Learned Hand And The Objective Theory Of Contract Interpretation, Daniel P. O'Gorman
Learned Hand And The Objective Theory Of Contract Interpretation, Daniel P. O'Gorman
The University of New Hampshire Law Review
When scholars discuss Judge Learned Hand’s approach to contract interpretation, they refer to him as a “great formalist commercial lawyer” who was a “pure objectivist” exhibiting a “crusader’s zeal” for the objective theory of contract. He is identified as a leading advocate of the classical approach to contract interpretation, which dominated American law in the late nineteenth and early twentieth centuries. But Hand’s reputation—built from three of his opinions—clashes with his reputation as a pre-Realist critic of formalism and as an intentionalist in statutory interpretation. This Article explores just how far Hand applied a strict objective approach to contract interpretation …

Doctrinal Evolution And The Right Against Self-Incrimination, Eliot T. Tracz
Doctrinal Evolution And The Right Against Self-Incrimination, Eliot T. Tracz
The University of New Hampshire Law Review
The Fifth Amendment’s right against self-incrimination is one of the most well-known constitutional protections as it is often referenced in movies, television shows, and in the news. Despite this wide-spread awareness of the right against self-incrimination, the Federal Circuit Courts remain split over whether the right attaches before or during trial. The specific point of contention is when a “criminal case” commences.
This article examines the history of the right against self-incrimination beginning with its common-law origins in Great Britain. The evolution of the right against self-incrimination is explored up to the present-day circuit split, and the cases involved in …

Family Perspectives On Newborn Screening For X-Linked Adrenoleukodystrophy In California, Katharina Schwan, Janey Youngblom, Kara Weisiger, Jessica Kianmahd, Rebecca Waggoner, Joanna H. Fanos
Institute on Disability
X-linked adrenoleukodystrophy (ALD) is caused by gene variants in the ABCD1 gene, resulting in a varied clinical spectrum. Males with ALD present with symptoms ranging from isolated adrenal insufficiency and slowly progressive myelopathy to severe cerebral demyelination. Females who are heterozygous for ALD typically develop milder symptoms by late adulthood. Treatment for adrenal insufficiency associated with ALD exists in the form of cortisol, and cerebral ALD may be treated with stem cell transplantation. Currently, there is no treatment for myelopathy. Since 2013, at least 14 states have added ALD to their newborn screening (NBS) panel, including California in 2016. We …

Sununu Approval Steady; Bipartisan Agreement Nh Headed In Right Direction 10/30/2019, Unh Survey Center
All UNH Survey Center Polls
Governor Chris Sununu remains popular nearly a year away from the 2020 election; six in ten New Hampshire residents approve of Sununu's performance as Governor while only a quarter disapprove. Nearly three-quarters of Granite Staters - and majorities of Republicans, Democrats, and Independents - believe the state is headed in the right direction. Residents continue to see drugs as the most important problem facing the state by a wide margin over any other issue.

Sanders, Warren & Biden Remain Top 3 Among Nh Dem Voters; Trump Holds Massive Lead Over Gop Rivals 10/29/2019, Unh Survey Center
All UNH Survey Center Polls
Vermont Senator Bernie Sanders, Massachusetts Senator Elizabeth Warren, and former Vice President Joe Biden continue to be the top three candidates in the Democratic field in New Hampshire, followed closely by South Bend (IN) Mayor Pete Buttigieg. However, support for Biden has declined since July. Likely Democratic voters see Sanders as the most progressive and most likeable candidate but continue to say Biden has the best chance to win the general election. Andrew Yang, Amy Klobuchar, and Tulsi Gabbard enjoy slightly higher support among NH voters than they did in July. President Trump continues to garner the vast majority of …

Facial Recognition And Drivers’ Licenses: Should The Dmv Share Your Photo?, Daniel Bromberg, Étienne Charbonneau, Andrew Smith
Carsey Publications
In this brief, authors Daniel Bromberg, Étienne Charbonneau, and Andrew Smith present the findings of a 2017 Granite State Poll asking New Hampshire residents how they feel about the Department of Motor Vehicles (DMV) sharing their driver’s license photos with the Federal Bureau of Investigations (FBI). Currently 21 states, though not New Hampshire, share DMV data with the FBI in support of its effort to build a massive database of over 400 million photos to which it applies facial recognition technology. The authors report that about 70 percent of Granite Staters support the state DMV sharing photos with the FBI …

All UNH Survey Center Polls
Optimism about business conditions in New Hampshire remains steady but pessimism about the U.S. economy in the next twelve months is at its highest point since 2014. A significant gap remains between Democrats and Republicans in their assessment of their personal finances but a majority of both groups think now is a good time to purchase a major household item.
