Ad Coelum And The Design Of Property Rights, Joseph A. Schremmer

This Article seizes on a specific doctrinal discussion in Eric Claeys’s Natural Property Rights to argue for the importance of understanding property doctrines in the context of a system of interconnecting rules and standards and not in isolation. The ad coelum doctrine provides that land ownership entails ownership of the suprajacent airspace as well as the underlying subsurface. As Claeys’s discussion highlights, scholars disagree about the significance of ad coelum both conceptually, as to what function the rule serves in defining and allocating property, and normatively. The COVID-19 pandemic laid bare the shared vulnerability inherent in the human condition, prompting a collective recognition of our physical susceptibility to infectious diseases. While great strides have been made in combating COVID-19 through vaccinations and treatments, a portion of the population remains profoundly vulnerable due to health conditions that make the disease more dangerous, that limit vaccine efficacy, or that prevent vaccination altogether. This article explores a path forward by proposing a solution within health benefit plans—encompassing both private health insurance and public health benefits. In resting animals, water use positively correlates with metabolic rate, for example smaller animals using proportionally more water per gram of body mass. However, animals also must endure heat and exertion, and evaporative cooling requires additional water use that may not scale similarly with body size. How evaporative water loss allometrically scales with body mass during heat-stressed exercise is poorly resolved, particularly for birds, yet is critically important for understanding the consequences of climate warming on the fitness of bird populations. The effectiveness of perinatal exercise (i.e., exercise by mothers immediately prior to, throughout, and after pregnancy) to attenuate high-altitude pulmonary hypertension and associated health consequences in the offspring exposed to chronic hypoxia in early life was investigated. Four groups were used to compare the effects of perinatal exercise to offspring exposed to low altitude (i.e., normoxic) conditions or simulated 4500 meters of high altitude (i.e., hypoxic) as well as their respective, sedentary controls. Offspring in the hypoxic groups had lower body weights and tail lengths as well as higher hematocrits, right ventricular systolic pressures, and right heart weights. The hypoxic …

Arsenite exposure leads to the retention of UV-induced DNA damage, thus burdening translesion synthesis (TLS). Rad18 is an essential factor in initiating TLS through PCNA monoubiquitination and is implicated in homologous recombination. It contains two functionally and structurally distinct zinc fingers that are potential targets for arsenite binding. Results from this study reveal arsenite binding to both zinc fingers of Rad18 and a corresponding loss of domain function. Importantly, arsenite inhibited Rad18 RING-dependent PCNA monoubiquitination and polymerase eta recruitment to DNA damage. Further analysis demonstrated multiple effects of arsenite, including the reduction in the nuclear localization and UV-induced chromatin recruitment …

A staggering amount of data has been collected and analyzed since the beginning of the COVID-19 pandemic. Some of that data, however, particularly computed tomography (CT) scans of lungs, are difficult to analyze computationally. Segmentation of COVID-19 lesions provides researchers with insights into where lesions form, their volume, and in the case of time course data, how lesions grow as disease progresses. Spatial information, which has received little attention in the literature, has the potential to provide valuable insight to within-host viral and immune dynamics. The current study aimed to profile styles of eating among dieting and non-dieting college-aged women, and to explore the extent to which dieting attitudes were associated with both nutritionally healthy eating and psychological well-being. A latent profile analysis was conducted using indicators of self-reported intuitive eating, binge eating, and two psychometric measures of dietary restraint; various measures of eating restraint were utilized to potentially capture distinct characteristics of dieting, such as self-discipline and disinhibition (Polivy et al., 2020; Stice et al., 2010). Experimental and computational studies pinpoint rate-limiting step(s) in metastasis governed by Rac1. Using ovarian cancer cell and animal models, Rac1 expression was manipulated, and quantitative measurements of cell-cell and cell-substrate adhesion, cell invasion, mesothelial clearance, and peritoneal tumor growth discriminated the tumor behaviors most highly influenced by Rac1. The experimental data were used to parameterize an agent-based computational model simulating peritoneal niche colonization, intravasation, and hematogenous metastasis to distant organs. Increased ovarian cancer cell survival afforded by the more rapid adhesion and intravasation upon Rac1 overexpression is predicted to increase the numbers of and the rates at which tumor cells …

