Municipal Corporations—Aesthetic Zoning Under The Police Power, W. D. Lorensen Jan 1955

Municipal Corporations—Aesthetic Zoning Under The Police Power, W. D. Lorensen

Nebraska Law Review

Plaintiff was denied a building permit solely on the ground that the village building board, composed of two architects and one other person, had failed to make a finding, as required by ordinance, that the “exterior architectural appeal and functional plan” of the proposed building would not be so at variance with other structures in the neighborhood as to substantially reduce property values. The trial court held the provision of the ordinance requiring the determination to be invalid and issued a peremptory writ of mandamus directing the building inspector to issue the permit, notwithstanding the decision of the board. Held: …

Trusts Under The New Code Where The Grantor Is Treated As The Substantial Owner, Barton H. Kuhns Jan 1955

Trusts Under The New Code Where The Grantor Is Treated As The Substantial Owner, Barton H. Kuhns

Nebraska Law Review

The provisions of Section 671 to 678 of the Internal Revenue Code of 1954 prompt a re-examination of the tax consequences of so-called short term trusts and other trusts. It is believed that heretofore many competent lawyers have shied away from recommending to their clients the creation of short term trusts, largely because of the wide range of uncertainties surrounding the principles under which the grantors of such trusts have been taxable. To a considerable degree, many of these uncertain elements have been removed, and it behooves lawyers once more to re-examine the possibilities of income tax savings for their …

Federal Procedure—Indispensability Of Superior Officers In Review Of Deportation Order, Clark Nichols Jr.

Nebraska Law Review

Plaintiff deportee brought an action against the District Director of Immigration and Naturalization seeking a declaration that a deportation order issued against him by the Commissioner of Immigration and Naturalization was invalid, alleging a lack of due process in the hearing and asking injunctive relief against the enforcement of the order. The defendant district director moved to dismiss the action for lack of an indispensable party. Held: the commissioner is not an indispensable party to an action to review an order of deportation.

The term “indispensable party” is used in the federal courts to describe a party without whom the …

Has Nebraska Solved The Problem Presented By The Uncompensated Victims Of Automobile Accidents?, Robert E. Roeder Jan 1955

Has Nebraska Solved The Problem Presented By The Uncompensated Victims Of Automobile Accidents?, Robert E. Roeder

Nebraska Law Review

Nine years ago the Nebraska Legislature enacted the Motor Vehicle Safety Responsibility Act in an attempt to solve the pressing social problem presented by uncompensated victims of Nebraska automobile accidents. The Supreme Court of Nebraska in upholding the act stated that its purpose was to protect the motoring public from the operation of motor vehicles by financially irresponsible persons. The act was designed to accomplish this purpose in two ways: (1) by the direct operation of its post-accident requirements and (2) by the indirect psychological effect of inducing owners and operators of motor vehicles to purchase automobile liability insurance to …

States—Device For “Avoidance” Of Constitutional Debt Limitation, Charles J. Burmeister Jan 1955

States—Device For “Avoidance” Of Constitutional Debt Limitation, Charles J. Burmeister

Nebraska Law Review

Provision in the Wisconsin Constitution that “The state shall never contract any public debt . . .” led the Wisconsin Legislature to authorize a complex plan for financing an extension to an existing state office building. Following statutory authority, the State Building Commission (hereafter called “the commission”) proposed to lease the existing building, and the land upon which it stood, to the Wisconsin State Public Building Corporation (hereafter called “the corporation”), a dummy corporation. The consideration was one dollar, and the lease was made on condition that the corporation construct a desired extension to the office building. The lease was …

Studies On The Helminth Fauna Of Alaska. Xxiv. Echinococcus Sibiricensis N. Sp., From St. Lawrence Island, Robert L. Rausch, Everett Schiller

Harold W. Manter Laboratory of Parasitology: Faculty Publications

As the result of field and laboratory investigations extending over a period of more than four years, we have amassed considerable information on the life cycle and ecology of a cestode of the genus Echinococcus (Rudolphi, 1801). Occurring on St. Lawrence Island, which lies in Bering Sea about 40 miles southeast of Cape Chukotskyi, northeast Siberia, this cestode not only has an interesting life cycle, but in the larval stage is an important parasite of humans.

Emily Dickinson's Approach To Poetry, Donald E. Thackrey Oct 1954

Emily Dickinson's Approach To Poetry, Donald E. Thackrey

University Studies (University of Nebraska) (1888–1984)

One of the most fascinating aspects of any poet is his conception of his art. Many poets have written extensively on the theory of art around which they orient their poetry. Others have clearly revealed their theories by writing criticism of other authors. Emily Dickinson, however, left no critical essays, no elucidation of her artistic principles. It is quite probable, indeed, that she did not consciously concern herself to any extent with poetic theory. She may have written, and written in her unique way, through an instinctive need which would admit of no plodding deliberation or stylistic experimentation. Still, such …

Studies On The Helminth Fauna Of Alaska. Xxii. Paranoplocephala Wigginsi N. Sp., A Cestode From An Arctic Ground Squirrel, Robert L. Rausch

Harold W. Manter Laboratory of Parasitology: Faculty Publications

During the summer of 1953, Mr. Edward T. Roche, of the Department of Zoology, University of Southern California, continued observations on the life history of the ground squirrel, Citellus undulatus barrowensis (Merriam), along the Meade River south of Point Barrow, Alaska. In the course of this work, 55 ground squirrels were examined for intestinal parasites, and were found commonly to harbor cestodes. Mr. Roche kindly offered a number of these cestodes to the writer for study, and they represent an undescribed species of Paranoplocephala Liihe, 1910.

In appreciation of the generous cooperation extended to the personnel of this laboratory by …

Studies On The Helminth Fauna Of Alaska. Xxi. Taxonomy, Morphological Variation, And Ecology Of Diphyllobothrium Ursi N. Sp. Provis On Kodiak Island, Robert L. Rausch

Harold W. Manter Laboratory of Parasitology: Faculty Publications

According to Eguchi (1934), two species of salmon (Oncorhynchus) serve as a source of human infection by a cestode identified as Diphyllobothrium latum (Linnaeus, 1758), in Japan. The possible role of these fishes in the transmission of cestodes to humans and other animals has not been investigated in North America, nor, apparently, on the Eurasian mainland. However, Ward (1930) reported unidentified Diphyllobothrium-like plerocercoids from Alaskan salmon; Simms and Shaw (1931) collected plerocercoids identified as D. cordiceps (Leidy, 1871) from Oncorhynchus kisutch (Walbaum) from lakes in Oregon; and Wardle (1932) reported plerocercoids of Diphyllobothrium spp. from O. kisutch …

The Lynch Site, 25bd1, Mary Louise Freed Sep 1954

The Lynch Site, 25bd1, Mary Louise Freed

Department of Anthropology: Theses and Student Research

One of the aims of anthropology is the study of the growth and change of cultures. The data on which the realization of this aim depends include reports upon single archeological sites or the ethnographies of a group of people. These data, however, are of little value as long as each report remains a unique entity, hanging in time and space. For the study of culture growth and change each must be seen in its proper perspective against the known total of history. This archeological report presents pertinent material for the study of some of these historical phenomena in the …
