Reconsidering The Foregone Conclusion Doctrine: Compelled Decryption And The Original Meaning Of Self-Incrimination, Norman Hobbie Jr. Dec 2021

Reconsidering The Foregone Conclusion Doctrine: Compelled Decryption And The Original Meaning Of Self-Incrimination, Norman Hobbie Jr.

The University of New Hampshire Law Review

The Self-Incrimination Clause of the Fifth Amendment prohibits the government from compelling an individual “to be a witness against himself.” The Supreme Court of the United States has long interpreted “witness” as “one who gives testimony.” Undoubtedly, this interpretation prevents the government from compelling a witness to take the stand and testify to his own demise. This interpretation also extends to the act of producing documents, giving rise to the so-called “act of production” doctrine. Yet if a court deems the testimonial value of the act minimal—in other words, not “sufficiently testimonial”—the government can compel production under the “foregone conclusion” …

Law And Sampling Theory, Jack Thorlin Dec 2021

Law And Sampling Theory, Jack Thorlin

The University of New Hampshire Law Review

Law involves a fundamental tradeoff, a sampling problem. In science, sampling problems emerge when trying to understand something complicated by considering discrete, manageable subsets of it—samples. When doing that, scientists must compromise between accuracy and resource-expenditure. Perfect accuracy requires infinite resources, such as a perfect digital image with infinite file size. Perfection being unattainable, scientists must decide what level of accuracy is best for any given case. Every kind of law, from parking regulations to criminal to high constitutional theory, is subject to the same dynamic.

Law’s sampling problem is the tradeoff between accurate representation of a community’s moral preferences …

Exploring Mechanisms To Resolve Position And Intensity Disparities To Create A Combined Sidescan And Multibeam Sonar Backscatter Image, Clinton Marcus Dec 2021

Exploring Mechanisms To Resolve Position And Intensity Disparities To Create A Combined Sidescan And Multibeam Sonar Backscatter Image, Clinton Marcus

Center for Coastal and Ocean Mapping

The need for comprehensive seabed characterization has increased as fields such as offshore engineering and habitat management have expanded. Sidescan sonars and multibeam echosounders have generally been used as separate means to provide high-resolution imagery of the seabed, as there are a number of factors such as different grazing angles and high positioning uncertainty that prevent a cohesive product. By using the “true” position of a feature from a multibeam grid to reposition sidescan navigation data, the associated sidescan imagery positions are now recalculated with a reduced uncertainty. Once all sidescan navigation has been recalculated, the multibeam backscatter can be …

Monitoring Fine-Scale Forest Health Using Unmanned Aerial Systems (Uas) Multispectral Models, Benjamin T. Fraser, Russell G. Congalton Nov 2021

Monitoring Fine-Scale Forest Health Using Unmanned Aerial Systems (Uas) Multispectral Models, Benjamin T. Fraser, Russell G. Congalton

Faculty Publications

Forest disturbances—driven by pests, pathogens, and discrete events—have led to billions of dollars in lost ecosystem services and management costs. To understand the patterns and severity of these stressors across complex landscapes, there must be an increase in reliable data at scales compatible with management actions. Unmanned aerial systems (UAS or UAV) offer a capable platform for collecting local scale (e.g., individual tree) forestry data. In this study, we evaluate the capability of UAS multispectral imagery and freely available National Agricultural Imagery Program (NAIP) imagery for differentiating coniferous healthy, coniferous stressed, deciduous healthy, deciduous stressed, and degraded individual trees throughout …

Adsorption Of Helium On A Charged Propeller Molecule: Hexaphenylbenzene, Siegfried Kollotzek, Florent Calvo, Serge Krasnokutski, Fabio Zappa, Paul Scheier, Olof E. Echt Nov 2021

Adsorption Of Helium On A Charged Propeller Molecule: Hexaphenylbenzene, Siegfried Kollotzek, Florent Calvo, Serge Krasnokutski, Fabio Zappa, Paul Scheier, Olof E. Echt