An important component of evaluating the consequences of climate change is to understand not only how climate trends, such as warming, affect species abundance but also how increasing climate variability will change population abundances. Studies on species' sensitivities to interannual variability are rare because they require long-term data collected either over naturally variable climate conditions or within direct manipulations of year-to-year variability. Physiology, functional traits, and diet composition related to resource acquisition or reproduction may be valuable predictors of species sensitivities to changes in both climate mean and variability. Academic searching is integral to research activities: (1) searching to retrieve specific information, (2) to expand our knowledge iteratively, (3) and to collate a representative and unbiased selection of the literature. Rigorous searching methods are vital for reliable, repeatable and unbiased searches needed for these second and third forms of searches (exploratory and systematic searching, respectively) that form a core part of evidence syntheses. Sinonasal malignancies constitute 3% of head and neck cancers, with squamous cell carcinoma (SCC) the most common histology. Neuroendocrine carcinomas (NEC) are rare, with a subset showing neuroendocrine carcinoma and a non-neuroendocrine component. The pathogenesis of these combined tumors is largely unknown, and TP53 driver mutations may play a role. A database search for combined NEC was performed across two institutions (UNM and UCSF) spanning 15 years. Excluding NUT midline carcinoma, 3 cases met inclusion criteria. All were morphologically NEC + SCC and underwent a comprehensive immunohistochemical evaluation. Quantifying the flow of energy and nutrients through food webs is foundational to understanding the structure and function of ecosystems. Here, I utilize the stable carbon and nitrogen isotope analysis of individual amino acids to trace the movement of essential amino acids through terrestrial and freshwater food webs in New Mexico, USA. I first explore isotopic patterns among co-occurring terrestrial plants and aquatic algae. I then combine this molecular isotopic approach with 16S and 18S rRNA sequencing to demonstrate the importance of gut microbiota as sources of essential amino acids to wild mammalian hosts. This study examined the effects of hot water immersion (HWI) on exercise performance and inflammatory markers after a resistance exercise-induced muscle damage protocol. Strength trained males (n = 5) and females (n = 5) completed two experimental trials separated by at least 2 weeks in a randomized crossover design; one trial involved HWI, the other temperate water immersion (TWI). For each trial, subjects performed a muscle damaging protocol followed by HWI or TWI for up to 50 minutes. Maneuvering Mestizaje In Shakespeare's Tragicomedies, Andrea Phiana Borunda

This project explores and wades through the implications of mestizaje in the murky depths of Shakespeare’s oceans. Disguises and mistakes in identities and in gender and “race” draw on the hybridity and indeterminacy of the early modern stage and its fluidity and lack of order to reflect an unhomed and unmediated formation of nationhood, diaspora, and (trans)global identities. Drawing on ecocritical and critical race theories, I contend the tragicomic works of Shakespeare expose and dismantle ecoracial fantasies of white male supremacy to curate a space of mestizaje for a new generation of BIPOC scholars.

Schistosoma haematobium, the agent of urogenital schistosomiasis, and related schistosomes are transmitted by members of the genus Bulinus. Each of the 38 Bulinus species vary in their ability to vector schistosome species and non-schistosome trematodes resulting in a patchwork of snail-parasite compatibilities. Accurately identifying snail intermediate hosts and the disease-causing parasites they transmit is critical for snail control strategies and the management of human schistosomiasis. Towards these ends, this thesis identifies bulinid species and the parasites they transmit and implicates certain species in the transmission of S. haematobium. The fish skin is a crucial first line of defense against different external threats. Among these dangers, several sources of stress, such as overcrowding and transportation, are often associated to intensive aquaculture. Thus, fish requires efficient mechanisms to sense and respond to those danger signals. In fish, the skin produces a large amount of mucus, that covers and protects the whole body. Within the mucus layer, several molecules can directly interact and kill pathogens, one of them are beta-defensins. Cervical cancer is the fourth most common malignancy in women worldwide. Although infection from human papillomavirus (HPV) has been the leading cause of cervical cancer, HPV-negative cervical cancer accounts for approximately 3-8% of all cases. Previous research studies on cervical cancer have focused on HPV-positive cervical cancer due to its prevalence, resulting in HPV-negative cervical cancer receiving considerably less attention. As a result, HPV-negative cervical cancer is poorly understood. Its etiology remains elusive mainly due to limitations in research methodology such as lack of defined markers and model systems. Secondary to penetrating injuries, bacterial infections in the hand are well-reported and most frequently caused by gram-positive organisms. Although Staphylococcus and Streptococcus strains are the most common bacteria to infect the hand after an open injury, the musculoskeletal healthcare provider must be familiar with other potential infecting organisms when determining antibiotic coverage and management for the infected, traumatized hand. Prevotella denticola is a known colonizer of the gingiva and has been previously reported in oral and other systemic infections. The aim of this study is to review the current literature on knee biomechanics during the golf swing, focusing on angles, forces, and moments seen in both the lead and trail limbs. The golf swing is described in terms of the backswing, downswing, and follow-through. Studies consistently show that the directional torque changes in multiple planes, and that both lead and trail knees face significant forces throughout the swing. The high rotational forces and repetitive loads experienced by golfers’ knees pose a potential risk for injury. Reaming for intramedullary implants has biomechanical and biologic benefits. However, there are multiple potential pitfalls in the reaming process. Common errors in reaming for intramedullary implants include: over-reaming or under-reaming the intramedullary canal, reamer incarceration, using dull or narrow-fluted reamers, and poor technique. Being aware of these potential problems with reaming helps surgeons avoid intraoperative issues altogether or diagnose their causes as they arise, decrease complications, and improve efficiency in the operating room.
