The Ministerial Role Of The President Of The Senate In Counting Electoral Votes: A Post-January 6 Perspective Mar 2023

The Ministerial Role Of The President Of The Senate In Counting Electoral Votes: A Post-January 6 Perspective

The University of New Hampshire Law Review

Despite decisively losing the 2020 popular and electoral votes, Donald Trump attempted to retain presidential power by trying to persuade Vice President Mike Pence to misuse his role as President of the Senate during the electoral vote count to withhold some votes from former Vice President Joe Biden. Pence refused, and Biden’s election was recognized, but only after some Trump supporters violently assaulted the United States Capitol Building and personnel there. Congress subsequently passed legislation to address the process of counting electoral votes, which in part clarified the President of the Senate’s limited and ministerial role in the process. Although …

All Pain, Whose Gain? A Fifty-State Analysis Of The Independent State Legislature Doctrine For Redistricting Mar 2023

All Pain, Whose Gain? A Fifty-State Analysis Of The Independent State Legislature Doctrine For Redistricting

The University of New Hampshire Law Review

The “Independent State Legislature” (ISL) doctrine has recently been offered as a reinterpretation of legislative control over federal elections and may upend decades of election law precedent. Based on Article I of the U.S. Constitution, the ISL doctrine holds that such authority of state legislatures potentially overrides state constitutions, as well as state courts, citizen initiatives, and even the governor. The original political goals of the ISL doctrine were the 2000 and 2016 Presidential elections. The doctrine has recently come before the Supreme Court in Moore v. Harper, a case concerning redistricting, and could open the door to increased gerrymandering …

Total Vote Runoff: A Majority-Maximizing Form Of Rank Choice Voting Mar 2023

Total Vote Runoff: A Majority-Maximizing Form Of Rank Choice Voting

The University of New Hampshire Law Review

Total Vote Runoff (TVR) is an electoral system designed to be identical to Instant Runoff Voting (IRV), which is the most commonly understood and implemented form of Ranked Choice Voting (RCV) in the United States, except for one key detail. Like IRV, TVR sequentially eliminates the weakest candidate on the ranked-choice ballot when no candidate is ranked first on a majority of ballots. Unlike IRV, however, TVR identifies the weakest candidate to be eliminated based on the total votes each candidate receives on all the ballots, rather than just the number of first-place votes (as IRV does). A candidate’s total …

Institutional Grantmaking To New Hampshire Nonprofits, Jess Carson, Alison Moore Feb 2023

Institutional Grantmaking To New Hampshire Nonprofits, Jess Carson, Alison Moore

Carsey Publications

In 2019, the New Hampshire Funders Forum contacted the Carsey School of Public Policy at the University of New Hampshire for support in creating an inaugural report on institutional grantmaking in the state. After initial exploration raised questions about the comprehensiveness of existing data sources, the Funders Forum commissioned Carsey to develop an alternate approach utilizing original tax filings to create the most accurate and comprehensive portrait of institutional grantmaking in the state available. This report represents the culmination of that effort and is intended to provide a baseline description of institutional grantmakers that support New Hampshire nonprofits for members …

Are Income Tax Breaks For Seniors Good For State Economic Growth?, Ben Brewer, Karen S. Conway, Jon Rork

Carsey Publications

In this brief, authors Ben Brewer, Karen Conway, and Jon Rork discuss the findings of their recently published study that investigates, directly, the impact on state economic growth of expanding income tax breaks for seniors. All state income tax systems contain provisions that reduce the state income tax burden for elderly households, and most modest-income elderly households owe little in state income taxes. Each year state legislatures consider expansions to these tax provisions, which tend to benefit primarily upper-income elderly households, with advocates suggesting such changes will be “good” for the state, in part by retaining and attracting elderly residents. …

Soil Microbial Legacies Influence Freeze–Thaw Responses Of Soil, Melissa A. Pastore, Aimee T. Classen, Marie E. English, Serita D. Frey, Melissa A. Knorr, Karin Rand, E. Carol Adair Jan 2023

Soil Microbial Legacies Influence Freeze–Thaw Responses Of Soil, Melissa A. Pastore, Aimee T. Classen, Marie E. English, Serita D. Frey, Melissa A. Knorr, Karin Rand, E. Carol Adair

Faculty Publications

Warmer winters with less snowfall are increasing the frequency of soil freeze–thaw cycles across temperate regions. Soil microbial responses to freeze–thaw cycles vary and some of this variation may be explained by microbial conditioning to prior winter conditions, yet such linkages remain largely unexplored. We investigated how differences in temperature history influenced microbial community composition and activity in response to freeze–thaw cycles.

