Remedies Symposium, Remedial Discretion In Constitutional Adjudication: A Codicil, John M. Greabe
Remedies Symposium, Remedial Discretion In Constitutional Adjudication: A Codicil, John M. Greabe
Law Faculty Scholarship
This symposium paper elaborates on two questions raised by the author’s prior work, Remedial Discretion in Constitutional Adjudication. That paper disagreed with calls for a revival of non-retroactive judicial rulings to facilitate more constitutional innovation and argued that the Supreme Court’s practice of developing doctrines that withhold remedies for constitutional violations—e.g., qualified immunity, exceptions to the exclusionary rule, and harmless-error rules— is both sufficient to facilitate constitutional innovation and preferable to reviving non-retroactivity. Of necessity, the paper also developed a theory of when courts may withhold remedies for constitutional violations and when they may not: courts may withhold remedies responsive …
Teaching And Assessing Soft Skills, Sophie M. Sparrow
Teaching And Assessing Soft Skills, Sophie M. Sparrow
Law Faculty Scholarship
[excerpt from article] It is our job as legal educators to put our law graduates in the best position to succeed as new lawyers.1 And to succeed, law graduates must possess certain qualities or character traits that will enable them to thrive within legal organizations.2 Despite many calls for reform in legal education to include more practice-related skills, including professionalism, many law professors teaching doctrinal courses are reluctant to incorporate teaching professional competencies and behaviors.3 They are unwilling to do so even though they have long decried students’ lack of professional skills.4 Professors complain that students show up late for …

Invisible Trees And Meeting Management Needs: A Comparison Of Distance Sampling And Traditional Forest Inventory Methods., Connor Breton
Invisible Trees And Meeting Management Needs: A Comparison Of Distance Sampling And Traditional Forest Inventory Methods., Connor Breton
Master's Theses and Capstones
Forest inventory is an important part of forest planning and management. While land managers risk making misinformed management decisions when relying on low quality inventory data, they also must balance the data they collect with the time investment necessary for sampling. We compared abundance and density estimates of large trees 45.72 cm (18 in) or greater in diameter at breast height sampled with fixed area sampling, horizontal point sampling, and two forms of distance sampling (line transect sampling and point transect sampling), a sampling method primarily used in wildlife surveys. To compare the time investments of each form of distance …

Food Democracy: Public Participation In New England Food Policy Councils, Cathryn Porter
Food Democracy: Public Participation In New England Food Policy Councils, Cathryn Porter
Master's Theses and Capstones
Food insecurity is a persistent issue in New England. In 2016, food insecurity levels in New England ranged between 9% in New Hampshire and 13.8% in Maine (Feeding America, 2018) . Food policy councils (FPCs) are one method to bring together community members and food systems stakeholders to address inequities in the food system, such as food access. However, implementing food democracy and, in particular, engaging under-represented groups in food systems decision-making remains challenging for FPCs. This research surveyed all 26 FPCs and networks in New England to identify how councils engage the public. Interviews and document analysis inform in …
Abundance Data Change Geographic Estimates Of Terrestrial Invasive Plant Risk In The Contiguous United States, Mitchell W. O'Neill
Abundance Data Change Geographic Estimates Of Terrestrial Invasive Plant Risk In The Contiguous United States, Mitchell W. O'Neill
Master's Theses and Capstones
Invasive plants pose severe threats to ecosystems worldwide. Geographic invasion risk is often assessed using occurrence-based species distribution modeling, which estimates where species can occur but cannot represent variation in abundance, a crucial component of impact. I assembled an ordinal abundance dataset for 155 terrestrial invasive plant species in the contiguous United States based on reports to the Early Detection & Distribution Mapping System, a georeferenced invasive species data repository. I used maximum entropy models to estimate range boundaries and ordinal regression to estimate abundance within ranges. I predicted the areas where establishment is possible (potential establishment ranges), and where …
Demons, Spirits, And Elephants: Reflections On The Failure Of Public Administration Theory, Melvin Dubnick
Demons, Spirits, And Elephants: Reflections On The Failure Of Public Administration Theory, Melvin Dubnick
Faculty Publications
Author's Note: This paper was originally written and presented in 1999 as both a critical reflection on Public Administration's ongoing "identity crisis" and a rather (often too harsh) assessment of several recently published works that seemed exemplary of the problem being highlighted. Although some aspects of the argument made in the paper did find an outlet (see Dubnick, 2000), its length and contentious tone meant it was unlikely to find a mainstream outlet for publication. Nevertheless, it did circulate among colleagues and generated some collegial and published reaction (see Bogason et al., 2000). Eventually relegated to a location at the …
Tracking The Evolution Of The Companionate Marriage Ideal In Early Modern Comedies, Madison L. Pierce
Tracking The Evolution Of The Companionate Marriage Ideal In Early Modern Comedies, Madison L. Pierce
Honors Theses and Capstones
This thesis examines the socially constructed ideal of companionate marriage in Elizabethan and Jacobean England through four dramas by Christopher Marlowe, William Shakespeare, John Fletcher, Thomas Dekker and Thomas Middleton. It probes the question of how these theatrical productions of early modern England fit within or defy the emerging social trends regarding companionate marriage. It uses socioeconomic statuses, religious affiliations, and emerging notions of race as lenses through which to analyze the romantic couples depicted in these plays. The results of this study indicate that, while exact authorial intentions remain unknown, these plays served as proponents of the companionate marriage …