Faculty Publications

Physisorption on planar or curved graphitic surfaces or aromatic rings has been investigated by various research groups, but in these studies the substrate was usually strictly rigid. Here we report a combined experimental and theoretical study of helium adsorption on cationic hexaphenylbenzene (HPB), a propeller-shaped molecule. The orientation of its propeller blades is known to be sensitive to the environment, with substantial differences between the molecule in the gas phase and in the crystalline solid. Mass spectra of HenHPB+, synthesized in helium nanodroplets, indicate enhanced stability for ions containing n = 2, 4, 14, 28, 42, …

Geostationary satellite measurements of aerosol optical depth (AOD) over East Asia from the Geostationary Ocean Color Imager (GOCI) and Advanced Himawari Imager (AHI) instruments can augment surface monitoring of fine particulate matter (PM2.5) air quality, but this requires better understanding of the AOD–PM2.5 relationship. Here we use the GEOS-Chem chemical transport model to analyze the critical variables determining the AOD–PM2.5 relationship over East Asia by simulation of observations from satellite, aircraft, and ground-based datasets. This includes the detailed vertical aerosol profiling over South Korea from the KORUS-AQ aircraft campaign (May–June 2016) with concurrent ground-based PM2.5 composition, PM10, and AERONET AOD …

The Limits Of Behavioral Economics In Tort Law, Daniel Pi Nov 2021

The Limits Of Behavioral Economics In Tort Law, Daniel Pi

Law Faculty Scholarship

Skeptics of rational choice theory have long predicted that behavioral economics would radically transform the legislation, adjudication, and analysis of law. Using tort law as an exemplar, this Article maps out the narrow set of conditions where substantive law can be modified to accommodate irrational decision-makers. Specifically, this Article demonstrates that if injurers are systematically biased, and the due care standard can be expressed quantitatively, and victims are unable to take meaningful precautions, then imposing punitive damages can induce irrational injurers to exercise efficient precautionary care. In all other cases, it is better that the law adopt a presumption of …

Classifying 3-D Models Of Coral Reefs Using Structure-From-Motion And Multi-View Semantic Segmentation, Jordan Pierce, Mark J. Butler Iv Oct 2021

Classifying 3-D Models Of Coral Reefs Using Structure-From-Motion And Multi-View Semantic Segmentation, Jordan Pierce, Mark J. Butler Iv

Center for Coastal and Ocean Mapping

Benthic quadrat surveys using 2-D images are one of the most common methods of quantifying the composition of coral reef communities, but they and other methods fail to assess changes in species composition as a 3-dimensional system, arguably one of the most important attributes in foundational systems. Structure-from-motion (SfM) algorithms that utilize images collected from various viewpoints to form an accurate 3-D model have become more common among ecologists in recent years. However, there exist few efficient methods that can classify portions of the 3-D model to specific ecological functional groups. This lack of granularity makes it more difficult to …

In situ measurements of aerosol microphysical, chemical, and optical properties were made during global-scale flights from 2016–2018 as part of the Atmospheric Tomography Mission (ATom). The NASA DC-8 aircraft flew from ∼ 84∘ N to ∼ 86∘ S latitude over the Pacific, Atlantic, Arctic, and Southern oceans while profiling nearly continuously between altitudes of ∼ 160 m and ∼ 12 km. These global circuits were made once each season. Particle size distributions measured in the aircraft cabin at dry conditions and with an underwing probe at ambient conditions were combined with bulk and single-particle composition observations and measurements of water …

Global-Local-Comparison Approach: Understanding Marine Mammal Spatial Behavior By Applying Spatial Statistics And Hypothesis Testing To Passive Acoustic Data, Hilary Kates Varghese, Kim Lowell, Jennifer L. Miksis-Olds Oct 2021

