Interpreting Parenting Plans As Contracts, William B. Reingold Jr.

When parents are divorced or separated, a parenting plan serves as a legal instrument to govern the means by which they raise their children. Most parents are able to compromise and reach an agreed-upon parenting plan without resorting to a trial or court intervention. These agreed-upon parenting plans are, in a manner of speaking, contracts that these parents must abide by. But too often parenting plans are not treated or considered in the same way we perceive ordinary contracts. They should be. This essay examines the interplay between courts reviewing agreed-upon plans, the best interest standard, and basic contract interpretation.

Securities offered under exemptions such as Regulation Crowdfunding, Regulation A, and Rule 506 without registering with the Securities and Exchange Commission (SEC) are classified as exempt securities. These securities typically lack liquidity in the secondary market. However, the growing popularity of blockchain technology and smart contracts has made token offerings increasingly prevalent. Fintech firms like tZERO and Securitize provide services to tokenize securities that have already been offered, while numerous crypto trading platforms facilitate the trading of digital tokens. In theory, tokenizing exempt securities and making the resulting tokens available for resale on digital token trading platforms could grant these …

Tales Out Of School: Delineating Student Speech Protections For The Digital Age, Jason Zenor

The way students communicate has also changed greatly over the last generation, but in the first two decades of 21st Century, the U.S. Supreme Court had yet to answers questions about the extent of power for school administrators to control off-campus speech on digital technologies. Then in the case of Mahanoy Area School District v. B.L (2021) the U.S. Supreme Court finally answered this question by holding that administrators do have the ability to control off-campus speech. The Court did give some specific scenarios in which administrators had power to regulate off-campus, but it did not give a bright-line rule. …

The Crusading Days Of Jackie Stewart: Evaluating The Development Of Safety In Motor Racing During The 1960s., Alex Twitchen
Journal of Motorsport Culture & History
This article critically evaluates the contribution of Jackie Stewart in making motor racing a safer sport for competitors. It challenges the validity of the popular assumption that Jackie Stewart by himself developed a ‘culture of safety’ that transformed the sport. Instead, the role of other individuals are identified alongside the importance of three social processes. These processes are identified as the changing balance of power between different masculine identities, the development of commercial sponsorship and a growth in the coverage of the sport on television.

Federal courts were once seen as the place for partisan gerrymandering challenges to be lodged, but after thirty-plus years of failing to find any redistricting plan to be a partisan gerrymander, even while holding partisan gerrymandering to be justiciable, the Supreme Court announced in Rucho v. Common Cause, 139 S.Ct. 2484, that partisan gerrymandering is not justiciable in federal courts. State courts are now seen as the only place where a remedy for egregious partisan gerrymandering might be sought (except, of course, for taking redistricting out of the hands of the state legislature and moving responsibility into a bipartisan …

Total Vote Runoff: A Majority-Maximizing Form Of Rank Choice Voting, Edward B. Foley

Total Vote Runoff (TVR) is an electoral system designed to be identical to Instant Runoff Voting (IRV), which is the most commonly understood and implemented form of Ranked Choice Voting (RCV) in the United States, except for one key detail. Like IRV, TVR sequentially eliminates the weakest candidate on the ranked-choice ballot when no candidate is ranked first on a majority of ballots. Unlike IRV, however, TVR identifies the weakest candidate to be eliminated based on the total votes each candidate receives on all the ballots, rather than just the number of first-place votes (as IRV does). According to clear scientific consensus, no known technology can make internet voting secure. In some applications—such as e-pollbooks (voter sign-in), voter registration, and absentee ballot request—it is appropriate to use the internet, as the inherent insecurity can be mitigated by other means. But the insecurity of paperless transmission of a voted ballot through the internet cannot be mitigated.
The law recognizes this in several ways. Courts have enjoined the use of certain paperless or internet-connected voting systems. Federal law requires states to allow voters to use the internet to request absentee ballots but carefully stops short of internet ballot return …

In the past decade, adolescent mental health has become a prominent issue in America. Specifically, rates of mental illness among sexual and gender minority adolescents are increasing at rates higher than those of cisgender-heterosexual adolescents. As this issue has progressed, much literature has placed focus on the different stressors that may cause and exacerbate it. This study aimed to measure college students’ sense of personal efficacy and sense of belonging among various majors, specifically concerning the differences across gender identities. The findings thus indicate whether gender experience and norms impact some majors more than others, demonstrating how a history of male domination in certain fields can be internalized on a population level. A total of 300 respondents from a large public university in the northeast United States completed an online survey. Further, this literature review explores the association between Christianity and the Republican party throughout America’s political history, drawing on instances such as Proposition 187 and Donald Trump’s travel ban to display that white evangelicals are motivated to support Trump because of their fear of becoming a minority. Almost one-third of the U.S. student population consists of students with immigrant families. This study aimed to analyze whether there were differences in how students with immigrant parents and students without immigrant parents navigate the college system. This was done by specifically looking at parental nativity status (within the U.S. or not) and the use of academic resources on campus. It was performed through a convenience sample of a large North Eastern college and yielded a sample of 300 students. The study hypothesized that students who are first-generation-born were less likely to use academic resources. The majority of respondents were …

Marijuana policy has been a crucial debate for many years in America. Even with the legalization of marijuana in many states, Black people are still being arrested at an unjustified rate in contrast to white people. These differences have led to the overrepresentation of Black people incarcerated for this low-level crime as a direct result of the aftermath of the War on Drugs. All inventors should be compensated for the value of their contributions. Inventors contribute both to the patent system and to the technology commercialization process by providing access to a qualifying disclosure describing a qualifying idea. Yet today, a schism divides the patent world and the commercial world over the value of these inventive contributions. Unlike the commercial world, the patent world pays inventors for the contributions of noninventor technology commercialization roles. In particular, seminal reasonable royalty cases like Georgia-Pacific and TWM Manufacturing allow patentees to recover infringer profits and proxies thereof—in violation of congressional mandate and the Supreme Court’s opinion …

In 1975, the New Hampshire legislature enacted a progressive statute which mandated the Department of Health and Human Services “to establish, maintain, implement and coordinate a comprehensive service delivery system for developmentally disabled persons.” This law was innovative for its time; it decreed that individual service plans (ISPs) be developed for every client in the state’s service delivery system, guaranteed “a right to adequate and humane habilitation and treatment[,]” and contemplated the state’s area agency system as we know it today. The statute was a steppingstone for the 1981 class action lawsuit of Garrity v. Gallen. This was one of …

This literature review explores the relationship of how excess weight affects women's romantic relationships. Romantic relationship success has been assessed through the measures of body image and BMI. These similar measures of excessive weight were compared to determine the best measure/method to represent the relationship between excess weight and women’s romantic relationships. The hypothesis stated that excessive weight (in terms of body image, and not BMI) would decrease the overall success of women’s romantic relationships. Findings throughout this literature review have concluded that women have higher social pressure to be thin, women feel excess weight stigma more and this can …
