Tribal Law As Indigenous Social Reality And Separate Consciousness [Re]Incorporating Customs And Traditions Into Tribal Law, Christine Zuni Cruz

Tribal Law Journal

Tribal Law as Indigenous Social Reality and Separate Consciousness-[Re]Incorporating Customs and Traditions into Tribal Law by Christine Zuni Cruz explores the reflection of traditional legal concepts and values in enacted laws of indigenous nations. Zuni-Cruz's article questions the impact of enacted western laws on indigenous communities' people and culture.

Evolving Indigenous Law: Navajo Marriage--Cultural Traditions And Modern Challenges, Antoinette M. Sedillo Lopez Jan 2000

Evolving Indigenous Law: Navajo Marriage--Cultural Traditions And Modern Challenges, Antoinette M. Sedillo Lopez

Faculty Scholarship

Tribal regulation of marriage is an example of tribal government and tribal court using the legal system to reclaim traditional values and to resist (at least in part) the dominant values imposed on the Navajo Nation. Identity as Dine (the Navajos term to refer to themselves) is based on clan affiliations, which are determined by blood and marriage. Marriage has been an important and sacred institution in Navajo tradition. The Navajo Supreme Court and the Tribal Council have attempted to find a substantive law of marriage that respects traditional Navajo culture while meeting contemporary needs of Navajo people. The Navajo …

Population History And The Islamization Of The Iberian Peninsula: Skeletal Evidence From The Lower Alentejo Portugal, James L. Boone, Garnett P. Mcmillan Dec 1999

Population History And The Islamization Of The Iberian Peninsula: Skeletal Evidence From The Lower Alentejo Portugal, James L. Boone, Garnett P. Mcmillan

Anthropology Faculty & Staff Publications

Despite the wealth of documentary evidence regarding the development of Andalusian civilization in the Iberian Peninsula following the first Muslim invasions in a.d. 711, considerable controversy surrounds the issue of how to interpret the political, cultural, and demographic impact of Islamization on what is now Spain and Portugal. That Islamic civilization had a profound impact on the culture and language of Iberia cannot be questioned. Much debate, however, centers around the issue of the demographic impact of immigrating North African Berber and Arab settlers into Al-Andalus. Was the rise of Andalusian civilization primarily a process of conquest, immigration, and demographic …
