The Rule Against Contribution And Its Status In Nebraska, Donald R. Wilson

Nebraska Law Review

It is the purpose of this article to present two distinct phases of the law of contribution between joint tortfeasors. The first section includes a brief summary of the background for the “no contribution” rule along with a discussion of a recent case which relaxes the stringent requirements for recovery. The second section deals exclusively with the Nebraska law on this issue and endeavors to determine Nebraska's exact position as to the allowance of contribution between negligent joint tortfeasors.

Defendant was convicted of violating a curfew ordinance prohibiting presence on the streets after a certain hour where such presence is unconnected with some legitimate business, trade, profession, or occupation. Held, judgment reversed. The ordinance is invalid as an arbitrary invasion of the inherent personal rights and liberties of all citizens, and unconstitutional under the California Constitution. This case was decided under the so-called “liberty clause” of the California Constitution, which is similar to the Ninth Amendment to the United States Constitution. In Naphtali v. Lafazan, defendant and his wife accepted the invitation of plaintiffs, husband and wife, to accompany them on a pleasure trip in an auto owned by plaintiff-husband. It was understood that the expenses of operating the auto were to be borne by plaintiff-husband. As the party proceeded along an Ohio highway, with the defendant driving, the auto left the highway and overturned, injuring the plaintiffs. Suit was instituted in New York, alleging defendant’s ordinary negligence and praying damages for the injuries sustained. Defendant relied upon the Ohio Guest Statute, arguing that plaintiffs were “guests” in the auto …

Effect Of Change In Moment Of Inertia On The Intensity Distribution In P And R Branches Of C OoV Molecules, Gordon A. Gallup

The effect of the change in moment of inertia part of the interaction between vibration and rotation on the intensities of parallel bands of linear polyatomic molecules has been determined to the first order. The results are quite similar to those of Herman and Wallis for diatomic molecules. The interaction term depends on among others a quantity, ξ k, different in general for each band. Perpendicular bands do not show a first-order correction. A ``sum rule'' for the ξ k has been determined.

Approximately three and one-third million acres of native prairie are harvested annually in Nebraska for hay. In the four-year period 1948-1951, the State ranked first in wild hay production with an average yield of more than two and one-quarter million tons per year. This crop is an important natural resource in Nebraska's livestock industry. Studies were initiated in 1945 to determine the effects of time of cutting on the yield and feeding value of prairie hay in southeastern Nebraska. The purpose of this paper is to estimate the amount of ground water flowing across the South Dakota-Nebraska State line within the Niobrara River basin, including the Ponca Creek basin.
