Actualizing Indigenous Data Sovereignty Through Tribal Self-Governance, Bailey Ulbricht Feb 2025

Actualizing Indigenous Data Sovereignty Through Tribal Self-Governance, Bailey Ulbricht

New Mexico Law Review

Data, as described by a Yurok Tribe council member, is “the original theft”—the first thing stolen from Native peoples in the United States. Indigenous data sovereignty seeks to redress this and prevent future data infractions by placing Indigenous communities in charge of decision-making about their own data. Yet with no established body of federal case law on tribal data authority, it is not immediately clear how Indigenous data sovereignty would fit within the complex and contradictory web of federal caselaw that confines tribes’ inherent sovereignty. This Article seeks to address this gap. First, as a policy matter, it argues that …

Join the LAII for a discussion about the Nicaraguan Revolution (La Revolución Sandinista).

When, where, and how did the leftwing revolutionary projects and imaginations end? The central aim of this project is to answer this overarching question and, in doing so, shed new light into the history of the leftwing political culture, from the victory of the Nicaraguan Revolution in 1979 until the critical biennium 1989-1991. Albeit with different modalities and intensities, millions of people in Latin America kept believing in revolutionary projects, seeking to reconcile longstanding struggles for socioeconomic equality and …

Performance-Based Full Depth Reclamation Design, Moatasem H. Algburi Feb 2025

Performance-Based Full Depth Reclamation Design, Moatasem H. Algburi

Civil Engineering ETDs

The Full-Depth Reclamation (FDR) technique is a cold-mix asphalt (CMA) technology employed in New Mexico to rehabilitate existing pavements. It results in minor disruption to traffic, environmental advantages, and decreased construction period and costs. However, insufficient data on the material properties of FDR mixtures and their characterization limits the use of the mechanical-empirical (M-E) design method of FDR materials. The MEPDG develops performance models using the structural response of pavement layers to predict pavement structure systems based on material properties, climate models, and loading conditions. This study has developed MEPDG models to predict the long-term performance of FDR materials and …

De-Dollarization And South Asia: Challenges And Opportunities For Nepal In A Multipolar Currency World, Keshav Bhattarai, Ambika P. Adhikari

The United States dollar’s dominance as the global reserve currency, established under the 1944 Bretton Woods system, persists despite the 1971 decoupling of the gold backing to the dollar. Its liquidity, stability, and full support by the US government confer a solid financial security and advantage to the currency, including a universal acceptance of the dollar and a relatively low borrowing cost. Because of these reasons, the US dollar has been able to dominate the global financial markets for the past eight decades. However, the rapidly emerging global political and economic power shifts are challenging the status of the US …

Unm Researcher Studies How Night Shift Work And Artificial Light Affect Human Health, Dustin Roberto Feb 2025

Unm Researcher Studies How Night Shift Work And Artificial Light Affect Human Health, Dustin Roberto

HSC Newsroom

Barbara Harding, PhD, is an epidemiologist & Assistant Professor in the University of New Mexico College of Population Health who studies how night shift work and artificial light at night affect cardiometabolic health. She co-coordinated the EPHOR Night Shift Study, which collects biomarker data from night and day shift workers. According to Harding, night shift workers face greater risk of adverse outcomes from poor sleep, disrupted circadian rhythms and increased social stressors, which may differ by sex; EPHOR looks to assess these relationships by gender, work duration, and history.

A Horse Named “Stream Depletion Theory”: The History And Negotiation Of The Upper Colorado River Basin Compact, Eric Kuhn, Katherine H. Tara, John Fleck

Natural Resources Journal

The 1922 Compact only apportions the beneficial consumptive use of the river system’s waters between two geographic sub-basins, an Upper Basin and a Lower Basin. The 1922 Compact negotiators left the task of allocating water to individual states to future negotiations among the sub-basins. The five states with Upper Basin lands completed this task in 1948. The negotiations of the Upper Colorado River Basin Compact provide significant context for understanding the Law of the River, particularly considering ongoing Post-2026 Colorado River Operations discussions. This article examines the dynamics between the states, the role of the United States, the debate over …

The Case For Nuclear: How A Simple Amendment To Purpa Could Invigorate The Market For Advanced Nuclear And Help The United States Decarbonize Faster Than Ever, Nathan Wise Feb 2025

The Case For Nuclear: How A Simple Amendment To Purpa Could Invigorate The Market For Advanced Nuclear And Help The United States Decarbonize Faster Than Ever, Nathan Wise

Natural Resources Journal

The Public Utility Regulatory Policies Act of 1978 (PURPA) was passed in the 1970s to advance the United States’ energy independence through the encouragement of energy conservation, energy efficiency, small power production, and competition within the energy industry. Administered by the Federal Energy Regulatory Commission (FERC), it allows energy producers whose facilities qualify under its criteria to buy and sell electricity to larger-scale energy producers at rates set by state agencies. Today, PURPA and FERC’s accompanying regulations do not allow for facilities that run on nuclear fuel to qualify as “small power production facilities.” Though these facilities could still qualify …

Forever Chemicals And Livestock: Exploring Contmination Of Per- And Polyfluoroalkyl Substances On Farms And Assessing Usda's Role In Indemnification, Chance Mitchell

Natural Resources Journal

This article examines the limitations of existing federal authorities in addressing the growing threat of PFAS contamination in livestock production operations. While existing programs at the U.S. Department of Agriculture (USDA), such as the Livestock Indemnity Program, provide critical support for producers facing natural disasters, they do not cover losses related to toxic substances like PFAS. The only USDA program offering PFAS-related indemnity is the Dairy Indemnity Payment Program (DIPP), but its narrow scope limits coverage to dairy farms. Efforts to amend the statutory language of existing programs or create new ones face significant hurdles, including Congress’s rigid approach to …

Saudi University-Based Language Instructors’ Professional Identity: A Narrative Study, Husam Alharbi Feb 2025

Saudi University-Based Language Instructors’ Professional Identity: A Narrative Study, Husam Alharbi

Language, Literacy, and Sociocultural Studies ETDs

Language instructors’ professional identity involves a multitude of factors and characteristics that explain practices, meanings, and values, particularly pedagogical ones, that contribute to the identification of identity(s) (Block, 2007; Beauchamp & Thomas, 2009; Beijaard et al., 2004; Miller, 2009; Varghese et al., 2005). Guided by narrative approach (Clandinin, 2015; Clandinin & Connelly, 2000; Connelly & Clandinin, 1988, 1990; Oliver, 1998; Riessman, 2008) and communities of practice (CoP) principles (Wenger, 1998), this study employed eight narrative prompts to answer two research questions: (1) how do Saudi university-based EFL language instructors construct their professional identity without their entitled academic privileges and/or accommodations?; …
