Taking Stock: Why The Supreme Court’S Decision To Apply The Market-Value Standard In Horne Ii Further Complicates The Just Compensation Requirement, Greg Seidner Nov 2016

Taking Stock: Why The Supreme Court’S Decision To Apply The Market-Value Standard In Horne Ii Further Complicates The Just Compensation Requirement, Greg Seidner

The University of New Hampshire Law Review

The Fifth Amendment’s Takings Clause does not prevent the federal (or a state) government from taking private property. It merely sets as a condition that the government pay the owner “just compensation” for the taking. Precisely what constitutes just compensation, however, is a tricky matter. One method for determining just compensation is the “market-value” method, which requires the government to pay the owner the property’s market value. But where a taking is only partial, that is, where the government takes only a portion of private property, the property that remains with the owner may see an increase or decrease in …

Preparing New Hampshire For Projected Storm Surge, Sea-Level Rise, And Extreme Precipitation: Final Report And Recommendations, New Hampshire Coastal Risk And Hazards Commission

PREP Reports & Publications

Coastal hazards associated with storm surge, sea-level rise, and extreme precipitation events can be devastating to human health and safety, public and private structures and facilities, and the economies of coastal communities. Coastal New Hampshire was fortunate to experience minimal damage from Tropical Storm Irene in 2011 and Superstorm Sandy in 2012. Nevertheless, the impacts of these storms on neighboring states and the more extreme local impacts from storms such as the Mother’s Day storm of 2006, the Patriots’ Day storm of 2007, and Winter Storm Nemo in 2013 have reinforced our knowledge that strong storm systems are capable of …

What Makes A Prion: Infectious Proteins From Animals To Yeast, Kyle S. Maclea Oct 2016

What Makes A Prion: Infectious Proteins From Animals To Yeast, Kyle S. Maclea

Life Sciences Faculty Scholarship

While philosophers in ancient times had many ideas for the cause of contagion, the modern study of infective agents began with Fracastoro's 1546 proposal that invisible “spores” spread infectious disease. However, firm categorization of the pathogens of the natural world would need to await a mature germ theory that would not arise for 300 years. In the 19th century, the earliest pathogens described were bacteria and other cellular microbes. By the close of that century, the work of Ivanovsky and Beijerinck introduced the concept of a virus, an infective particle smaller than any known cell. Extending into the early–mid-20th century …

Demographic And Economic Characteristics Of Immigrant And Native-Born Populations In Rural And Urban Places, Andrew P. Schaefer, Marybeth J. Mattingly

Carsey Publications

In this brief authors Andrew Schaefer and Marybeth Mattingly use American Community Survey five-year estimates to document demographic and economic characteristics of the immigrant and native-born populations in the United States by metropolitan status. They focus on a wide range of demographic and economic indicators that relate to immigrants’ ability to assimilate and thrive in rural America. They report that compared to the native-born rural population, rural immigrants are more likely to be of working age (18–64), are more racially and ethnically diverse, are less educated, and are more likely to have children. Working rural immigrants are nearly twice as …

Previous studies have investigated carotid artery intima-media thickness (IMT) and blood pressure and found a direct correlation between the two. It is known that adult females have better cardiovascular health than males until a certain stage of life, yet limited research has examined gender differences in vascular function. Thus, the purpose of this study was to investigate vascular structure and function, blood pressure, and blood glucose/cholesterol levels in relation to gender differences in young healthy adults. On three separate days, 44 adults (26.30 ±11.9yrs; 24M, 20F) completed a carotid IMT ultrasound, a flow-mediated dilation (FMD), a fasted glucose and cholesterol …
