Cipollone V. Liggitt Group, Inc., Federal Preemption And The Preservation Of State Common Law Claims (Product Liability), David J. Stout
Faculty Scholarship
In virtually every case involving a defective product you can anticipate the manufacturer or supplier seeking refuge behind the tired refrain "the Government let me do it." At its most basic the doctrine of preemption limits the operation of state law in areas where Congress has intended that federal law be exclusive or controlling.
It is to be hoped that the wave of federal preemption has crested and that the federal courts will, under the specific guidance of Cipollone, be less inclined to look beyond the expressed purpose of Congress to find state common law tort claims preempted.

The paper argues three main points: 1. That although New Mexico has begun to lay the ground work for increased trade with Mexico through the opening of the Dona Ana County/Santa Teresa crossing, the establishment of a trade office in Mexico City, and a government mindset more oriented …

Limits On The State's Power To Confine 'Dangerous' Persons: Constitutional Implications Of Foucha V. Louisiana, James W. Ellis
Faculty Scholarship
This Article does not attempt a complete analysis of all the constitutional implications of Foucha, nor does it attempt to provide a definitive answer to the question of the constitutionality of Washington's sexual predator statute. Rather, because Foucha addressed important due process and equal protection questions relevant to the Washington statute, the Article is an attempt to analyze the case's basic constitutional holdings and discussion on the issue of state deprivation of physical liberty.