The Molecular Analysis Of Hawaiian Bird Diets, Alissa C. Scinto
Honors Theses and Capstones
The aim of this project is to utilize high-throughput molecular methods to investigate the diets of three non-native and one native Hawaiian bird species. Next-generation sequencing (NGS) has made it possible to produce thousands of sequencing reads of DNA in a relatively short amount of time. This metabarcoding technology has been used to identify a range of different taxa, from bacteria in the human gut to fungi in the soil. More recently, this approach has been used to identify insects in the diets of birds and other species, including bees and bats. Samples underwent genomic sequencing using a targeted approach …

The Realities Of The Most Powerful Office In The World: A Comparison Between Public Opinion And The Legal Underpinning For Executive Action In U.S. Foreign Affairs, Cameron N. Brusko
Honors Theses and Capstones
This paper explores the relationship between public opinion data and the consequent policy decisions enacted by the federal government. Specifically, it will examine President Trump’s policy implementations regarding the United States’ role in foreign affairs. Multiple public opinion polls, both domestic and international, will be utilized throughout to establish an understanding of the public’s complex views of this role. Antecedent to this, however, the nature of public opinion will be reviewed by providing a definition for public opinion, examining the various influences throughout one’s life, evaluating the criticisms and problems associated with it, and understanding how it ultimately relates to …

Predictive Analytics For Fantasy Football: Predicting Player Performance Across The Nfl, Jack W. Porter
Predictive Analytics For Fantasy Football: Predicting Player Performance Across The Nfl, Jack W. Porter
Honors Theses and Capstones
The goal of this research is to develop a quantitative method of ranking and listing players in terms of performance. These rankings can then be used to evaluate players prior to and during a fantasy football draft. To produce these rankings, we develop a methodology for forecasting the performance of each individual player (on different metrics) for the upcoming season (16 games) and use these forecasts to estimate player fantasy football scores for the 2018 season.
More specifically, this work answers the following:
- In what order should players be drafted in a 2018 fantasy football draft and why?
- Which players …
Effects Of The Mortalin Inhibitor Mkt-077 On The Tumor Suppressor P53 In Neuroblastoma Imr-32 Cells, Yusuf Ebrahim
Effects Of The Mortalin Inhibitor Mkt-077 On The Tumor Suppressor P53 In Neuroblastoma Imr-32 Cells, Yusuf Ebrahim
Honors Theses and Capstones
The tumor suppressor protein, p53, is an important cell cycle regulator in humans. Over half of all human cancers involve disruption of p53 function. One way this is achieved is by tethering p53 to the mitochondrial 70 kilodalton heat shock protein (Hsp70), mortalin, in the cytoplasm, and preventing p53 from entering the nucleus. The mortalin inhibitor, MKT-077, binds competitively to the p53 binding site in mortalin, and disrupts the p53-mortalin complex in cancer cell lines, allowing p53 to enter the nucleus and promote apoptotic cell death. Previous research reported that cytoplasmic tethering of p53 occurs in certain human neuroblastomas. Thus, …

Friend From France: The Popular Image Of The Marquis De Lafayette In Early America, Elisabeth Iacono
Honors Theses and Capstones
This paper addresses the impressions the Marquis de Lafayette made upon the American people during the American Revolution and his return tour in 1824. As someone who has admired Lafayette since I was young, I was aware of the fact that many locations are named after the general and that he plays a prominent role in shows such as the Broadway musical Hamilton. I wanted to study why Lafayette had such an impact on the American people, and why he has been memorialized in a positive manner. As a promoter of liberty, Lafayette was embraced by the colonists for his …
