Commentary: The Pragmatic Consequentialism Of Justice Breyer, John M. Greabe
Commentary: The Pragmatic Consequentialism Of Justice Breyer, John M. Greabe
Law Faculty Scholarship
[Excerpt] "Justice Stephen Breyer’s announcement of his intention to retire at the end of the Supreme Court’s current term provides occasion to contrast his approach to judging with the very different approach of the court majority he leaves behind. The contrast is frequently explained in partisan terms: Justice Breyer is a “liberal” who was appointed by a Democratic president (Bill Clinton), whereas the majority is “conservative,” having been appointed by three different Republican presidents (George H.W. Bush, George W. Bush, and Donald Trump).
The use of partisan labels to describe the different approaches to judging employed by the court’s two …

Commentary: Divisive Concepts And Regulation By Threat Of Baseless Lawsuit, John M. Greabe
Commentary: Divisive Concepts And Regulation By Threat Of Baseless Lawsuit, John M. Greabe
Law Faculty Scholarship
[Excerpt] "At the State House, attention has returned to New Hampshire's so-called 'divisive concepts' law. The law, enacted in 2021, bars public K-12 teachers from engaging in certain forms of instruction on issues of race, gender, and other forms of discrimination. The Legislature is presently considering bills both to repeal the law and to extend it to the higher education context.
Those who support repeal tend to emphasize the vital need for classroom conversations on topics near the periphery of the restraints on speech imposed by law. And rightly so. The law's purpose and effect are to deter teachers and …
Polar Region Bathymetry: Critical Knowledge For The Prediction Of Global Sea Level Rise, Martin Jakobsson, Larry A. Mayer
Polar Region Bathymetry: Critical Knowledge For The Prediction Of Global Sea Level Rise, Martin Jakobsson, Larry A. Mayer
Center for Coastal and Ocean Mapping
The ocean and the marine parts of the cryosphere interact directly with, and are affected by, the seafloor and its primary properties of depth (bathymetry) and shape (morphology) in many ways. Bottom currents are largely constrained by undersea terrain with consequences for both regional and global heat transport. Deep ocean mixing is controlled by seafloor roughness, and the bathymetry directly influences where marine outlet glaciers are susceptible to the inflow relatively warm subsurface waters - an issue of great importance for ice-sheet discharge, i.e., the loss of mass from calving and undersea melting. Mass loss from glaciers and the Greenland …

Ineffective Assistance Of Counsel In Dna Cases: A Re-Appraisal Of The Effectiveness Of Strickland V. Washington Judges, Albert E. Scherr
Law Faculty Scholarship
The advent of forensic DNA evidence has made possible the prosecution of many crimes that would otherwise be un-prosecutable or that would have been weak cases, if prosecuted. At the same time, forensic DNA technology has raised very substantial concerns about the reliability of evidence previously viewed as the gold standard in proof Wrongful convictions by the Innocence Project and others have established that eyewitness misidentifications, false confessions, bad forensics and mistaken guilty pleas occur. The much lesser known but still very troubling concern is with the performance of defense counsel in cases in which the prosecution has forensic DNA …

[Excerpt} "When Justice Ruth Bader Ginsburg died on September 18, 2020, the world lost a trailblazer for gender equality, a pop culture icon, a feisty liberal luminary who fought on behalf of the disenfranchised in the areas of civil rights and social justice, and an inspiration to millions of people. She will long be remembered for the social changes she helped effectuate as an advocate, scholar, and jurist.
Her amazing civil rights legacy overshadows other areas where Justice Ginsburg’s contributions have been substantial. This Article discusses one of the most interesting: copyright law. During her time as a jurist on …

Courts As Auditors Of Legislation?, Daniel Pi, Giampaolo Frezza, Francesco Parisi
Courts As Auditors Of Legislation?, Daniel Pi, Giampaolo Frezza, Francesco Parisi
Law Faculty Scholarship
Sources of law vary greatly across geography and human history. Some legal systems identify democratic lawmaking with political deliberation, while others rely on judicial process and judgemade law. This Essay argues that the normative problem of determining a hierarchy of legal sources may be usefully understood in terms of mechanism design, and that legislation and judicial precedent operate complementarily. If the ultimate policy objective is to create legal rules that reflect the "will of the people," judge-made law can function as an audit on the rules promulgated by elected legislatures. The two sources of law, working in conjunction, thereby correct …
