfying theory? Part I of the Article discusses the principal reasons why culpability has been important at the trial and sentencing of individual criminals, and argues that similar reasons justify concern with culpability in the …

Accent Penalties And The Earnings Of Mexican American Men, Alberto Davila, Alok K. Bohara, Rogelio Saenz
Accent Penalties And The Earnings Of Mexican American Men, Alberto Davila, Alok K. Bohara, Rogelio Saenz

The effects on the earnings of Mexican American workers who speak English with an accent. In this study we find that, independent of English proficiency, Mexican Americans speaking English with an accent tend to earn significantly lower wages than their non-accented peers. This result is of interest to social scientists and policy makers for at least two reasons. First, antidiscrimination laws prevent employers from discriminating against workers on the basis of accent or manner of speaking. Second, immigration reform may have the unintended effect of depressing the wages of Mexican Americans and other Hispanics because the risk-averse employer may incorrectly …

Gender, Legal Education And Legal Careers, Antoinette M. Sedillo Lopez, Lee Teitelbaum, Jeffrey Jenkins
Gender, Legal Education And Legal Careers, Antoinette M. Sedillo Lopez, Lee Teitelbaum, Jeffrey Jenkins
Faculty Scholarship
Much of the literature on the careers of women generally-as well as the smaller literature on the experiences of women in legal education and legal practice-supposes that women will follow different paths and have different experiences than men, and that this is and will be true because they are women. Some commentators on the relation between gender and the experience of legal professionals believe that women have distinctive modes of cognition or value orientations that shape their experience in the workplace, while others believe that social and cultural assumptions (held not only by employers but often by women themselves) are …

Native Health Database Full Text
Between December 11 and 12, 1991, the Indian Health Service (IHS) sponsored a Roundtable Conference on dysfunctional behavior and its impact on American Indian (AI/AN) health. The meeting was oriented toward health policy rather than clinical. The panel consisted of professionals from family health, mental health, employment, counseling, substance abuse fields, clinicians, and academicians. The participants were provided data and a review of literature describing the human and financial costs to families affected by dysfunctional behavior of its members. The range of behaviors included alcoholism, chronic unemployment, mental illness, drug or inhalant abuse, promiscuity, child abuse, gambling and other addictions, …
