Reporting The Irish Famine In America: Images Of "Suffering Ireland" In The American Press, 1845-1848, James M. Farrell
Reporting The Irish Famine In America: Images Of "Suffering Ireland" In The American Press, 1845-1848, James M. Farrell
Communication
This chapter is a study of American newspaper reporting on the Great Irish Famine. The study examines six master narratives that constrained the image of Ireland and the Irish people presented to American readers. Those narrative constraints predisposed Americans to respond with hostility when Irish Famine refugees began to arrive in the United States.
One And Inseparable: The Union And Deliberative Conduct In Webster's "Reply To Hayne.", James M. Farrell
One And Inseparable: The Union And Deliberative Conduct In Webster's "Reply To Hayne.", James M. Farrell
Communication
In Daniel Webster's view, the survival of the Union required not only an orator who could defend the Constitution as he did against Robert Hayne, but one who could embody the spirit of the constitution in deliberative performance. Webster uses his performance in debate not only to assail his opponent, defend New England, and expound on the Constitution, but further to demonstrate with his own oratory the abiding value of decorum, prudence, and eloquence in the national life. Webster becomes the ideal of deliberative performance as he contrasts his own conduct in debate with that of his Southern opponent. Webster’s …
The Child Independence Is Born: James Otis And Writs Of Assistance, James M. Farrell
The Child Independence Is Born: James Otis And Writs Of Assistance, James M. Farrell
Communication
This chapter is a reexamination of the Writs of Assistance speech by James Otis. In particular, it is a reconsideration of the evidence upon which rests the historical reputation of Otis’s address. Are the claims by historians who credit Otis with sparking the Revolutionary movement in colonial America warranted or not? That reassessment begins with a detailed review of the nature and function of writs of assistance within the political, legal, and economic environment of colonial Massachusetts. It then turns to an analysis of the legal dispute over writs of assistance in the 1761 trial. From there we will reconstruct …

Noel Canning And Remedial Obligation Under The Constitution, John M. Greabe
Noel Canning And Remedial Obligation Under The Constitution, John M. Greabe
Law Faculty Scholarship
There is a pervasive assumption that the Supreme Court's ruling in NLRB v. Noel Canning has rendered void the decisions of the Board during the period when it lacked a quorum because a majority of its members held their posts through unconstitutional recess appointments. The assumption is unfounded. The question of remedy for the wrong identified in Noel Canning should not be decided in the air; it should be decided contextually, as one involving whether and how to provide relief to parties affected by a wholly concluded constitutional violation, in a manner that is akin to harmless- and plain-error review.
Convict Voices: Women, Class, And Writing About Prison In Nineteenth-Century England, Anne Schwan
Convict Voices: Women, Class, And Writing About Prison In Nineteenth-Century England, Anne Schwan
University of New Hampshire Press: Open Access Books
In this lively study of the development and transformation of voices of female offenders in nineteenth-century England, Anne Schwan analyzes a range of colorful sources, including crime broadsides, reform literature, prisoners' own writings about imprisonment and courtroom politics, and conventional literary texts, such as Adam Bede and The Moonstone. Not only does Schwan demonstrate strategies for interpreting ambivalent and often contradictory texts, she also provides a carefully historicized approach to the work of feminist recovery. Crossing class lines, genre boundaries, and gender roles in the effort to trace prisoners, authors, and female communities (imagined or real), Schwan brings new insight …

Occupy Wall Street, Distributive Justice, And Tax Scholarship: An Ideology Critique Of The Consumption Tax Debate, Partrick Crawford
Occupy Wall Street, Distributive Justice, And Tax Scholarship: An Ideology Critique Of The Consumption Tax Debate, Partrick Crawford
The University of New Hampshire Law Review
[Excerpt] “This Article argues that the pro-consumption tax literature is wrong to claim that no legitimate fairness objections to the consumption tax exist. It argues that the persistent and widespread wariness about replacing our current hybrid consumption tax/income tax system with a pure consumption tax is, contrary to what the pro-consumption tax literature asserts, completely justified. In fact, our reservations about the consumption tax’s fairness reflect legitimate concern about the role of capitalist power in America, particularly over the past thirty years. Indeed, the more the nation continues to experience the social welfare effects of increased capitalist power, the more …