Global-Local-Comparison Approach: Understanding Marine Mammal Spatial Behavior By Applying Spatial Statistics And Hypothesis Testing To Passive Acoustic Data, Hilary Kates Varghese, Kim Lowell, Jennifer L. Miksis-Olds

Center for Coastal and Ocean Mapping

Technological innovation in underwater acoustics has progressed research in marine mammal behavior by providing the ability to collect data on various marine mammal biological and behavioral attributes across time and space. But with this comes the need for an approach to distill the large amounts of data collected. Though disparate general statistical and modeling approaches exist, here, a holistic quantitative approach specifically motivated by the need to analyze different aspects of marine mammal behavior within a Before-After Control-Impact framework using spatial observations is introduced: the Global-Local-Comparison (GLC) approach. This approach capitalizes on the use of data sets from large-scale, hydrophone …

Assessment Of Online Water-Soluble Brown Carbon Measuring Systems For Aircraft Sampling, Linghan Zeng, Amy P. Sullivan, Rebecca A. Washenfelder, Jack E. Dibb, Eric Scheuer, Teresa L. Campos, Joseph M. Katich, Ezra Levin, Michael A. Robinson, Rodney J. Weber

Faculty Publications

Brown carbon (BrC) consists of particulate organic species that preferentially absorb light at visible and ultraviolet wavelengths. Ambient studies show that as a component of aerosol particles, BrC affects photochemical reaction rates and regional to global climate. Some organic chromophores are especially toxic, linking BrC to adverse health effects. The lack of direct measurements of BrC has limited our understanding of its prevalence, sources, evolution, and impacts. We describe the first direct, online measurements of water-soluble BrC on research aircraft by three separate instruments. Each instrument measured light absorption over a broad wavelength range using a liquid waveguide capillary cell …

Futurama: An Immersive Experience Of America's Automotive Future, James Miller Sep 2021

Futurama: An Immersive Experience Of America's Automotive Future, James Miller

Journal of Motorsport Culture & History

General Motors’ Futurama exhibit at the 1939-40 New York World’s Fair offered a wildly popular immersive experience of American automobility twenty years in the future. The Fair proclaimed the “Dawn of a New Day” in “The World of Tomorrow” through comprehensive innovative architecture and design, which promoted the primary role of new technology, especially in the field of transportation. Futurama harnessed techniques of theatre and multi-media in unprecedented ways. Its narrow aim was to foster the construction of new highway systems hospitable to the growing population of modern cars. More broadly, Futurama sought to inculcate a new way of thinking …

Isolating Detrital And Diagenetic Signals In Magnetic Susceptibility Records From Methane-Bearing Marine Sediments, Joel E. Johnson, Stephen C. Phillips, William C. Clyde, Liviu Giosan, Marta E. Torres

Faculty Publications

Volume-dependent magnetic susceptibility (κ) is commonly used for paleoenvironmental reconstructions in both terrestrial and marine sedimentary environments where it reflects a mixed signal between primary deposition and secondary diagenesis. In the marine environment, κ is strongly influenced by the abundance of ferrimagnetic minerals regulated by sediment transport processes. Post-depositional alteration by H2S, however, can dissolve titanomagnetite, releasing reactive Fe that promotes pyritization and subsequently decreases κ. Here, we provide a new approach for isolating the detrital signal in κ and identifying intervals of diagenetic alteration of κ driven by organoclastic sulfate reduction (OSR) and the anaerobic oxidation of …

Nitrous acid (HONO) is an important precursor to hydroxyl radical (OH) that determines atmospheric oxidative capacity and thus impacts climate and air quality. Wildfire is not only a major direct source of HONO, it also results in highly polluted conditions that favor the heterogeneous formation of HONO from nitrogen oxides (NOx= NO + NO2) and nitrate on both ground and particle surfaces. However, these processes remain poorly constrained. To quantitatively constrain the HONO budget under various fire and/or smoke conditions, we combine a unique dataset of field concentrations and isotopic ratios (15N / 14N and 18O / 16O) of NOx …