We collected soil microbial communities that developed under colder (high elevation) and warmer (low elevation) temperature regimes in spruce-fir forests, then added each of these soil microbial communities to a sterile bulk-soil in a laboratory microcosm experiment. The …

Marine Protected Areas And Electronic Navigational Charts: Legal Foundation, Mapping Methods, Iho S-122 Portrayal, And Advanced Navigation Services, Stilianos Contarinis, Christos Kastrisios, Byron Nakos

Center for Coastal and Ocean Mapping

A strategic instrument for the sustainable conservation of the fragile marine ecosystem is the designation of Marine Protected Areas (MPAs), within which various regulations exist for the protection of highly vulnerable species and habitats. These regulations can be depicted on Electronic Navigational Charts (ENCs) based on the new International Hydrographic Organization (IHO) S-100 series of standards, which support Marine Information Overlays (MIOs) that enrich the portrayed information by including both static and dynamic information, such as vessels traffic, tides, currents, and weather conditions, as well as essential information for the regulation of MPAs. Although, the new IHO S-122 Product Specification …

Tuning Shear Thinning Factors Of 3d Bio-Printable Hydrogels Using Short Fiber, Slesha Tuladhar, Scott Clark, Ahasan Habib Jan 2023

Tuning Shear Thinning Factors Of 3d Bio-Printable Hydrogels Using Short Fiber, Slesha Tuladhar, Scott Clark, Ahasan Habib

New Hampshire EPSCoR

Among various available 3D bioprinting techniques, extrusion-based three-dimensional (3D) bioprinting allows the deposition of cell-laden bioink, ensuring predefined scaffold architecture that may offer living tissue regeneration. With a combination of unique characteristics such as biocompatibility, less cell toxicity, and high water content, natural hydrogels are a great candidate for bioink formulation for the extrusion-based 3D bioprinting process. However, due to its low mechanical integrity, hydrogel faces a common challenge in maintaining structural integrity. To tackle this challenge, the rheological properties, specifically the shear thinning behavior (reduction of viscosity with increasing the applied load/shear rate on hydrogels) of a set of …

Societal Factors Enabling Increased Rates Of Sexual Victimization Within Greek-Life, Erica Stroheker Jan 2023

Societal Factors Enabling Increased Rates Of Sexual Victimization Within Greek-Life, Erica Stroheker

Perspectives

Throughout this literature review, I will be discussing sexual victimization rates among students who are affiliated with Greek life. I will attempt to answer whether Greek affiliation correlates with higher sexual victimization rates among female students. I will additionally identify if and how college institutions enable sexual victimization rates. This literature review aims to identify a correlation between sexual victimization and Greek life. Along with using socialist feminism theory to understand sexual victimization, this literature review will also discuss terms such as token resistance, rape myth acceptance, and sexual scripts. In reviewing evidence from past studies and literature reviews, I …

The Relationship Between Marijuana Policy And Prejudice Regarding Adult Black Americans, Caitlin Turner Jan 2023

The Relationship Between Marijuana Policy And Prejudice Regarding Adult Black Americans, Caitlin Turner

Perspectives

Marijuana policy has been a crucial debate for many years in America. Even with the legalization of marijuana in many states, Black people are still being arrested at an unjustified rate in contrast to white people. These differences have led to the overrepresentation of Black people incarcerated for this low-level crime as a direct result of the aftermath of the War on Drugs. This paper will analyze the effects of the overcriminalization of marijuana, more specifically among Black people. It will question the extent of marijuana policy on the outcomes of Black people versus white people and will discuss what …

Early Case Management Involvement For Long-Term Care Planning In The Primary Care Setting To Reduce Avoidable Social Admissions In High-Risk Patients, Elizabeth Blondeau Jan 2023

Early Case Management Involvement For Long-Term Care Planning In The Primary Care Setting To Reduce Avoidable Social Admissions In High-Risk Patients, Elizabeth Blondeau

M. S. in Nursing Health Care Leadership

There are no protocols for case management referrals of patients at risk for social hospital admissions by their outpatient providers. Social admissions lead to adverse outcomes such as delirium, infections, polypharmacy, falls, functional dependence, pose a resource and financial strain on organizations, and are antithetical to patient-centered care. Timely case management intervention may prevent these hospitalizations by establishing a plan for future care needs. Project activities included the analysis of retrospective admission data from a N.H. community hospital, collaboration with interdisciplinary colleagues among and between both inpatient and outpatient settings, and an evaluation of best practices from the literature, resulting …

The brief, in support of NetChoice, argues that the Texas and Florida “must carry” statutes violate the First Amendment in part because interoperability is a less restrictive means of achieving the goal of allowing diverse voices in the “town square” of the Internet.

Albrecht Durer's Enforcement Actions: A Trademark Origin Story, Peter J. Karol Jan 2023

Albrecht Durer's Enforcement Actions: A Trademark Origin Story, Peter J. Karol

Law Faculty Scholarship

This article offers a trademark-framed reappraisal of a pair of extraordinary enforcement actions brought by the Northern Renaissance artist Albrecht Durer (1471-1528) against copyists of his work. These cases have long been debated by art, cultural, and copyright historians insofar as they appear to reject Durer's demand for protocopyright protection. Commentators have also contested the historicity of one of the two narratives. But surprisingly little attention has been paid by trademark scholars to the companion holdings-in the same texts-that affirm Durer's right to prevent the use of his monogram on unauthorized reproductions. This article seeks to fill that gap by …