Competencies For The 21st Century: Teaching An Understanding Of Others, Critical Thinking, Leadership And A Sense Of Obligation. Perceptions Of Educational Leaders., Michael F. Schwartz
Doctoral Dissertations
In the 18th century, utilitarian writers highlighted the importance of a sense of obligation, an understanding of others, and the ability to think critically (Daniels, Bizar, & Zemelman, 2001; Kant, 1785/2008). Additionally, scholars stressed the importance of leadership (Burns, 1978). Teacher instruction in the 19th century incorporated many of these values (Kliebard, 2004). However as the common school developed in the early 19th century there was a shift from these values toward a common curriculum meeting industrial needs (Tyack, 1974). As the 20th century ended, significant federal and state legislation further funneled school curriculum to focus on very specific instruction …

The Foliose Bangiales (Rhodophyta) In The Northern Part Of The North Atlantic And The Relationship With The North Pacific Foliose Bangiales - Diversity, Distribution, Phylogeny And Phylogeography, Agnes Mols-Mortensen
Doctoral Dissertations
Foliose Bangiales species have a long history of study in the North Atlantic, but regions, especially in the northern parts, need more attention. Based on both new collections and herbarium material from Iceland, the Faroe Islands, West Greenland, UK, Norway, Sweden, Denmark and the Northwest Atlantic coast (from Newfoundland to Florida) the aim was to document diversity and distribution of foliose Bangiales species in the North Atlantic and to make floristic comparisons between the geographical areas. Species Identification was based on DNA sequences using the mitochondrial cox1, chloroplast rbcL and 3' rbcL + 5' rbcL-S markers. The North Atlantic species …

California – Land Of “Lawless Taxation” And The “Midnight Special”: Outlier Or Leader In A Growing Trend?, Mystica M. Alexander
The University of New Hampshire Law Review
[Excerpt] “Taxpayers in California recently found themselves the target of a retroactive grab for revenue by the Franchise Tax Board (FTB) in what has called an act of “lawless taxation” by the state of California. The source of the conflict was the Qualified Small Business Stock credit that had been in place in California since 1993. The tax credit, which was designed to encourage innovation and investment in California-based enterprises, allowed business owners who had at least eighty percent of their assets and employees in California to take a credit of fifty percent of the capital gain realized on a …

Securitize Me: Stimulating Renewable Energy Financing By Embracing The Capital Markets, Andrew C. Fink
The University of New Hampshire Law Review
The current system of financing renewable energy projects is broken and inadequate, especially when compared to the framework for participating in oil and gas ventures. The solution lies in borrowing accepted energy business practices and adapting them to solar and wind energy projects. This Article focuses on the current issues facing renewable energy project financing in the United States, analyzes failed attempts to stimulate growth, and presents the securitization of renewable energy assets as a solution. Drawing on current legal structure and debates from the corporate sphere, this Article also discusses specific securitization techniques that can help to democratize and …
The Changing Discourse Of The Supreme Court, Stephen M. Johnson
The Changing Discourse Of The Supreme Court, Stephen M. Johnson
The University of New Hampshire Law Review
[Excerpt] “Academics, judges, and other commentators complain that, for the past few decades, the Justices on the Supreme Court have been increasingly writing opinions that are unreadable for most American citizens. Those critics complain that the opinions are too long and too complex, riddled with incomprehensible multi-part tests. They also attack the style of the opinions and assert that recent opinions are more likely to be written in a technocratic, rather than persuasive, style.
There seems to be little consensus among the critics regarding why the Justices are writing opinions that are increasingly unreadable. Some attribute it to the increasing …

A Comparison Of Absolute And Relative Stand Density Measures Used In The Northeastern United States, Rachel Knapp
A Comparison Of Absolute And Relative Stand Density Measures Used In The Northeastern United States, Rachel Knapp
Master's Theses and Capstones
The quantification of observed stand density relative to a desired density, a measure known as relative density, is a critical component of many silvicultural treatments. Calculating stand density is more complicated when there are multiple species involved. I compared four regionally appropriate relative density measures to frequently used absolute density measures such as biomass, basal area, trees per area and stand density indices. I found absolute measures inferior to relative measures of stand density in that they lack an accepted reference point that allows for the comparison of one stand to the next in a meaningful and biologically accurate way. …

Instilling Diet And Exercise Confidence: Influence Of Nurse Body Size, Erin Murdock Spaulding
Honors Theses and Capstones
This paper reports a research study focused on perspective of nurse body size and how it affects confidence in a nurses’ ability to provide education on diet and exercise. The study followed a descriptive method design guided by a cross-sectional survey with quantitative variables. Results show that there is increased confidence in a nurse’s ability to provide education and influence habits regarding diet and exercise when the nurse role models such behaviors. Other findings presented include respondents’ perception of their body mass index versus their actual body mass index, percentage of respondents with health care conditions related to obesity, and …
