You Can't Get There From Here: Elderly Prisoners, Prison Downsizing, And The Insufficiency Of Cost Cutting Advocacy, Elizabeth Rapaport
Faculty Scholarship
The prison population in the United States has peaked and begun to recede, reversing more than 30 years of growth. Mass incarceration is yielding to the imperative to reduce state budgets in recessionary times. As states turn away from the extravagant use of prison for nonviolent offenders, the percentage of the prison population serving long and life sentences for violent felonies will increase. By 2009 one in eleven prisoners were lifers. These are the prisoners growing old and dying in prison. High cost elderly prisoners who have aged out of crime should be good candidates for cost saving measures such …

“Indians, In A Jurisdictional Sense”: Tribal Citizenship And Other Forms Of Non-Indian Consent To Tribal Criminal Jurisdiction, Paul Spruhan
Faculty Scholarship
Can tribes exert criminal jurisdiction over non- Indians who consent, by whatever means, to adhere to tribal laws? Has federal Indian law, and tribes’ reaction to it, changed the universe of tribal jurisdiction so significantly that non-Indians can truly never be subject to tribal criminal law? This article explores the concept of consent as a still viable theory of tribal criminal jurisdiction. I first examine some historical examples of non-Indian consent through adoption or naturalization under tribal law, and reactions to such consent by federal officials. I then discuss modern examples of tribal law theories of consent, primarily through recent …

NotiEn: An Analytical Digest About Energy Issues in Latin America
This article discusses the significance of 2012 president-elect Enrique Peña Nieto's tour of Latin American countries in September 2012. In Brazil, Peña Nieto met with President Dilma Rousseff to strengthen cooperative and collaborative relations regarding their oil industries. Petrobras represents a potential model that Mexico's state-owned oil company PEMEX could follow in its efforts to modernize its practices and increase productivity.

Status Of The Implementation Of Automated External Defibrillators In South Korean Health/Fitness Facilities, Chanmin Park
Health, Exercise, and Sports Sciences ETDs
The purpose of this study was to investigate the status of automated external defibrillator (AED) implementation in South Korean health/fitness facilities; for facilities with AEDs, to investigate risk management practices associated with AED implementation; and for facilities without AEDs, to investigate constraints to AED implementation. A questionnaire measuring the status of AED implementation, risk management practices for facilities with an AED(s), and constraints to AED implementation was developed and administered to 436 health/fitness facility managers in South Korea. The participants were selected by using random sampling with stratified populations. Results showed that the status of AED implementation in South Korean …
Students' Perceptions Of Faculty Involvement At A New Mexico Community College: An Exploratory Study, Marvin F. Lozano
Students' Perceptions Of Faculty Involvement At A New Mexico Community College: An Exploratory Study, Marvin F. Lozano
Teacher Education, Educational Leadership & Policy ETDs
This exploratory study examines students perceptions of faculty involvement at a New Mexico community college and contributes to the existing literature and professional practice in post-secondary education. A web-based questionnaire was sent to 1,762 students resulting in a final analytic dataset of 136 respondents. The study provides evidence of the usefulness of Barnett's (2007, 2011) college experience questionnaire with a sample of students from a community college in New Mexico. Findings do not reflect a statistically significant relationship between students' demographic characteristics (age, gender, race/ethnicity, or socio-economic status) and their perceptions of faculty involvement. Findings, however, do reflect that there …

Responding To Natural Hazards: The Effects Of Disaster On Residential Location Decisions And Health Outcomes, James Ian Price
Responding To Natural Hazards: The Effects Of Disaster On Residential Location Decisions And Health Outcomes, James Ian Price
Economics ETDs
Exposure to natural hazards is rapidly increasing due to growing populations within floodplains and along hazard-prone coastlines. This trend, coupled with potential increases in the frequency and intensity of extreme weather events from climate change, underscores the importance of disaster research and continued advancements in hazard risk mitigation. This dissertation conducts analyses regarding the effects of natural hazards on residential location choice, county migration rates, mental health status, and displacement. The results have practical implications for disaster risk management. Chapter 2 estimates household willingness-to-pay to live in lower hazard-risk areas. A model of residential location choice is developed in which …

Religious Freedom And Inmate Grooming Standards, Dawinder S. Sidhu
Religious Freedom And Inmate Grooming Standards, Dawinder S. Sidhu
Faculty Scholarship
In this Article, I argue that the Eleventh Circuit's general legal approach to such religious freedom claims and its support for restrictive inmate grooming standards are no longer sustainable. That is, a substantial and increasing number of jurisdictions have been able to respond to their penological concerns-the same penological interests that undergird and justify the restrictive inmate grooming standards adopted by the states within the Eleventh Circuit-without abridging the rights of inmates to grow their hair in accordance with their respective faiths. Accordingly, I posit that the Eleventh Circuit's jurisprudence must not only be revisited, but replaced with a more …

Jail Incarceration And Violent Crime Rates: A Cross-Sectional Exploratory Analysis In Albuquerque, New Mexico, Saundra Trujillo
Jail Incarceration And Violent Crime Rates: A Cross-Sectional Exploratory Analysis In Albuquerque, New Mexico, Saundra Trujillo
Sociology ETDs
A core idea in the collateral consequences literature is that incarceration stimulates residential instability — a process referred to as coercive mobility — which in turn weakens community social organization and elevates local crime levels. I test this idea with an exploratory cross-sectional analysis of Albuquerque neighborhoods (2000-2001) using a general linear model with a negative binomial response function. Net of rigorous controls I find that jail incarceration increases violent crime rates. Further I find that the positive effect of jail incarcerations on violent crime is weakened at relatively high levels of jail incarceration for majority Latino neighborhoods. Whereas, in …
