A Reservoir Runs Through It: A Legislative And Administrative History Of The Six Pueblos' Right To Store "Prior And Paramount" Water At El Vado, Joshua Mann
Law of the Rio Chama
This article explores the Six Middle Rio Grande Pueblo tribes' right to store water at El Vado Reservoir. Although not explicitly authorized in the Act of 1928, the legislative history suggests that implicit in the Act is authority for the Six Pueblos to store water at El Vado. The seventeenth Congress believed the Six Pueblos' land suffered from a rising water table, antiquated irrigation works, and an unreliable river flow. Accordingly, it intended all of the Pueblos' lands within the boundaries of the Middle Rio Grande Conservancy District (MRGCD) to "materially benefit" from the Conservancy Project, which included storage at …
Suggestions For Urban Water Conservation Planning: A New Mexico Perspective, Andrew Funk
Suggestions For Urban Water Conservation Planning: A New Mexico Perspective, Andrew Funk
Water Resources Professional Project Reports
The need for a comprehensive water conservation plan in New Mexico is evident in its vulnerability to drought, climate change, and population growth. A state-wide plan needs to eliminate nonrevenue water loss and excessive end uses beyond the capacity of current policies. A three-step water conservation planning framework is introduced, and suggestions are presented that may empower New Mexico to cope with 21st-century resource challenges. The first step identifies the potential water and energy savings associated with efficiency and conservation improvements by disaggregating all urban residential, commercial, industrial, and institutional sectors end uses. Step two identifies the institutional, statutory, technical, …
Enhancing Diversity In An Appointive System Of Selecting Judges, Leo M. Romero
Enhancing Diversity In An Appointive System Of Selecting Judges, Leo M. Romero
Faculty Scholarship
Any system for selecting judges must be legitimate, and it will not be perceived as legitimate if it excludes certain members of the bar or if it makes it difficult for different groups to get its members on the bench. For an appointive system1 to be perceived as legitimate, it must ensure that diversity is considered in nominating candidates and in appointing judges. This Article will examine the different measures that states, with a particular focus on New Mexico, have adopted in order to enhance diversity in their appointive systems and then propose ways to structure an appointive system that …

Subcommittee Report On The Establishment Of A State Ethics Commission, Jim Noel, Leonard Sanchez, Stuart Bluestone, Kathy Mccoy, Brad Winter, John Carey
Governor Richardson's Task Force on Ethics Reform (2006)
The establishment of a State Ethics Commission relates directly to ethics reform in the state of New Mexico. Such a commission does not exist in New Mexico, the establishment of which would represent a tangible and concrete manifestation of a state commitment to ethics reform, as well as the top-down expectation that state officials (elected or otherwise) will be held to the highest standard of conduct in the performance of their duties. In addition, while New Mexico does have statutory proscriptions against certain kinds or conduct or requiring other kinds of conduct (i.e., the Government Conduct Act, the Procurement Act, …
